A RESOLUTION ORDERING CONDEMNATION OF THE NORTH 20 FEET OF LOT 7,
SUB- DIVISION OF LOT 10 AUDITOR'S SUB - DIVISION NO. 94.
BE IT RESOLVED, by the Council of the City of Fridley,
Anoka County, Minresota, as follows.
WHEREAS, it is necessary to acquire an easement for
utility purposes over the above described nronerty for the
construction of Sewer Water Project #79, and
WHEREAS, the contract for construction on the above
project is pending before the City Council, and
WHEREAS, the City Council has previously determined that
the project was feasible and necessary and has approved the plans
and specifications, and
WHEREAS, an attempt has been made to attain the easement
by negotiation with the property owners involved byt that said
attempt has been unsuccessful, and
WHEREAS, the easement that is required is-fully described
as follows: The North 20 feet of Lot 7, Sub- division of Lot 10
Auditor's Sub- division No. 911.
NOW, THEREFORE, BE IT RESOLVED, by the Fridley City Council
as follows:
1. It is necessary for purposes of construction of storm
sewer, sanitary sewer, and water utilities, for other utility
purposes and for street purposes that the above stated easement
be acquired
2. That said easement is to be used for street and utility
purposes.
3. That the attorneys for the City are authorized and
directed to acquire such easement by condemnation action
in Anoka County District Court.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY, THIS 7TH DAY
OF NOVEMBER, 1966.
