RES 1965-58 - 00011337e M RESOLUTION NO. 58 -1965 A RESOLUTION WAIVING THE RESTRICTION ON THE CONSULTING ENGINEERS OF THE CITY FROM PERFORMING SERVICES FOR THE PRIVATE DEVELOPMENT OF THE JOHNSON GRA`FL PIT AS A RESIDENTIAL SUBDIVISION WHEREAS, it.has been the policy of the City Council of Fridley to discourage the use of Comstock & Davis, Inc., the consulting engineers for the City, from performing private engineering w rk for property owners and subdivision developers in the city, and WHEREAS the property known as the Johnson Gravel Pit has long been a source of difficulty to the City, and WHEREAS this tract of land presents unusual topographical problems, and WHEREAS the adjoining neighbors of said tract, over many years, have protested any further gravel sale operations, and WHEREAS the tract has now been sold to Mike O'Bannon who intends to level off the property and develop the tract as a housing subdivision, and WHEREAS the development of the tract for a housing subdivision presents special problems to provide facilities for public water, sewer, streets, and storm drainage to the tract that would be unduly duplicated if consulting engineers other than Comstock & Davis, Inc. were employed. NOW THEREFORE BE IT RESOLVED By the City Council of Fridley as follows: 1. That the practice of discouraging the use of Comstock & Davis, Inc. as consulting engineers for a private development in the City of Fridley be waived in. this instance. 2. That the consulting engineers, Comstock & Davis, Inc. be authorized to accept. an assignment to perform engineering, services for Mike 01 Bannon in the development of Johnson Gravel Pit tract if such assignment is offered.
