RES 1964-226 - 0001188828 RESOLUTION NO. 226 -1964 A RESOLUTION GRANTING AUTHORITY TO GIVE AN EASEMENT TO THE NORTH SUBURBAN SANITARY SEWER DISTRICT ACROSS LOCKE PARK WHEREAS, the City of Fridley has a need of a sanitary sewer line North of Rice Creek and running to the Easterly edge of the City, and WHEREAS, it does appear that the North Suburban Sanitary Sewer District has plans for a trunk line commencing at the Nor- thern Pacific and Great Lorthern Railway right -of -way and running Easterly from the railroad right -of -way and along the old Minnesota Transfer railroad rirrht -of -way to the East boundary of the City of Fridley, and WHEREAS, said District Line as previously proposed would be so constructed as to have no practical use to take care of sanitary sewer needs in a portion of the City not presently served, and WHEREAS, the said Sewer District, after study, has proposed that it would make the trunk line running from the railroad right - of -way to the East Boundary of the City a gravity line that would be more accessible and economical for use by the City of Fridley, and would bear the additional cost and expense of said gravity line if the City of Fridley would permit and allow said line to be constructed on the North boundary of Locke Park. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley, that the City give an easement without cost along the North boundary of Locke Park to the said Sewer District in exchange for the said District altering its previous plans so as to construct a gravity trunk line on said easement. That the City Manager shall immediately do what is necessary to have an easement prepared containing the description of the easement. That the Mayor and Manager be authorized and directed to sign such an easement to the Sewer District on behalf of the City of Frid- ley. That this Resolution and the said easement shall not constitute a waiver of any rights or privileges that the City of Fridley may.have under its present contract with the Sewer District.
