THE MINUTES OF THE REGULAR COUNCIL ME�'1IntG OF JULY 5, 1967
The Regu.lar Council Meeting of the City of Fridley was called to order
by Mayor Kirkham at 8:G7 P.M.
OPENING CEREMONY:
Mayor Kirkham asked the audience to stand and join in saying the Pledge
of Allegiance to the Flag.
ROLL CALL:
MEMBERS PRESENT: Kirkham, Liebl, Harris, Samuelson, Sheridan
MEMBERS ABSENT: None
PRESENTATION TO JAI�:ES SHAY:
Mayor Kirkham announced that the Police Department has a function they
would like to perform at this time.
Officer Kennedy, President of the Fridley Police Pension Association,
presented James Shay with an award and read the placque which commended
Mr. Shay for his bravery.
Chief McCarthy, on behalf of the Fridley Police Department, presented
James Shay with a Series "E" Bond.
The members of the cour.cil individually congratulated ,7ames Shay and
Mayor Kirkham said that today, among our citizens, there is a growing
disregard for law and order and it is so refreshing and encouraging to
meet and know a person that is such as you are with so much courage and
bravery and anyone who can display such bravery is a credit to our
commun i ty .

The Acting City Manager read the Notice of Hearing. Jack Terpstra,
attorney for Mr. Gearhart, stated that one of the problems on the variance
in connection with this matter is to provide adequate parking space.
I am sure most of you are familiar with this already. Under your zoning
ordinance, there is a�ravision for obtaining ex.*ra space. Arrangements
have been made between the mortuary and St. Philip's Church. The church
has 200 parking spaces and they can use the mortuary parking area and visa
versa. The mortuary does not hold funeral services on Sunday mornings
and it will not interfere with the church services. He called on
Dr. Deane Richardson, president of St. Philip's Church, who said the
mortuary would make a pretty good neighbor. We have an agreement on
the parking. I understand the second problem is the setback. The landscaping
is far more important than parking and their building and landscaping is
at-tractive. Councilman Harris stated the Council has indicated to
Mr. Gearhart a desire to acquire additional land for parking. Mr. Herwal
answered the only problem we would have is that of cutting down on the
north side, then there would be no parking space for that lot. On the
�aest side, we would have to push back on the hole side and it is
questionable building there. It would ruin the piece to the north for �
future development as the cost of a lot would run to $20,000 and that is
a lot of money for parking.
Mr. Stanley Carlson, 6219 Baker Avenue, asked why you cannot put more than
18 parking spaces. He said I am not objecting to the request, but can't
understand why he cannot put more parking space. He wondered what would
happen if there were a loop-hole in the agreement with the church.
Mayor Kirkham reassured him there is a legal document for the agreement.
Mr. Carlson was told that there has been a written agreement established
by the church and mortuary and it is a matter of contract now. As to
the parking of 18 spaces, I think perhaps zoning requirements, such as
setbacks, etc. affect the amount of Zand remaining for parking. Mr. Carlson
wondered why there is always someone caming in for a variance when they
build.
� Councilman Harris stated that unless there is a petition before the Council
or a petition to the district court to withhold the ordinance and deny the
request, he felt a motion would be in order to approve the request for the
variances as shown with the stipulation of occupancy- that if, at any time
1 the contract between the church and mortuary is severed, the property owner
wi11 provide a parking space equival.ent to what is necessary as so shown in
the Code on his property.

a mortuary at 6210 Highway ;�65 with the provision that if the contract for
parking with St. Philip's Lutheran Church at any time is severed, that the

500 feet of the property as so shown by the Ordinance. Seconded by

PUBLIC HEARING - ON INiPROVEMENT STREET PROJECT I96%-1 (ADDENDUM ��5):

The Acting City Manager read the Notice of Hearing. Mayor Kirkham explained
that there are several ways in which this project can be put in. The
original request was to continue the street according to the map on the wall.
The Engineer points out that it might be advzsable to put in additional
storni sewer in connectian with this street. CounciZma,n Liebl stated he
went down that area and the people want access to 57th or 58th. He saw
two catch basins installed on 57th Avenue, one catch basin on 58th. I
think we do not have to tax the people down there when we can alleviate

the Engineer's standpoint,.there is not actually much water problem there.

Councilman Liebl continued that only a few people would be assessed the

Mr. Joe Zizak, 5791 - 232 Street N. E., said that his taxes are $l,$00.00
on one house, and his only income is from his two houses. Any additional
tax would be more of a burden. Councilman Harris asked if there would be
a problem making a right turn, and the City Engineer said there would be
no problem. Councilmar� Li�bl ask�d the Fire Chief, Robert Hughes, who
was present, if the Fire Department could go through the proposed street
and he said it would be no problem. ,
Frank Gabrelcik, 5740 University Avenue N. E., sai,d he has a Used Car
lot on 58th Avenue. He did not believe a storm sewer would be necessary,
but definitely wanted the street. .

' answer to the storm sewer on Btarlite Boulevard and Sylvan Lane. We are
supposed to be assessed for storm sewer and are getting no benefit from
the storm sewer. Why are we being assessed?

It was explained to Mr.Searle that storm sewer assessment is made on the
area basis wherever the water drains. If your water drains onto another
lot, both property owners are assessed. There will be no additional
storm sewer in that area.
Councilman Liebl told Mr. �earle that this is a very complicated project
, and it is called No. 5-C. It includes all the area starting from the _
railroad all the way up to Mississipi Street and down ta Hwy �i�100. What
they have done in the past, they have assessed the people first on the
main, interceptors and then the laterals. The main is in, a11 the inter-
, ceptors and we have put in the laterals. You live in about the middle ef
Starlite Boulevard. There is a low spot which will be solved when we put
in the permanent improvement of Starlite Boulevard. This is also a
' Minnesota State Aid Street. WnenQVer this is brought up, you people, in
my opinion, should get a credit because you are assessed for it now. It
could not be done in any one night to clarify this.

Mr. Comstock, Consulting Engineer, was asked to give a short resume of
the history of Project No. 5-C. He said the original design was made on
this project in the late 5G's, the final design in 1900. At this time
the storm sewer line was proposed to run up the walkway to Starlite. It
was deieted at the final cer.tract and at the public hearing in an effort
to redu�e the cost of the improvement. The main prupose was to eliminate
the valley gutter. The area is benefited and the water-does drain. Some
water may collect in low lots and �ahen the roads are constructed to Gity
standar.ds of prop.er grades, all the lands in this area will receive the
same benefits. Mr. Searle was assured he would not be assessed for

Mr. Comstock wished to add that there are some homes im this area,
particularly arour.d Ruth Street, Ashton and Longfellow which have wet
basement problem. One of the contractor's who started construction and
stopped the work because of high watPr table. The City Engineer and our
office have been considering having perforated gipes and putting in a
drain in part of the areas, attempting to negotiate a law figure with
the low bidder. The present figure we have received is not acceptable
with. ou-r office. We would like the matter delayed until the next Council

INTERPRETATYON OF LAND USE - COMMERCE PARK: ,
Mr. Sam Rosenbaum, representing the Federal Lumber Company (Retail Lumber)
stated that they are buying land in Commerce Park. The Company is presently
�.ocated wh2re the freeway is going through. They are interested in Lots 5
through 8, 25 and 26, and 1 and 2 of Commerce Park, and they will be
crecting a very fine building.
Mr. Gibbs said that regarding zoning in the area, we are talking about
C-1. I understand that it is retail lumber and the question I would like
to ask i�n regard to the applicability of the ordinance is, where do you
intend to put the warehouse? Mr. Sam Rosenbaum, General Manager and
Treasurer, answered that they plan to have offa.ces and s�xlas rooms a�ong
University Avenue. Directly behind the offices and sales rooms, not
facing University Avenue, they will have the principle warehouse facilities.
Directly in frant of the office salesroom, there will be a parking sgace for
about sixty vehicles. The front of the builcling will be as attractive as
they know how to make it. Lots 1 and 2 wzll be xequired as access for the
railroad spur. Most of our heavy commoditi�s, such as lumber, will arrive
by railroad. We hav e talked to the Northern Pacific Rai.lroad about putting
a spur across,�practically adjacent to the crossing en Osborne Road, across
Lots 1 and 2 which will be on the rear portion of either Lots 25 or 26.
(The sketch wi11 show it).
Mr. Gibbs sazd that they had discussed Zoning C-1 that aft�rnoon, and it
was our interpretatian of the zoning as it now stands that a warehouse or
lumber storage would not be permitted within the C-1 zoning. As far as
the retail operation itself is concerned, iz would be within C-1 Zonir,g,
but that the warehouse itself and the general storage area for the lumber
would not be within C-1 Zoning. It properly should be located across
Commerce Lane in the Industrial Zoning. .
Mr. Rosenbaum said ttzey intend to operate a major aper�tion and the
warehouse would, physically, have to be adjacent to their main selling
area, and not to be able to do so, would he impractical. We have looked
at the area thoroughly, and the access road is a considerable distance
back from University. ,
Councilman Harris reviewed the zoning of Commerce Park and asked
�r. Mike Hafner if the original plans were sti11 in effect, Mr. Hafner
replied that, originall.y, these were the plans and he would have gone
along wirh them, but now, these people come in with a new idea. If .
the Council still wished him to follo�a throug�, he c�ould do so.
Councilman Liebl said he believed with all the large shoppin� centers
coming in, he dc�ubted very much if you ��ould get a shopping center in
that area at this time. Councilman H?rris sai_d he appreciated the fact
that these people were t�ying to make good use of the land and be an
asset to Fridley, but if our attorney advises us that there are restrictions,

Councilman Liebl asked permission to read the letter from the parks and
Recreation Commission dated July 3, 1967e He referrPd to the Special
Parks and Recreation K,c�r<nission Minutes of May 15, 1967 wt-!ereby they
approved Preliminary Plan P-2 as the final plan �or Summit Square Park
and authorized execution of the plun. He,stated the people in �he area
have consulted him and asked that the plan go through as tloted. They
feel it is necessary for the ch3_ldren in the are�. to have this playground,
and they do not want to wait any longer, and want i.t done this year. As
long as the money has been budgeted for 1967, Councilman Liebl could see
no reason for waiting any longer to give the people what they want. A
citizen from that area, Mr. A1 Osfar, spoke in behalf of the peopl.e who
were in favor of getting the work done this year. Courn�ilman Harris
agreed the people have been very patient and the Council concurs with
the people. We have decided that Plan P-2 is the appropriate plan tor
uses as the land now exists. In the area that borders on the South of
Hughes Avenue, I think the Parks and Recreation has made a reasonable
statement when they said_that if you put in equipment on a temporary
basis, it would make it impossible to have safe equipment. We do not
want to pur in equipment that is not anch.oredo Mr. Osfar said the people
want a skating rink ag�.�.n.
Councilman Harris said we agreed in our discussion that Plan P-2 is a
reasonable plan for the deveZopment of Sun�nit Square Park, but based an
the discussion before and the recommendation of the Parks and Recreation,
we should not put in any temporary appuratus an tY:e sou�h half of the park
which borders Hughes Avenue. If the ball-playing is a problera there, we
will. have to find another so2.ution to keep t12e ba�l in the park by erect-

Mayor Kirkham stated the Gouncil. had asked Mr. Wilbur Whitmore, Fridley
Po1ic Civil Service Commission, to report back. Mr. Whitmore said last
year, you discussed a$1C,000 policy. Mr. Schillinger's letter,of
June , 1967, pointed out they couid have a straight $7,000 in additzon
to th $3,000. When this was discussed, some of the men said they would
start with $7,000 if they could get double indemnity. The intent of
insur nce is to cover hazardous conditions. The Gommission thought it
would be good to have double indemnity. We are trying to put the family
in a osition where they are not dependent upon the co�ru�unity in the case
of ac idental death. This is why.the more we can have, the better. By
havin double indemnity, we can get the most for the least premium.

DISCUSSION OF BUS ROUTyS:
Councilman Samuelson said there is a gentlemen in the audience who called
to ask if the bus route could be routed to 7th Street. A citizen said
that if there aren't enough passenge-rs, the Bus Company will take ttce bus
off. The County road can stand the bus traffic. If you extend the route
to Highway ��65 i t �oi 11 he lp .
Mayor Kirkham explained the City had asked the Bus Company to extend the
route to 01d Central but they could not because of the ruling of the
Railroad and Warehoase Commission_that you cannot cross another bus line.
They had established the line to come up to the Methodist Church parking
lot, but, of course, cahen they started their construction, the Bus Company
had to find a new place. Mayor Kirkham received unofficial information
that the church does not want the bus to go back into their property after
the church is built. None of. the streets in the area are built to carry
the weight of the bus except 7th Street. The Bus Campany would like to
go further on Mississippi if we could find a place for them to turn ar.ound.
Councilman Harris told the citi.zen that the Bus Cornpany cannot take the
service off �.•ithout petitioni.ng the Railroad and Warehouse Commission
because the line has been in existance long enough. .
No action was taken.
LEGAL ACCESS TO LOCKE PARK;
� Council:nan Samuelson said he aske�] this item be put on the agenda. Council-
man Samuelson stated the Legal �epar t�uent should cooperate with the Park
Board and the Engineering Department and find a l�gal access from Locke
� Park to Highway ��65. I believe it is time to pursue a permanent easement.

Councilman Harris said that NSP would be caming in f�r consideratior,. of
permission to build some high lines. We should determine where the road
should go. It should be worked in cooperatian wzth the Park Board and
the Engineering Degartment and wit� the Highway Department because of
crossovers.

ment and the Park Board work out a permanent easement for the eastern access

RESOLUTT,ON ��127-1967 REGARDING JOINT ACQUIS;CTIOr; OF PROPERTY FOR ICE
ARENA, PUBLIC WORKS AND OTHER CITY PROPERTIES: �
Councilman Harris said in reference to the resolution covering the joint
acquisition of land no�a owned by Minnesota Transfer Company, the site will
be used in part by the Anoka County Commissioners for an Ice Arena, and
ttie Easte-rly one-half to be used for public warks garage� The agreement
has been prepared by the County and the City. The Resolution is to go
along with the agreement indicating additional considerations to be
exercised upon acquiring the property; that would be that the service
road would be constructed by the Anoka County Commissioners which would
serve both the Park and the Arena, and the part that would serve the Park
would be gaid for by the Board of County Commissioners in their con-
struction. This contract is only valid if we take half of the property.
If th.ere is any change in the amount of land, a new contract will have to
be dratti�m. The ser.vice road which would have,to serve the maintenance
garage on the east edge of the property would have to start on 69th and
go through to 73rd. Councilman Liebl stated he hoped the City will get
at least eight acres. Councilman Harris said the Board of Commissioners
kno�a how much they need for the Arena, but there are a few minor changes
they.m:ight want to make which.would not require much land. We could give
them one or one and a half acres and not miss them, as perhaps part of
our acreage would be put into park. Councilman Harris also said the
Board of Coirunissioners w�re ready to act on this tomorr.ow morning or as
soon as they heard Council's action. Any delay on our part will make it
that much longer in getting negotiations started to acquire the land and get
construction started. ' �
MOTION by Councilman Harris that the Gouncil adopt the Resolution Re-
garding Joint Acquisition of Property for Ice Arena, Public Works Garage
and Other City Properties. Seconded by Council Samuelson. Upon a voice

to get hold of Councilman Samuelson. He feels a resolution as such is
not necessary, but that it could be done on motion with the provision
that one Councilman on this committee be in charge and submit an invoice
to the City Manager or Finance Director for his approval. Councilman
Samuelson said that this was the intent, The Counczl was in agreement
that the expEnditures should be handled as the City A.ttorney suggested.

The City Engineer explained this vacation has been considered by all of
the committees and rejected Uy Council in 1964, reactivated again in
1966 and tabled until the street problem in the area was solved. Now
that Third Street is going through, it was felt the facation should be
granted and a public hearing he1d.

Joe Zizak, of 572 Avenue between Third Street and 22 Street be granted
and that a Public Hearing be held. Seconded by Couacilman Harris. Upon

Councilman Harris said he was glad Mr. Qureshi put this item on th.e agenda.
We did meet with the State High�vay Department relative to the detachment
of the service road at Mississippi Street:; and also the section of the
road that eaould sex~vice 64th Avenue and 5th Strec�t. The report oi the
City Engineer was contained in a Memo No. CNI ��67-30 datecl ,Tune 27, 1967.
The problem of acquiring right of way either by n.egotiating or condemnatzon
in order to proceed with the �vork *his year was discussed.
MOTTON by Councilman Harris that the Council concur with the City Engineer,

condemn the land necessary for the detachment of the service road at

, �i3hen Mr. Qureshi was asked about speeding up the work around the new City
Hall, Mr. Qureshi said the State tias already done the design work and the
City would let the contract to build the road. The design is not the
probiem now, but entering into agreements for right of way. The State
, was going Lo put in a 36 foot road at no cost to the City but we want a
40 foot. We do not have the ri�ht of way along the Riedel property.
This type of work is time consuming.

The City Engineer explained that he and the City Attorizey had been unable
to get a final d.ecision from Sears-Roebuck and Company for the acquisition
of a right �f way on 73rd Avenue, although in the beginning of the.negoti-
ations, they seemed to be willing to grant the easement.
Councilman Harris explained that Minco purchased a piece of property on
73rd Avenue and th,ey want to start construction but need a road. They
requesLed the County to take over construction of 73rd Avenue from Univ ersity
Avenue to Commerce Lane. If the County.is not going to take it over, we
are going to have to put in a road, or we will have no company.
The City Engineer said that if the Council authorized either negotiation
or condemnation for the right of way on the south half of 73rd Avenue,
we can put the road in this year.
MOTZON by Councilman Harris that the Council receive Memo No. CM ��67-29,
dated June 27, 1967 from the City Engineer and request the Administration,
Engineering Department and City Attorney to enter into negotiation or
condemnation to acquire the right of way on the South HaZf of 73rd Avenue
from Univexsity Avenue to Commerce Lane. Seconded by Councilman Samuelson.
Upon a voice vote, there being no nays, Mayor Y.irkham declared the motion
carried.

I think we are doing the right thing and i feel comfortable with
the decision. Things could conceivably get a lot worse but I think
the scales are tipping more toward some improvement in the next
month or two.
With this additional time and in view of the location of Onan in
the City, I think we shauld ga to New York to try for a better
rating. I am planning to do this on Thursday, August la, and be-
lieve you or someane from the City should be authorized to go t�ere
too. We might not be able to raise the rating but, the enormous
saving from a better rating is well worth the cost and time.
If you have any information, especially letters
wouZd like to have copies for our nresentation.

A RESOLUTION REQUESTI!i�iG ANOKA COUNTY COMMISSIONERS
TO DESIGNATE 73RD AVENUE AS A COUNTY ROAD AND
IMPROVE IT.
WHEREAS, the City Council of the City of Fridley by
Resolution ��37-1966, dated March 21, 1966, requested the Anoka
County Commissioner to take over 73rd Avenue from East River Road
to Old Central as a county.road; and
WHEREAS, the City has had no official response from the
County on this request to date,
WHEREAS, Onan Properties are b�ilding over a$13,000,000
' industrial complex at 73rd and Central Avenue with appraximately
1,600 employees, and they will be using 73rd Avenue as the main access
to their complex,

WHEREAS, all this new construction is going to create a
considerable amount of additional traffic volume,
WHEREAS, the City Council has authorized the improvement
and installation of Storm Sewer on 73rd Avenue on 3uly 10, 1967 and
the City is in the process of negotiating cost of participation with
the County for their share, ,
NOW THEREFORE, be it resolved by the City Council of the
City of Fridley, Anoka County, Minnesota» as follows:
THAT Anoka County is requested to designate i�:iediately, at
least the section of 73rd Avenue from Trunk Highraay ��65 to Old Central
as a county road,
AND also improve and compLete the construction of 73rd Aveniie
from Trunk Highway �r`65 to Stinson Boulevard by the end of next summer.

.. I had a detailed telephone conversation with
� Mr. Norman R. Osterby, the Assistant District Engineer, District ��5,
Minnesota Highway Department, this morning in regard to the above
mentioned subject.

He pointed out that their office has given their
recommendations and report in regard to the need for above items
to the central office of the Highway Department last winter. A
committee of the Standards Section of the Highway Department is
studying the problem of footbridges to formulate a state-wide policy
in regard to the needs, standards, and the cost participation between
the parties involved.
Mr. Osterby indicated that they are expeeting these
policy decisions any day now and once they have these recommendations
they can inform us about the steps they can take. H�, felt that they
certainly look favorably on installing the fence along certain areas
to contral the pedestrian traffic. This would be installed in spots
where they felt it was needed in conjunction with the pedestrian
traffic signal, but if the pedestrian bridge is installed, they would
like to do extensive fencing on the highway to funnel the pedestrian
traffic to this bridge.
The reasons they are waiting tor the recommendations
of the committee is that they would like to get these befare they
proceed with any work on the fencing so that whatever work they do,
they let under one contract and be done with it.
In regard to sodding and landscaping of Trunk High-
Way ��47, south of Interstate �r694, I talked to Duane Brown, the
Project Engineer, today. He tnentioned that basically most of this
work has been completed. I am meeting with him tomo�row morning at
8:30 to go over the job and I should have an up-to-date report for
the Council at the next Council meeting. .

' Pursuant to the agreement between the City of Fridley and the
North Suburban Sanitary Sewer District entered into on the 8th day of
January 1964, the North Su3urban Sanitary Sewer Board has requested that
Fridley make a determination of the status of its hook-ups pursuant to
' Section 7 entitled connection charges.
The City of Fridley has connected to the District disposal
system but has not indicated to the Board, whether such connection is on
a temporary or a permanent basis. This would be an important determina�ion
in view of the fact that both parties have certain rights which became ef-
fective on Fridley's election, particularly under Provisions B, C and D of
Section 7 of the supplementary contract.
A resalution was received by the Baard relative to an assign-
ment of a poxtion of Fridley's capacity at the 43zd and Marshall connection
but there appears to have been no election mada as to whether the Fridley
connections are on a temporary or permanent basis. Your cooperation would
be greatly anpreciated.

A RESOLUTION RELATIVE TO CITY OF FRIDLEY-NORTH SUBURBAN
SANITARY SEWER DISTRICT SEWER USE AGREEMENT
WHEREAS, the City of Fridley and the North Suburban Sanitary Sewer
District entered into a general sewer use agreement, conditioned, modified
and limited by a supplementary agreement dated the 8th day of January 1964, and
WHEREAS, Section 7 of said supplementary agreement relative to con-
nection charges reads in part as follows, "Fridley shall have the right to
connect portions or all of its sewer system directly to the District disposal
system on a temporary or permanent basis, as Fridley may elect, and shall pay
current connection charges to the District;...", and
WHEREAS, the City has requested the District for a connection to
the District system to serve an area in the City designated as Gommerce Park,
�which is located south of Osborne Road, west of T.H. 4�47, north of 73rd Avenue
N.E. and east of the Great Northern and Northern Pacific Railroads, and
WHEREAS, the District has requested that the City make its election
as to what basis it intends to connect the above described property to the
District disposal system,
NOW, THEREFORE BE IT RESOLVED as follows:
1. That the City of Fridley has not exceeded its disposal cagacity
at 22nd and MarshalZ, or 43rd and Marshall,
2. That it has elected to connect ta the District system that area
described as Commerce Park, which is located south of Osborne Road, west of
T.H. �647, north of 73rd Avenue N.E. and east of the Great Northern and Northern
Pacific Railroads , on a basis . '

�Vice Chairman Erickson said on Page 19, Memo Number
CM ��67-25 from the City Engineer, Paragraph ��1, there is
a statement that water and sewer utilities are running
between Hugo and Ironton. They would be in the proposed
right of way.
In answer to the Vice Chairman's question of wishing to
know exactly what the rezoning r.equest is now, is it the same
as you originally proposed, the Engineering Assistant answered
"yes". He added, there was a motion for denial before the
Planning Commission and the Council. Mr. Qureshi asked that
it be advertised and put on the agenda.
Hugo Skrandies, 195 Hugo: I asked Mrs.Swanson why she
can't build homes there? �dhy apartments? What kind of apart-
ments can she build other than second-class when rhere is
industrial across the street. I am opposing the rezoning.
Mrs. Florence Swanson, 3254 Arthur St. N.E.: The City
Engineer called me to his offi,ce to discuss a cul de sac for
Hugo Street and also pZan what the remainder of my prop�rty
could be used for. We ran into problems such as how we can
have access to the back yards without having the homes face
the factory. Also, we can't get financing. I understand that
eventually in the future,.they would like to vacate a portion
of Ironton Street because of truck traffic. If it can't be
rezoned to R-3, I would like to have some indication what I
should build there.
Ralph Officer, 315 Hugo St. N.E.: We talked about
, Bernard Julkowski as being involved in the request. Property
boundaries indicate in the notice that Mr. Julkowski d�oes not
own any of the land we are considering tonight.

The Engineering Assistant said the hearing notice covers
just the Swanson parcel. The notice itself does not inelude
anything below Mrs. Swanson's property.
Mr. Officer distributed maps colored to shaw Mrs. Swanson's
property, Mr. Julkowski's property, the new Planned Development
project owned by Howard Dumphy, and the undeveloped area west of
Julkowski' property.
It was e?cplained that the Plat (Ironton Industrial Park) has not

been recorded and that is why rlr. Julkowski is not a fee owner, however,
i_t was approved about three years ago. Ashton Avenue wi11 not be a
dedicated street until the plat is recorded.
Normar_'iuomie, 304 Ironton St. N.E.: Ae wished t� voice a contrary
opinion in opposition to this type of rezoning. The area is basically
residential. My parents and myself have our homes here under the assump-
tion it would be a residential area. The rezoning from residential to
multiple dwellings would be spot zoning. I caould be opposed to it.

Robert Venne, 200 Hugo Street: •He wished to voice his opposition
to allowing the change in zoning to R-3A. I understand the utilities
are on Ashton Avenue. Is it impossible that Ashton Avenue could be
changed. The answer was that it depends upon how the sewer and water could
be utilized. He asked "Is there a plan to vacate Ironton Street so as
to not allow traffic to go through Ashton Avenue?" The answer was negative,
although there was a proposal by the City Planner to do so. He th�n asked
that if it were vacated, would it be from Mrs. Swanson's property to
Ashton? He was informed that Ironton could n�t be vacated unless there
were a street to the north. It is proposed to go all the way through to
University Avenue. He asked why Ashton was put where it is, and that if
the edge of Ashton had lined up with the edge of M-1, there would be a
natural barrier.
Mrs. Swanson commented that these people ar,e objecting to living close
to apartment buildings, but they are asking someone to build homes and
these homes will be across from a factory. The factory has no landscaping
and it is not attractive, certainly a good looking apartment would be much
nicer to look at.
Mr. Skrandies: I would suggest that this land be sold for individual
homes and believe the property is good for homes. She wants to sell the
whole property or build an apartment.
Mrs. Kenneth Sporie, 301 Ironton St.: I went to the meeting a year a,

Acting Chairman Erickson sai.d in that area we have an industrial area
created some time ago and we would like to get the traffie in and out of
there. Ashton is a designated municipal state aid street.
Mr. Venne showed on the blackboard another proposal for Ashton Avenue
but after discussing setback requirements, etc., it was �ot feasible.
Mr. Charles Seeger, 324 Ironton St.: Would you have to buy some of
the property if you cannot get it dedicated? Is it correct that if you are
going to run a street, the City would have to buy enough to make it 40 feet
wide? How is the value of the land you are going to purchase determined?
If you have to buy 40 feet of 200 feet,it is 20% of the property. Why not
buy it all for park purposes?
T'he Engineering Assistant said that we already �re occupying 30 feet.

Acting Chairman Exickson said the only thing the Planning Commission
can do as far as the road which has not been dedicated, is to ask the City

four new members. We would like to get this problem settled before the year
is out. Anyone in the community can ask for a rezoning. I hope you will be
patient with us as we have complete opposing views concerning the rezoning.

Acting Chairman Erickson asked for the report request at the last meet-
ing regarding the home owners and residents on Third Street.
Engineering Assistant Clark explained the information sheet showir_g the',
�wners, legal descripti�n of thezr property and date purchased, the vacant ',
land and apartment buildii�gs. The first change of zoning in that area was '
Ordinance No. 98 published on July 10, 1958 from C-1S to R-2, and Ordinance
No. 231 published April 4, I963 rezoning from R-2 to R-1, Mr. Charles Root
explained that the examiner of titles of Anoka designated the people who
were to be served notice of registration and the three gentlemen present,
Lyndale Builders who sold to Clemron, Inc. were the only ones who received
notices.
Mr. Chester Brozak, 5110 3rd Street N.E.: Opposed the rezoning as he
built his home here because he expected the neighborhood to remain resident
The petitioners were asked exactly what they were planning to build.
As far as the number of buildings, they did not know until they went through
the Building Standards-Design Control Subcommittee, but it probably would be
a 2z story building, total 24 units.
Mr. Root said the remaining lots across the street would remain residen
tial.
Mr. Bxozak said he did not believe people will buy homes for residentia
acrass f.rom apartment buildings.
MOTION by Ylinen, to close the public hearing, ZOA ��67-04, S& S Invest
ment Co., represented by William Shaw of Lots l-6, Carlson's Summit Ma.nor
Annex 2nd Addition to be rezoned from R-1 to R-3A. The motion was out of
order inasmizch as the hearing was closed at the Planning Conanission meeting
of June 8, 1967.
Acting Chairman commented that the property on the East side of Third
Street between 49th Avenue and 53rd Avenue is all multiple zoning. It seems
rather sensible to continue it and finish'up multiple. I understand the
problem of the people living across the street. The structure need not be
unattractive and the Building Standards-Design Control Com¢nittee will have

VACATION REQUEST: SAV ��67-03, ROBERT MINDER• Vacation of Charles Street
between Anna Street and Mississippi River.
Mr. Minder was present and an informal discussion took place. The pro =
lem of access to Chase Island was discussed. It would be necessary to get
parking lot area from the School. It was suggested a report in writing
regarding access from the Engineering Department concerning road access to
the Island and an agreement with them for parking to be requested.
The Vacation Request (SAV ��67-03) was continued until July 27, 1967
and the Parks and Recreation Commission should be contacted to give their
opinion by July 27th. The Planning Conunission suggested advertising.
DISCUSSION OF ZONING FOR VETERINARIAN CLINIC:
Dx. Leonard Fogelson was present to inquire the status of the zoning
for vetexinian clinic.
The Engineering Assistant reported that he talked with the City Attorn
who said he could draft an ordinance so that it could be discussed and have
it up for your approval prabably at the August meeting and then go to Counc
in September.
I7r. Fogelson said they plan to start building, if the zoning can be
resolved, in September. In the spring they will be ready to open their clin c.
This item will come up again at the August 10, 1967 meeting.
