ROLL CALL: Nlembers Present: Nee, Kirkham, Sheridan, Wright, Thompson Members Absent: None BUILDING PERMIT - 451 - 57TH PLACE - ERICK ERICKSON: Mr. Erickson was present at the Council Meeting. He did not have a site plan of his property. Mr. Erickson said that h�.s property consits of three 40 foot � lots combined to a 120 foot frontage. He said the house is built on the middle lot and is 24 feet wide. He stated that he would like to build a 12 foot addition to his house leaving approximately a 40 foot side yard on either side of the house. He stated that he also would like to rebuild his garage upon the existing slab. He said the ga�age slab is on the east side of his house and he wishes to build the addition to the west side of his house, fIe stated that temporary repairs to the garage and the addition to the house amount to $3000. Mayor Nee asked Mr. Erickson if he knew he would have to bring in a site plan and Mr. Erickson answered, "Yes". Mr. Erickson asked whether his home wi11 be taken for Urban Renewal. Mayor Nee said that he does not know, that this would be up to the Faidley Aousing and Redevelopement Authority. Mr. Erickson said that if his home is taken for Urban Renewal within two years it would not pay him to build the addition and the garage 12� Motion by 6dright to grant the request of Mr. Erick Erickson for a@u�lding Permit to build a 12 foot addition to h1s home and rebuild his garage at 451-57th Place. Seconded byySheridan. Upon a voice vote, there being no nays, the motion carried unanimously. BUILDING PERMIT - 359 - 57TH PLACE - LEONARD WEIGEL: Mr, and Mrs. L,Teigel were present at the Council Meeting. The Mayor stated that this question had heen referred to the acting City Attorney for an opinion and the Council had the opinion of the acting City Attorney. Councilman Wright said that in light of the information presented by the , acting City Attorney, he moves to grant the request.of Leonard Weigel for a Building Permit to make repairs to his 8-plex located at 359 - 57th Place N.E. Seconded by Thompson. Upon a voice vote, there being no nays, the motion carried unanimously. BUILDING PERMIT - PHILLIPS PETROLEiIM COMPANY - 5755 iTNIVERSITY AVENI7E: Mr. $chlesinger, representative of White Investment Company, Mr. Petrie, representing the Phillips Petroleum Company, and Mr. Gibbs, representing Ranco Schuur were present at the Council Meeting. Mr. Gibbs stated that the Phillips Petroleum Company would like it under- stood that the plan presented to the Council is an alternate plan and the Pfiillips Petroleum Company prefers the original plan with a service road located on the west property line. Mr. Gibbs said that moving the service ro2d in�ures the property of the Phillips Petroleum Company, and �.f the service road is moved back Phillips 66 would wish to build accnrding to the origrnal plans. Mr, Petrie showed the alternate plan with the service road located to the east of the property and the original plan with the service road located to the west of the property, to the Council. Mayor Nee asked' Mr. Gibbs wh�ther the alternate plan is based upon an agreement with the Minnesota Highway Department for the location of this service road. Mr. Petri answered that no formal agreement has been made with the Minnesota Highway Department concerning the location of the service road, Mr. Petri also � pointed out that the alternate plan was not drawn on the basis of a legal survey, but that it is based upon the original survey of the property when the serv.tce road was located to the west of the property. Councilman Wright asked Mr, Petri whether he understood that Phi111ps Petroleum Company will recej�ve vacated land from the service road located west of the property, Mr. Petrie answered, "Yes". Mayor Nee asked Mr. Petrie whether he had assurance from the Minnesota Highway Department that the access to the property can be where it was as shown on the alternate plan. Mr. Petrie answered that the Minnesota Highway Department has not agreed to anything. There was a lengthy discussion of the p1an, the set backs, the traffic pattern and other possible building arrangements. Mayor Nee asked Mr. Petrie and Mr. Gibbs if the Council would give hinding assurance that the Council wi11 give a Building Permit, would that be sufficient, rSr. Petrie said that he wants the Building Permrt, Mayor Nee asked whether a resolution of the Council to grant a Building Permit for construction upon the land, whatever the description of the property will be, would be sufficient. Mr. PetrLe stated that he wished to have the Building Permit, and that the exact description of the property including easements to be given to Phillips Petroleum Company should be included with the Building Permit. Councilman Wright asked whether it would be possible to define the property in the resolution as a parcel of land. This question was referred to the City Attorney. Mayor Nee informed the City Att'orney that Phillips Petroleum Company caished a firm committment to obtain a Building Permit even � though the easements and vacations of land to be included in this property are not drawn. The City Attorney stated that a resolution granting a Building Permit sub�ect to receipt of an agreeable site plan should be sufficient for Phillips Petxoleum Company to exercise its option and purchase the property, Motion by Wright to pass a resolution, to be drafted in final form by Mr. Suster, saying that the Council has no ob7ection to granting a Building Permit to the Phillips Petzoleum Company, that the Council will not deny the Bullding Permit to the Phillips Petroleum Company and will in fact grant a Building Permit to the Phillips Petroleum Gompany upon presentation of a satisfactory site plan to the Council for construction of a Phillips 66 Station and restaurant upon the property located at 5755 University Avenue N,E. Seconded by Kirkham. Upon a voice vote, there being no nays, tlze motion carried unanimously. 129 BUILDING PERNIIT - 6473-6481 UNIVERSITY AVENUE N.�. - ART CFII2ISTGNSEN: Mr. Robert Christensen, Mr, Art Christensen, and Mr. Gibbs, Attorney for the Christensens, were present at the Council Meeting. Mayor Nee asked Mr. Christensen whether he wished to postpone consideration af the Building Perntit until after the discussion with the Fridley Housing and Redevelopment Authority. Mr. Christensen stated that he refers this question to his Attorney. Mr. Gibbs indicated that he wished to consider the Building Permit immediately, Mayor Nee stated that the Council could grant or not grant the Building Permit and that the decision was up to the Council. � Motion by Kirkham to grant a Building Permit to Arthur Christensen For repa�r of his property at 6473-6481 University Avenue N. E. Seconded by Sheridan. Upon a voice vote, there being no nays, the motion carried unanimously. (APPROVAL OF MINUTES - AUGUST 4, 1965 top of next page) PUBLIC HEARING• — IMPROVEMENT - PORTION OF STREET 1965-1 (HEL�NE PLACE ANA QUINCY): The City Manager read the notice of hearing. Mayor Nee announced that the Council had available for property owners calculations of proposed assessments based on the contract £or Street Project 1965-1. IIe asked if any property owners wished to hear the amount of proposed assessment against their property for this improvement. None of the property owners asked for these amounts A property owner, Walter McGaughey, 701 Helene P1ace, was present at the � Council Meeting. He stated that he wished to have the Council repair the hole in the street in front of his property. He stated that whenever it rains he gets water in his basement and he wishes the CLty to fix the drainage tile in front of his property immediately before the rest of the improvement is completed. He stated that he has the lowest property in this immediate area and most of the rain water drains into has property. He stated that he wishes to go on record as being inlfavor of the improvement. Mayor Nee informed Nir. McGaughey that the proposed improvement includes repair of the tile. Mr. McGaughey asked the City Engineer whether the City could fix the drain tile the following day. The City Engineer answered that the conCractor would start woxk the following day az�d install additional tile to connect the drain tile system to the storm sewer system.
