The details of the job to be worked out later. We would probably be tal, king about 5 months for one man in the rear of Z967, or a expenditure in the neighborhood of $3,OOO.QO. According to the specifications, the contraetor was supposed to compact the water and sewer trenches which he did not do. On October 3, 1966, it was finall.y agreed br Sexter Realty and the Citr Couzzcil that the developer would put in escrow of $1,000 to the City to cover the future repairs to the street. An agree- ment was tirritten by Vi.rgil Herrick, City Attorne.y, a copy of which is attach.ed herewith, for execution by the developer. To m,y knowledge, this agreement has not been executed by the developer and na money has been put in escrow with the City. . The total improvement cost of this street is 8,630.96, of which $2,200 is th.e right of way cost for the acquisition of the West Half of Polk StrEet South of Sexter Addition. The City Council would have to decide what action the City should take in light af these facts on the request of Sexter Realty for reduction of their assessments.
