RESOLUTION NO. 7 -1964
RESOLUTION ANNEXING TO THE CITY OF FRIDLEY THAT PART OF 44TH AVENUE EXTENDED
WEST OF THE COLUMBIA HEIGHTS CORPORATE LIMITS AT MAIN STREET NORTHEAST
WHEREAS, the City of Columbia Heights did by Ordinance No. 566 adopted
on the 26th day of August, 1963, detach from the corporate limits of the
City of Columbia Heights and transfer to the City of Fridley the property
described as follows;
That part of Lot 8, Auditor's Subdivision #39 lying between a
line 40 feet northerly of the following described line: Commencing
at a point 1127 feet west of monument M.S.C. 1050 as shown on said
Auditor's Plat of Auditor's Subdivision 39 which said point is on
the center line of 43rd Avenue as now surveyed and laid out in the
town of Fridley, thence along a curve to the left in a northeasterly
direction with a radius of 636.6 feet, and an angle of 380 12',
thence along a tangent to curve in a northeasterly direction for
a distance of 610 feet, thence on a curve to the right in easterly
direction with the same radius and angle to.the westerly line of
Main Street N.E. as now surveyed and laid out, and a line 40 feet
northwesterly of the following line:
Commencing at a point in center line of 43rd Avenue N.E. distance
of 1139.65 feet, west from its intersection with the east line of
N.E.-'4 of N.E,4 of Section 34, Township 30, Range 24, thence north-
easterly on a tangental curve convex to south the radius of 573.27 feet,
• distance of 422.4 feet, thence northwesterly tangent to the curve
• distance of 539.8 feet, thence on tangent curve to the right the
radius of 560.85 feet a distance of 421,57 feet to a point in center
line of 44th Avenue N.E. a distance 32 feet east from the west line
of the N.W.4 of the N.W.4 of Section 35, be and the title to same is
hereby transferred to the City of Fridley.
AND WHEREAS, Section 414.06, Subdivision 2, of Minnesota Statutes provides
that property in one municipality and contiguous to another may be concurrently
detached and annexed by an adjoining municipality.
NOW, THEREFORE, BE IT RESOLVED, By the City of Fridley as follows:
Section 1: That the area or land described in Ordinance No. 566
of the City of Columbia Heights passed August 26, 1963, as described
above be annexed to -the City of Fridley.
Section 2: That a certified copy of this Resolution together with
a certified copy of Ordinance No. 566 of the City of Columbia Heights be
filed with the Municipal Commission, 51 State Office Building, St. Paul, Minnesota.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY
