RESOLUTION NO. 225A -1964
A RESOLUTION TO ACQUIRE AN EASEMENT FOR UTILITY PURPOSES -
PROJECT 5B (LOT 5, BLOCK 3, BEhNETT PALMER ADDITION)
WHEREAS, it is necessary to acquire an easement for utility
purposes in connection_ with the storm sewer and other utility cons-
truction involved with Project 5B, and
WHEREAS, the Contract has been let for the construction work
in Project 5B, and
WHEREAS, a voluntary easement was contemplated for the ease-
ment necessary in Lot 5, Block 3, Bennett Palmer "addition, but that
said easement has not been forthcoming, and
WHEREAS, the City Council has previously determined that the
Project was feasible and necessary, and has approved the plans and
specifications, and
WHEREAS, the easement that is required rmay be more fully des-
cribed as follows:
A permanent easement over the South 10 feet
of Lot 5, Block 3, Bennett Palmer Addition,
according to.the map or plat thereof on file
and of record in the office of the Register
of Deeds in and for 1 -noka County, Minnesota,
and to €ether with a construction easement for
a temporary period over the following des-
cribed land: The North 1C feet of t-e South
20 feet of Lot 5, Block 3, Bennett i -almer
Addition, according to the map or plat there-
of on file and of record in the office of the
Register of Deeds in and for Anoka County,
Minnesota.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Fridley, Anoka County, Minnesota, as follows:
I_ It is necessary for the purpose of storm sewer and utility
construction that the above stated easement be taken;
2. That said easement is to be used for utility purposes;
3. That the attorneys for the City are authorized and directed
to acquire such easement by condemnation action in Anoka County Dis-
trict Court.
