NOTICE OF HEARING ON IMPROV�MENTS
WHEREAS, the City Council of the City of Fridley, Anoka County,
Minnesota, has deemed it necessary and expedient that the improvements
hereinafter described be made.
NOW, THEREFORE, NOTICE IS HEREBY GIVEN THAT on the 8th day of
April, 1968, at 8:00 o'clock P.M, the City Council will meet at the
City Ha11 in said City, and wi11 at said time and place hear all
parties interested in said improvements in whole or in part.

Chairman Hughes explained that it was important that the Subcommittee and
Commission have looked at the plan in tezms of what is desirable if conditions
remain as they are at the present time. If some division of land uses at a
later date could change the logic of this plan, there is nothing that is so bind-
ing about the plan that it could not be changed to fit changing conditions. It
should be made very clear to the property owners in that area that one of the
Couunission members at the last meeting said that any property owner, if he felt
he had a better plan, at any time was free to reopen this matter. He thought
it was important for the people to remember that.
Theodore Theilmann, 1540 Rice Creek Road: I still feel_that the plan I
submitted to you was far superior to the plan you propose in the area of my own
home. I can't see that anyone would be better off by the cul de sacs on the East
side and another one on the West side. Or why I should be subject to sewer and
water when they don`t benefit me. I have lived in this area for 19 years and
I don't feel that, because some outsider comes in and buys a piece of property,
we should have to have a plan. How you put in the road governs the development
of my property and anyone else, and I can't see why you want to split me up
that way.
Chairman Hughes thought it was important that the desire is to prepare a
street plan which will be used in the eventuality that the land would be developed.
It is very unlikely that your land will be used, but the possibility is that it �
may well be used in a much different manner. There is room for four lots. If
that possibility exists, the street plan should take that possibility into account.
If streets were built, the best bet, as we can see now, is to be built in this
manner.
Mr. Theilmann asked if this plan is approved as it stands, could he put a
building on this lot? Mr.. Erickson said the adoption of the plan merely indicates
that this is the way the City prefers to see it developed. Until the City
actually condemns, there is no reason you cannot put a house on it.
Mr. Z'heilmann said he did not wish to have his land cut up. He did not
need a cul de sac as he felt Benjamin Street could be used.

to nrejudice any ri�hts of individuals nor the Citv in the ultimate urban devel-
opment of the large tract under studv. The studv ia not intended to serve as _
a proposed plat in the normal process of platting property, but only a guide
for the Citv and affected individuals in their future planning. Specific layout
of lots is not provided but has been generally considered. No time schedule is:
recommended fox any portion of the plan and it is intended that individual sug-
�gestions for modifications be given due consideration at any time in the future.
Upon a voice vote, all voting aye, the motion carried unanimously.
7. INTERSECTION PATTERN: MISSISSIPPI STREET AND EAST RIVER ROAD:
Final recommendation set for March 14, 1968.

bunch of athletes at the Fridley High School, and these young men have
. participated in the State HigEi School �Jrestling Tournament;.and the Counci2
would like to recognize them. He presented Certificates of Rchievement to
� the two wrestling coaches, Mr. Don rleyers and Mr. Walt tdenholz, and to the �
following members of the wrestling team; Mr. Richard Aune, Mr, Steve
Carlson, Mr. William Massof, Mr. Kevin Knudson, Mr. Steve Lind, Mr. Roger
Lennox, Mr. Alan Palmer, Mr. Kenneth Cochran.
CONSIDERATION OF RICE/CREEK CENTRAL AVENUE PLAN:
Mayor Kirkham read the Public Notice. The City Engineer explained briefly
that early last year the people in this area wanted to develop some of the
" parcels. The Planning Conu�iission felt a study �of the overall area should
be done and hired Hodne and Associates to develop a road plan for the area
which was brought before all the people concerned last March. The City
Engineer said that many meetings have been held by the Plats and Subdivisions
Subcommittee and by the Planning Commission, and the final plan befare the
Council is the one they recommend.
Councilman Harris asked how many people attended the Council Meeting in
regard to this item. 9 people raised th�ir hands. Council.man Harris asked
how many of these people were in favor of the plan. 6 people rai.sed their
hands. He asl:ed how many people were opposed to the plan and 3 people
raised their hands. �
Mr. Reverend Henderson, representino the Peoples Church, 41st and Van Buren
Street Northeast, said that the wishes of the Trustees of the Church remain
the same as they have been and they would like to go on record opposing the
plan. He said they purchased the property because there was other ground
to go with it, and tfiey were not anxious to see their piece of ground
opened up for egress to the east and west. He said they have no plans
to offer the Council on what they intend to do with their property, but at
present would like to leave it as it is. He said that with a couple of
changes in t6e plan 90% of the plan could tie carried out, and still leave an
opening for tiie future use of Lot 1, Block 3, if they wo uld change their
position for any reason.
Mayor Kirkham asked if there was anyone else in the audience opposed to the
plan. Mr. Theodore Thei.lmann, 1540 Rice Cree�: Foad, said that his concern
was whether he wauld be t�xed for the tcvo eul-dc-sacs shown, if they caere
put in. The City Engineer sai.d that if the in�provement went in and his
property benefitted from it, he thoughC the Council would choose to assess
the property. The City Engineer said the plan �is an overall plan, and
would not necessarily develop this year or next year, but would give a
�eneral idea, so that if one of the parcels were to be developed, it would
f.it in with the rest, and Ehe area would not develop in a hodge podge way: �
He said that rir. Theil.mann's parcel is fairly large, and the value woiild
probably go up once tlie property around it was improved. Mr. Theilrnann � �
said he did not believe as niany lots could be developed as shown on the

Councilman �Iarris asked Mr. liieilmann if he would be opposed to the plan,
if the Counci.l decided that there was no benefit to his propexty from the
cul-de-sacs. Mr. Theilnzann said he would have no objection if there was
no additional cost. There was a discussion regarding the dotted lines
shoc�n on the map, and it was explained that if this.property was subdivicled,
the dotted Iines indicated where the two cul-de-sacs could }oin into a street.
Mayor Kirkham said that the Council wauld not put in streets unless they �•
were�pe�a�-i-csr�ed for. He said the idea would be to adopt a plan that coul�d
be followed as the groups of parcels develop, but nothing would be done �
until the people wanted it developed.
Councilman Liebl read the rfinutes of the Planning Commission regarding
this plan from their meeting of February 29th:, He said he thought the •
Planning Conunission has been very fair in this matter as they have con-
s idered both the small and big property owners.. Mr. Theilmann said again
that he would be in favor if no roads, or sewers were put in. 1►irs.
Theilmann was the third person who had raised�her hand�as being opposed. �
Mayor Rirkham asked if anyone wi.shed�to speak in favor of the plan. Mr.
�tichard Carlson, 3509 Maplec•�ood Drive, said that he and his father ocan
a parcel on the east side adjacent to Mr. Theilmann, and that a year ago
they came in for a land alteration permit. He said they feel this will
benefit the entire area in the future, and they would like knowing the
generalities rather than come in with a plan�of their own that may not
fit in. He said he thought the Pl.anning Conunission had done a good job.
No one else in favor wished to speak._ Mayor Kirkham asked �ir. Hughes,
Chairi�an of the Planning Commission, if he had any cor�unant to make.
Mr. Hughes said that the Planning Commission viec;s have been given �
previously, and there was nothing new he could add.
Councilman Liebl asked Reverend Henderson bo�o many people the City would
be dealing coith, if a future Council has to give approval of the street
pattern. Reverend Henderson said it woul.d be just the trustees, three
men and himself. Reverenu FIenderson came to the Council table and
pointed out an alternate plan bringing 2 roads down together. Mrs. Skog
came to the Council table and objected to his idea as it would affect
her property and she would be required to pay for far more improvements
and streets. �

before ttiey make a decision, as the Pla�ining Commi.ssi.on has spent a lot of
time studying this, but the Council is seeing it for the first time. Council-
nian I,iebl said that his ideas tied in with the Planning Commission, who he
felt had done a very good job.
There was a di.scussion about ano[her possible way of brireging the streets in,
but rlrs. Slcog said that if this �aas done, they wculd not have enough land
on one end and she oioul.d have 4 lots tliat she could not sell.
Councilman Shcridan suggested that the communications from Feverend �Ienderson
to the Planni.ng Commission may be a help to the Council in ntaking their ���
decision. .

MOTION by Councilman Samuelson to receive the proposed plan.as outlined by
Hodne and Associates and as reconunended by the Planning Conunission and any
other conununications received relating to this project. Seconded by Council
man Sheridan. Upon a voice vote, there.being no nays, Mayor Kirkf�am declared

Councilman Harris asked if anyone was planning any immediate development in
this area. Mr. Carlson said they would not begin until they haye a proper
�YOad plan to fol7.ow, but it may be delaying them, if it is not decided
before the summer is over. Councilman Sheridan said he had received a call
from l�r. 0'Bannon who was out of to�an and could not attend the meeting, and
he had said he was in f avor of the plan as presented, and wants a street
plan accepted so he can start�moving. ,� . .
MOTION by Councilman Harris that this Rice Creek/Central Avenue Plan be
brought back to the Council at the second nieeting in April, which will
be April 8, 1968. Seconded by Councilman Liebl. Upon a voice vote, there
being no nays, Mayor Kirkham declared the motion carried unanimously.

conditioned, modified and limited by a supplementary agreemen.t dated

under way on: The Easterly part of the Southeast Quaxter of the
Southwest Quarter (S 4 of 54�� of Section. Eleven (11) Township
Thirty (30�, Range Twenty-Four (24�; and is in immediate need of
sewer services;
NOW, THEREFORE BE IT RESOLVID by the City of Fridley
as follows: That it elects to connect the sa.nitaxy sewer services
to the District for the City Garage area on a permanent basis.
