RES 1967-51 - 00010677RESOLUTION NO. 51 -1967 A RESOLUTION REGARDING WATERSHED DISTRICT LEGISLATION BE IT RESOLVED, by the Council of the City of Fridley, Anoka County, Minnesota, as follows: WHEREAS, a portion of the City of Fridley lies within the Rice Creek Watershed; and WHEREAS, valuable residential and park property has been damaged in the past years because of flooding conditions; and WHEREAS, a uniform flow of water in Rice Creek is of great im- portance to the City of Fridley; and WHEREAS, the Rice Creek Watershed encompasses parts of four counties and an excess of 30 local governments; and WHEREAS, the most efficient means of assuring a coordinated development of the Watershed is through the Minnesota Watershed Act; and WHEREAS, the Minnesota Watershed Act needs certain amendments so that it might operate successfully in a suburban watershed. NOW THEREFORE, by it resolved, that the Fridley City Council urges the Minnesota Legislature to adopt the following amendments to Minnesota Statute Chapter 112, Minnesota Watershed Act; 1. Rewrite 112.34 to expand upon the "declaration of policy* and emphasize development of storage capacity for multiple use, including recreational uses. 2. Amend 112.46 to require the managers to review the overall plan with the county commissioners and the municipal councils before presenting the plan to the WRB. 3. Amend 112.501 to permit the assessment of benefited property in the ,same manner as authorized by MS Chapter 429. 4. Delete the $20,000.00 limitation in 112.61, subd. 2 and 3.
