evening, aad altbough the nteeting was late in atarting, it would be
coatiaued for a full hour if it was neceasary.
Mayor Rirkham atated that, under the City C'�arter, aoticea had been mailed
to the propertq o�mera knawn to the City, and printed ia tbe aewspaper,
He said that an thia project, the City hae had either a petftioa from the
property owners or else ehe City Council hae detexmined that the proposed
praject shou3d be studied. The Engineers have given tbe Conacil a writCea
report that tbe project is feasible fram an engiaeeriag st:ndpoiat, aad
�ave outlined parcels of Iac�d that would benefit frem tt�e project. H�
stated that the City Coe�ncil will ultimately have �o make the decision,
but they are interested in the pecsple°a views, and if the Council doee
• deaide to p�coceed with t6e project, it will adopt a resolutioa to that
etfect, thea plaa�a and specifications are pregared, studied, and approved.

For the past several years, our client has been required
to obtain, and has obtained, a license to perform electrical
work in the c�.ty .
On March 11, 1966, the Minnesota Supreme Court, in the case
of Minnetonka Electric Com an vs Villa e of Golden Valle ,
determine t at municipa ities ave no power to icense
electricians in this state. Furthermore, our Supreme Court
had previously decided in the case of Moore vs. Village of
Gilbert, 289 N.W. 837, that if a party pays a�ee to a city
un�c.er such circumstances that the exaction of the fee was
unlawful, the �arty paying the fee has a right to recover such
payments from the municipality.
We, therefore, request repayment by the city of fees paid
by our client for electricians' licenses. The total amount
of these payments during the last six years has been $30.OQ.
In our opinion, the Supreme Court decisions referred to above
clearly require the city to repay this sum. We trust that
. you will promptly honor our request and that any legal

• The Board discuased the proposed structure with Mr. Wolke. Mr. Hoffa�an
then asked Mr. Wolke if the doable bungalow wouZd be ea+aer occupied.
Mre Wolke stated that he did nat knaw, but that Mr. Wentworth had ask�ed
that he petition for a Speaiai Use Permit, although he had not said whether
or not he would occupy the double bungalow. Mr. Wentworth then arrived at

under the conditions listed in this letter.
. The crossover, of course, would be for emergency vehicles only
and would be so signed and constructed to discourage use by any-
one else. It is further understood that at that time the existing

keeping the standards of home building in Fridley high. This

We, the residents of Holiday Hills Additions to the City of
Fridley, do strongly object to the location of the new City Hall on
the Park property at University Avenue and 69th Street and request
that the Council reconsider their decision to locare it there.
In selecting this location for our homes, one consideration
was that we would be next to park lands and away from the congestion
and noise of a City Hall, fire station, courtroom and police station.
We paid a premium price for our lots because of the location near or
on a creek and next to a park. Now you plan on removing the park. We
bought in good faith and on the assumption that the bond issues for
Locke Park and the CiCy Hall to be located at 64th and University would
be honored by the Citq officials. Now we find that our elected offi-
cials are not honoring the decisions and promises that were made to
the peopie when they asked them to vote the bond issues for these two
projects.
No one has given the reason for the change in location of the
City Ha11 complex and we feel that the Council acted hastily and
unwisely in the decision they made, and that it was in opposition to
a study made by a group of citizens organized at the request of the
former Council and which study was used to sell the City Hall bond
issue. •
We again ask you to reconsider and study this further, before
going ahead with the project.

of this portion of the street, but due to opposition of the assess-
able property owners, the improvement was not ordered.in.
Now there is a feeling that City should try to hold
another hearing as this section has been requested to be desig-
nated by the City Council as State Aid Street and I am confident
that the State Iiighway will designate it so, then State Aid
monies can help pay some of the cost.
Before this road can be paved, the City Council
has to make the decision in regard to the storm sewer in this
area. This includes the Riedel property storm sewer (Project
��80) and the Rice Creek Terrace area storm sewer (Project ��77.)
Also, if the storm sewer in Rice Creek area is not
ordered in, then City will do some minor corrective work on the
existing storm sewer to alleviate some of the problems.
I hope that a decision can be made soon so that,
if the City Council orders the improvement in, we can schedule
this improvement in this year's construction season. _

• As we discussed in our recent telephone conversation, the State
Highway Department is now re-submitting the above referenced agree-
ment concerning storm sewer construction on T.H. 4% for a new approval
by the City of Fridley. The Highway Department's legal division has
requested that since Mr.�Nee is no longer Mayor of Fridley, a new reso-
lution be passed by the present City Council authorizing the present
mayor and City Manager to execute the a�reement on its behalf.
The a$reement we are now submitting is exactly the same as the agree-
ment previously approved by the City Council; only Page 7, the si�nature
page, has been revised. Would you kindly present the agreemerit to the
Council for its execution. Please return all three copies, to�ether
with three copies of a new resolution authorizing the present city
officers to execute it on behalf of the Council. Please affix the city
seal to all copies of the resolution and Page 7 of the agreement.
If you will notify this office as soon as this agreement is completely
executed, we will be glad to have someone stop by and gick it up.
