RESOLUTION NO. 210 -1965
A RESOLUTION AUTHORIZING THE EXECUTION OF THE PERMIT
AGREEMENT IN CONNECTION WITH STORM SEWER PROJECT #12
THROUGH PROPERTIES OF THE NORTHERN PACIFIC RAILWAY
'COMPANY AND THE GREAT NORTHERN RAILWAY COMPANY, UPON
CCNDITICNS, AND ALTITWATIVELY TO CONDEMN LANDS.
WHEREAS, the City Council has heretofore let a contract for the
construction of Storm Sewer #12 on and across properties of the Northern
Pacific Railway Company and the Great Northern Railway Company;
AND, WEREAS, it is necessary to acquire the right and permission
to cross the lands of said railway companies,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of =-
Fridley, Minnesota, that the Mayor and Manager be authorized and directed
to execute in behalf of the City of Fridley an agreement with said railway
companies identified as Permit No. 96908 and to pay said railway companies
the sum of $570.00 as provided for in said Permit, provided however that
paragraph numbered 8 be deleted from said Permit.
AND BE IT FURTHER RESOLVED, that in the event the Permit Agree-
ment cannot be consummated by such deletion of Paragraph 8, that the City
Attorney be authorized to forthwith commence condemnation proceedings so
as to acquire the necessary easements across said railway lines by the
exercise of the right of eminent domain.
