RESOLUTION NO. 252 -1964
A RESOLUTION ORDERING CONDEMNATION cF SEWER AND WATER PiiOJECT NO. 70
WHEREAS, it is necessary to acquire an easement for utility pur-
poses in connection with the Sewer and Water rroject No. 70, and in
connection therewith to have an easement for street purposes, and
WHEREAS, the contract for the construction work is pending be-
fore the City Council, and
WHEREAS, the City Council has previously determined that the
Project was feasible and necessary, and has approved the plans and
specifications, and
WHEREAS, an attempt has been made to obtain the easement volun-
tarily and by negotiation with the property owners involved but that
said attempt has been a failure, and
WHEREAS, the easement that is required may be more fully des-
cribed as follows:
An easement for Riverview Terrace to be a
street 40 feet in width and running between
61st '.lay and Mississippi Place, and that said
property is more fully and particularly des-
cribed in the plans and drawings in connection
with Sewer and Water Project No. 70; that said
proposed street is located in the City of _'rid-
ley, rnol-a County, State of Minnesota.
NOW, THEREFORE, EE IT RESOLVED by the City Council of the
City of Fridley, Anoka County, Minnesota, as follows:
1. It is necessary for the purpose of sewer and water utilities,
for other utility purposes, and for street purposes; that the
above stated easement be taken;
2. That said easement is to be used for street and utility
purposes.
3. That the attorneys for the Oitj, are authorized and directed
to acquire such easement by condemnation action in Anoka County
District Court.
