RES 1964-211 - 000118633 RESOLUTION NO. 211 -1964 A RESOLUTION ESTABLISHING A POLICY CONCERNING THE FSSESS- MENTS OF BEIZFITTED PROPERTY FOR STORK SE,:�RS IN THE CITY OF FRIDLEY WHEREAS, the City of Fridley has heretofore and will in the future construct and make public improvements for the control of storm, drainage, and sub -soil waters, and WHEREAS, an appeal by a property owner of certain parcels assessed by the City for storm sewer Project No. 24B resulted in a stipulated dismissal of the existing assessments on said parcels, and WHEREAS, the City of Fridley has carefully reviewed its past practice of assessing the property benefitted at a single rate for all property, and WHEREAS, it does appear that special improvements enhance large tracts of undeveloped property insofar as fair market value is con- cerned at a ratio many times greater than smaller, odd - shaped and improved tracts, and 1,1HEREAS, it does appear that large tracts, within the City of Fridley, that have been zoned for heavy industry use and that have available to the tract railway trackage are enhanced in value at a ratio many times greeter than smaller tracts without such trackage. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley, that hereinafter on all assessments for storm sewer pub - lie improvements that any large and undeveloped tracts that have a ' disproportionate enhancement in fair market value because of size and undeveloped state to smaller, odd- shaped or improved areas be so classified as to equitably share the real and actual benefit of the public improvement. AND FURTHER, that the City Manager shall examine all of the existing storm sewer projects and where it appears that the total costs of the particular project have not been fully spread on the assessment rolls that he together with the City Engineer, the City Finance officer, and the City :attorney study the area involved to the end that the undeveloped tracts in said area be re- assessed in accordance with this resolution. AND FURTHER, that the formula to be applied shall be similar in ratios and classification to that used in the re- assessment hear - ings on Project No. 24B as follows: Class 1 Per 100 square feet Property in zoning districts R- 1- 2 -3 -4 -5 a.91 of less than 100 acres with one ownership of contiguous parcels. Class 2 Property in R- 1- 2 -3 -4 -5 of more than 100 $3.82 acres with one ownership of contiguous parcels. Class Property in C- 1 -2 -2s of less than 30 acres $1.91 with one ownership of contiguous parcels. RESOLUTION NO. 211 -1964 (Continued) Class 4 Per 100 square feet Property in C- 1 -2 -2s of more than 30 acres $3.82 with one ownership of contiguous parcels Class Property in M -1 of less than 120 acres $1.91 with one o�mership of contiguous parcels, or without trackage Class 6 Property in M -1 of more than 120 acres $5.73 and with one ownership of contiguous parcels with trackage. Class 7 Property in M -2 of less than 120 acres $1.91 and with one ownership of contiguous parcels.
