RES 1964-132 - 00011748188 RESOLUTION NO. 132-1964 A RESOLUTION ORDERING IMPROVEMENTS, APPROVAL OF PLANS, AND ORDERING ADVERTISEMENT FOR BIDS (PROJECT N0. 67) WHEREAS, the resolution of the City Council adopted the 4th day of May, 1964, set the date for hearing on the proposed improve- ments, as specifically noted in the notice of hearing attached hereto for reference as EXHIBIT "A ", and WHEREAS, all the property owners whose property is liable to be assessed with the making of these improvements (as noted in said notice) were given ten (10) days notice by mail and published notice of the Council hearing through two (2) weekly publications of the re- quired notice, and the hearing was held and the property owners heard thereon at the hearing, as noted in said notice. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley, Minnesota, as follows: 1. That the following improvements heretofore proposed by Council resolution are hereby ordered to be effected and completed as soon as reasonably possible, to wit: (a) All of the improvements as noted in the notice of hearing on the same as are noted (in Exhibit "A" in said notice) except (none); that the work involved in said improvements as listed above shall hereafter be designated as: SANITARY SEWER AND WATER IMPROVEMENT PROJECT NO. 67 -1964 2. The plands and specifications prepared by Comstock and Davis, Inc., Consulting Engineers, for such improvements and each of them, pur- suant to the Council resolutions heretofore adopted, a copy of which plans and specifications are hereto attached and made a part hereof, are hereby approved and shall be filed with the City Clerk. 3. The work to be performed under SANITARY SEWER AND WATER IMPROVEMENT PROJECT NO. 67 -1964, shall be performed under one contract. The City Manager shall accordingly prepare and cause to be inserted in the official newspaper advertisements for bids upon the making of such improvements under such approved plans and specifications. The advertise- ment shall be published for three (3) weeks (at least 21 days), and shall specify the work to be done and will state that bids will be opened and considered at 12:00 Noon, on the 7th day of July, 1964, in the Council Chambers of the City Hall, and that no bids will be considered unless sealed and filed with the City Clerk, and accompanied by a cash deposit, bid bond, or certified check payable to the City for five percent (5 %) of the amount of such bid. That the advertisement for bids for SANITARY SEWER AND WATER IMPROVEMENT PROJECT NO. 67 -1964 shall be substantially in form as that noted in Exhibit "B" attached hereto for reference and made a part hereof. RESOLUTION NO. 132 -1964 (Continued) OFFICIAL PUBLICATION CITY OF FRIDLEY (EXHIBIT A) NOTICE OF HEARING ON IMPROVEMENTS WATER AND SEWER PROJECT r#67 WHEREAS, the City Council of the City of Fridley, Anoka County Minnesota, has deemed it necessary and expedient that the improvements hereinafter described be made. NOW, THEREFORE, NOTICE IS HEREBY GIVEN THAT on the 2nd day of June, 1964, at 8:00 o'clock P.M., the City Council will meet at the City Hall in said City, and will at said time, and place, hear all parties inte- rested in said improvements in whole or in part. The general nature of the improvements is the construction (in the lands and streets noted below) of the following improvements, to wit: CONSTRUCTION ITEM A. Water Lateral and Service Connections and Sanitary Sewer Lateral and Service Connections located in all of the streets and serving all of the area described as: 1) Fireside Drive from Central Avenue to Hayes Street ?) Hayes Street from Fireside Drive to 75th Street 3) Dalberg Terrace - McKinley Street, Arthur Street, etc. 4) Riverwood Manor from 71st Way and Riverview Terrace 5) East Service Drive, East River Road, Hillcrest addition 6) Property bounded on the north by Osborne Road, on the west by T.H. ; -;65, and on the east by Central Avenue and on the south by Fireside Drive. B. Water Lateral and Service Connections located in the following street and serving all of the area described as: 1) Washington Avenue N.E. between 57th Avenue N.E. and 58th Avenue N.E. C. Sanitary Sewer and Service Connections located in the following street and serving all of the area described as: 189. 1) Central Avenue - 330 feet south from 73rd Avenue N.E. (west side). ESTIMATED COST . . . . . . . . . . . . . . . . . . . . $1289201.40 THAT THE AREA PROPOSED TO BE ASSESSED FOR SAID IMPROVEMENT IS AS FOLLOWS: For Construction of Items A. B. and C, above - - - - - - - - - - All of the land abutting upon said streets named above and all lands adjacent and abutting thereto. All of said land to be assessed proportionately according to the benefits received by such improvements. ' That the Council proposes to proceed with each of said improvements as separate improvements, except as hereafter otherwise provided by the Council all under the following authority, to wit: Minnesota Laws 1953, Chapter 398 and laws amendatory therecf, and in conformity with the City Charter. NOTICE TO CONTR.ICTORS (EXHIBIT B) Settled bids will be received and publicly opened by the City of Fridley, Anoka County, Minnesota, at the office of the City "Tanager, on the 7th day of July, 1964 at 12:00 Noon, and will be considered by the City Council of the City of Fridley, at a regular Council Meeting, at 8:00 P.M. on the 7th day of July, 1964 for the furnishing of work and mater- ials for the installation of Sewer and :later Improvement Project No. 67 and Storm Sewer Improvement Project No. 68 -. The projects consist -of the following approximate quantities: 7,100 Lin. Ft. 8" Sanitary Sewer Lines with sewer service lines and appurtenances 500 Lin. Ft. 4" Force Main 1 Factory Built Lift Station 10,000 Lin. Ft. 6" - 8" Water Lines with water service lines and appurtenances 2,300 Lin. Ft. 12" - 21" Storm Sewer Lines with appurtenances A11`in accordance with plans and specifications prepared for the City of Fridley, Minnesota, by Comstock & Davis, Inc., Consulting Engineers, 1446 County Road "J ", Minneapolis, Minnesota, 55432, Telephone: SU. 4-931+6. Plans and specifications may be examined at the office of the City Manager, and copies may be obtained for the Contractor's individual use by applying to the Engineers and depositing with the Engineers $25.00 for each set. The deposit will be refunded to each bidder sub - mitting a bonafide bid upon return of the documents in good condition within ten (10) days from the date of opening bids and to non - bidders upon return of the documents in good condition prior to the bid opening. Bids must be made on the basis of cash payment for the work, and accom- panied by a cash deposit, certified check (on a responsible bank in the State of Minnesota), or a. bidder's bond and made payable without condi- tion to the City of Fridley, Minnesota, in an amount of not less than 5% of the total amount of the bid. The City Council reserves the -right to reject any and all bids and to waive any informalities in any bids received without explanation. No bid may be withdrawn for a period of thirty (30) days.
