RES 1966-138 - 0001117011 t 185 EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF A SPECIAL MEETING HELD AUGUST 22ND, 1966, kT 7 :30 O'CLOCK P.M., AT THE CITY HALL, CITY OF FRIDLEY, MINNESOTA Pursuant to due cann and notice thereof, a special meeting of tite City Council of the City of Fridley, Minnesota, was duly held at the City Hall in said City on Monday, the 22nd day of August, 1966, at 7:30 o'clock, P.M. The following members were present: Harris, Sheridan, Samuelson and the following were absent: Kirkham and Wright. The Clerk announced that the proposed assessment for SEWER AND WATER IMPROVEMENT PROJECT NO. 73-B had been filed in his office on the 1st day of August, 1966, and that notice of a hearing on said assessment to be held at the special meeting of the Council on the 22nd day of August, 1966, had been given in the form and manner as provided by law„ The Clerk presented an affidavit showing publication of such notice in the official newspaper, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor announced that the meeting was open for consideration of objections to the assessment heretofore filed with the City Clerk for SEWER AND WATER IMPROVEMENT PROJECT NO. 73 -B The Clerk reported that written objections had been filed by the following persons affecting the following described lot, pieces or parcels of land, to -wit: NAME OF OBJECTOR DESCRIPTION OBJECTION NONE The following persons were then heard and presented their objections to said assessment: NAME OF OBJECTOR DESCRIPTION OBJECTION NONE After due consideration of all said objections, Councilman Wright introduced the following resolution and moved its adoption: RESOLUTION NO. 138 - 1966 RESOLUTION CONFIRMING ASSESSMENT FOR SEWER AND WATER IMPROVEMENT PROJECT NO. 73 -B BE IT RESOLVED, by the City Council of the City of Fridley, Minnesota, as follows: 11 The City Clerk has with the assistance of the engineers heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the SEWER AND WATER IIMPROVEMENT PROJECT NO. 73 -B in said City against every assessible lot, piece or parcel of land in accordance with the provisions of law, and has prepared and filed frith the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same. 186 RESOLUTION NO. 138 - 1966 Continued 2. Notice has been duly published as required by law that this Council would meet it regular session at this time and place to pass on the proposed assessment. 3. Said proposed assessment has at all times since its filing been open to inspection and copying by all persons interested and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed; except; NONE , 4. The amounts specified in the proposed assessment are changes and altered as follows: NONE 5. This Council finds that each of the lots, pieces or parcels of land ennumerated in said proposed assessment as altered and modified was and is specially benefited by the SEWER AND WATER IMPROVEMENT PROJECT NO. 73 -B in the amount in said proposed assessment as altered and modified by the corrective roll in the amount set opposite the description of each such lot, piece or parcel of land, and that said amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein described. 6. Such proposed assessment as altered, modified and corrected is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment as altered, modified and corrected, with the changes and alterations herein above made, are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 7. Said assessment so affirmed, adopted and confirmed shall be certified to by the City Clerk and filed in his office and shall thereupon be and constitute the special assessment for SEWER AND WATER IMPROVEMENT PROJECT NO. 73-B 8. The amounts assessed against each lot, piece or parcel of land shall bear interest from the dates hereof until the same have been paid at the rate of six per cent (6 %) per annum. 9. Such assessment shall be payable in one or twenty annual installments payable on the lst day of January in each year, beginning in the year 1967, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor. 10. The City Clerk is hereby directed to make up and file in the office of the County Auditor of Anoks County a certified statement of the amount of all such unpaid assessments and the amount which will be due thereon on the 1st day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Sheridan, and unon vote being taken thereon the following voted in favor thereof: Kirkham, Wright, Sheridan, Harris - Samuelson, absent. and the following voted against the same: NONE PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 6TH DAY OF SEPTEMBER, 1966. / MAYOR - Jack 0.
