Responding to the suggestion of remwing �5 from R-3, Mr. Engstrom safd he tauld not say positively what their reaction would be to this suggestinn as it is a jofnt venture with Borson Constzuction, Inc. and they came in with a 6.5 densify, which is relatively low. Their plans called for eight units to the acre which was one of the reasons why they did not put townhovses there originally. They were talking substantially price range and did feel the freeway tra£fic could be a factor in selling individual homes. Chairman Erickson said if they would want to zeplace that density in an Sasterlq area of #3, he did not think he could say at this time whether or not he woald vote for it. A member of the sudience said that if Hathaway were_cut off, then there would be even more tra£fic on Regis Lane. Chairman Erickson replied that he didn't knw how you can cut Regis Lane off in that area no matter what is built up there. Another ciEizen wondered if a aervice soad could be established going sgsc 8aj8�enc to the freeway over to Silver Lake-Road,-But he was 3nfonned it vould be tremendously difficult hecause of the terrain. Ttie question was asked what role the Planning Cosomission would play 1n the closing--of the Matterhorn bridge.. Chai�an Erickson answered tha[ he did not lrnaw whether or not consideration would be given to closing that bridge especially as it relates to Fire and Police protection. Mr. Myhra refened to the paper presented bq Chairman Erickson by saying he did a good job, particularly on Items 1 and 2 on the first page. However, he dtd not think they had a complete enswer to �1. He guessed the stickler is #2 -- will the development have an adverse effecr on the adjacent residential property. Ae had made aome inquiry and undexstood it does not have any adverae e£fect. He said you make a judgment on belief, but then you do not have the answer until it is a^-ie. Once agai.n, it seemed the owners should not be werlooked. The Chairman .nade a good point that the City has been using the land as a park, that is the residents. We can hardly expect someone to sit with valuable property, pay taxes and espect they ought to furnish this kind of facility for the residents. Mr. Hittelstadt said that he'd like to make a few points which he did not helieve have been thought about. It is by a study of the University of Minnesota that multip?: dwellings of one or two bedrooms do pay for their way in a tax structuxe. On th: average, tne taxes to the school accrued fram muItiple dwellings of this type would be about $165.00 per child annually. Their ¢osC to the school is about $54.00, so you can-see it does pay for itself.- No�i thfs area is in School District #13. In the City of Fridley, School District �13 is about 23% or 26% of the total area of Fridley. Therefoze, the administrative cost, which would came from the entire City of Fridley in terms of services of fire and police protection, would have a major impact on the other two school districts -�14 and �16. In other words, I am saying that 76% of Fridley would have a municipal burden� an increase in a municipal tax base because.of the high population density in this area., The major portion of the echool district is in Columbia Heights,-the services are being rendered by the City of Fridley� therefore, in t�erms`o°f anjr schoal tax gain, the major - portion of Fridley would not benefit. n i� ' . Mr. Mittelstadt replied that he was aaying that the ta�ces collected from here go mainly to District �13 schools end yet the municipal boundaries would include all of Fridley and all would pay the tax to municipal services. Mr: Myhra said that, 3f it is-ae2f-supporC- ing� it wouldn't matter, would it? Mr. Mittelstadt replied that-the services would increase-and he didn't feel it would support itself. - Chaitman-Erickson said that it seema then that what we �ust ask ourselves ia what municipal servicea are going tn be increased because of the develop- ment of the area. Their main asgument, I feei, is the tra€fic prnblem and that argument-has the �- biggest impaCt with me. And, Mr. Mittelstadt continued, there ie accother item to consider -- the future of an em•ironment like Yemtom's. For the first ten oz fifteen yeara, I am sure the project will remain in reasonable condition, but as pears go by, it could very well become a ghetto area with problems for Fridley that would be nnbelieveable. Mr. Myhra said that one of the objections o£ the residents is for monetary reaaons. He thought that if sameone wished to sell his house, it might he easier to se1T if he had an "Innsbruck Sth" next to his praperty, but then this brings us right back to Item 7. What about the owner2 What rights does he have? Does it mean because these people would like their residences to increase in value, he should be denied some tppe of rezaning? Chairman Erickson said he had no sympathy for the awner of the property ittasmuch as he bought the land under R-1, but because of the fact the property !a difficult and e�cpensive to develop, he pereonally felt the plan was a beneficial one and one which would allow the land to remain as it is. Mx. Myhra said he took exception, sayi:ng he realized people have said "I purchased with the idea in mind it was R-I and did not expect it to change", but once again they must recognize conditions do change. If conditions have ohanged, he did not think they should set their thoughts back. Then what bear- ing does past history have on it? At this point, we stop considering all changes. It still gets down to conflict of interests of the three parties imolved: the owner� people whc '.?°� in the surrounding area_and the Planning Co�ission. Of all the camnents he heard at the public hearings, Mr. Mittelstadt said the only one he felt that really held weight, was traffic pattern. There followed a short diseussion on traffic pattern. Mr. Fitzpatrick said he could not add`anythfng to �.+hat had been said. He did not under estimate the amount of objections and the unanimity of the group of property owners directly to the West and he agreed with the'things-that are being said and, perhaps, the most Iegitimate Ys traffic. As plans go, he.thought this one was a good one, although Don (Mittelstadt) has 6rought ssg a question whether we are ready for any plans in this area. He believed rezoning Planned Development does give the Planning Co�ission continued con- troi o£ the'deveYopment of the area. All these things have been said and it is a matter of balance, weighing one with another. Mr. Myh=a said that this brings us back to the points af Chairman Erickson's comments. 1. Thinking of access to Matterhorn IJrive from Eiathaway and the closing of a street, whaf is the policy in the closing of the streets? Dsrrel Clark anawered that there was no right of �*ay and there is no atreet there. The street would have a 12x grade which would not be too goo3 fox aa3 access to a high density area. This is a State Aid route to connect AfaCter�aoas+ Drive to :-- Central Avenue. 2. Matterhorn has been under consideration for five or six years. Azthur Street has been dedicated down to the North line and with no real plsn where it would go from ttiere. 3. In getting acceptance from New Brighton for two streets connecting to Silver Lake Road with the neiAhboring minicipality would have to he=iavestlgated�_-- The Engineering Assistant sai..: that the City has aet no precedence with New Brighton. They have connected up to Gardena and made it a through street to Silver Lake Road, aud also have connected ap with Miasiseippi Street: Appesently their interest iu agremkent are =unning with ocire. 4. Can we change setbacks as part of a plan2 Chairman Exickeon said we can make stipulations, if necessary. Referring back to Iteffi #3; he said he had talked to the manager of New Brighton and they aze waitfng until we take action. 14�e suggestion was made by the City Managez th�.t a joint co�nittee may have to come out of it. He can anticipate probably s.�.i� problems �,+ith the joint uti,lity situation. Mr. Myhra said he made another note. E;" ver they have started talking ahout la=ge developments� they get involved =.':: utilitiea. Darrel Clark said Ehere is access to a large transmission wat�::'<.•in running up Matterhorn Drive. From the standpoint of sewer, we could not he:�.�;1e this whole area at this density. There has been some correspondence with New Brighton and it could be solved either by retention or perhaps all of the sewage go to New Brighton. Mr. Mittelstadt asked if the City had made studiea in the area for the develoQ- ment of stxeets and utilities and the Engint�ering Assistant replied these studiea are not made until the o-zier request�. them. Answering a question, he said the overall density of Fridley is 6.5. The Consulting Engineer o£ Pemtom's auggested three solutions: retention tank and discharge during off peak houra; put part 3n Fridley and part in New Brighton; or all go to New Brighton." Regarding the density, Section 3 on the map, they have to study quite carefully because of the freeway and the topography of the area. Eridley, Minnesota 55421 Gentlemen• Enclosec2 is our application for rezoning of that part of SE 1/4 of Sec. 24, T 130, R 24, lying north of Interstate 694. It is our understanding that the Planning Commission will meet on January 23, and we hope that a public nearing on this matter could be scheduled for that date. Our application is for "PD" zoning. Although we have not built in Fridley before, we have accomplished several sizable planned developments in other Twin Cities commun- ities having PD provisions in their zoning ordinances. �. We are very much in favor of the PD approach to urban growth, and we are pleased that Fridley has included a PD section in its ordinance. We think, however, that certain aspects of the Fridley PD section would pose enormous and perhaps insurmountable difficulties for us in the development of the particular tract with which we are concerned. These difficulties stem from two facts: 1. The size of the tract. The property contains approximately 120 acres in Eridley, plus an additional 30-35 acres in New Brighton. The development of such a large area would no doubt require several years. We do not think we can adeq- uately project the public's needs and tastes in housing for such an extended period, and, therefore, do not feel we can provide a detailed development plan for the entire area at this time. Until architectural designs for future buildings have. been drawn, we would not be able to designate "location, general exterior dimensions and approximate gross floor areas of all proposed buildings". Nor would we be able to designate: � Fridley Planning Commission C/o Mr. Darrel Clark, Assistant Engineer December 31, 1968 Page Two the location, arrangement and nwnber of parking stalls; location and dimensions of pedestrian entrances, exits and walks; standards for exterior finish, etc., all of which are required under the present ordinance before any construction may begin. We think it would be pre- mature at this time to attempt to provide such a det- ailed design for the total area. In addition, this unique site involves a fantastic amount of planning and architectural ti.me and expense which would be inpracticable to incur without some assurance from the City of Fridley. 2. The option on the property. We do not own the property but together with Bor- Son Construction Company, have an option for purchase, and we have arranged mortgage financing with which to exercise the option. The mortgage companies, of course, will not place the financing for our purchase of the land without some assurance that the City would not oppose the kind of development we intend to undertake. Satisfaction to the mortgage companies on this issue would have to be accomplished prior to the expiration date of the option. Under the present PD zoning pro- visions in Fridley, there is no assurance as to what type of land use will ultimately be approved on land zoned PD. Such assurance apparently is not obtained until a detailed development plan for the entire area is approved. As explained above, the size of the tract makes a detailed development plan impractical at this time. Perhaps a Planning Commission and Council resolution or statement of intent regardinq future land use could be obtained in our case. These are the principal problems we are faced with in our proposed development in Fridley. We wish to cooperate with the City in every way; however, because of the difficulties described above, we do not see how we can meet the present ordinance requirements for the development we propose. One approach to PD zoning which has been used successfully in other communities, and which would solve our problems, is as follows: 1. For large tracts the developer submits a general plan for the entire area. This plan shows only such items as principal streets, types of land use, and residential densities. Thus it shows the internal traffic pattern, the relationship to exterior exist- inq streets, and the relationships of the various land uses. It shows how the proposed development would relate to existing development and the City's Comprehensive Plan, but no construction details are specified. 2. If the City disapproves the proposed land use or other features of the general plan, it rejeets the plan (or it may grant approval contingent upon certain mod- ifications.) 3. If the City approves the general plan, the developer must then provide a detailed plan for the particular portion he wishes to develop at that time. This det- ailed plan must be for the specific land use already approved in the general plan. The detailed plan must show building locations and dimensions, parking lot designs, pedestrian walkways, and any other const- ruction details the City may require. 4. If the City disapproves bhe detailed plan, the dev- eloper must amend the plan to the s�at sfaction of the City or design a new and satisfactory plan for the same land use. 5. Construction of subsequent stages is handled in the same manner, that is, by submission and approval of detailed plans for those areas. That, briefly, is one way in which PD zoning can be applied in a'workable manner to very Iarge tracts. There may be others, but the above is one with which we have had personal exper- ience. It seems to have worked out well for the municipal- ities, ourselves and the residents. We have had excellent relations with the municipalities in which we have worked, and we look forward to an opportunity to prove worthy of your confidence and support. "' Y � ` �TOM REZONING ZOA 9�69-01 Chairman Erickson`s Summary 2J27/69 I believe that-no rezoning proposal in F'ridley has stirred up more concern on the part of' the citizens or has been given more thought and considerationa on the part of this Pla.nning Commission. We have been asked to consider a developr�ent never bei'ore seen in our com.��unity and a type of living with which none of us, I 2'eel sure have had any practical experience. The opponents have a number of £eers and many of their ptlints are well-taken� although I believe the principal concerns to be those oi' increased tra.fic and deterior�,tior. of reaidential values arisin� from the proposal. The petitioner has presented a new and exciting concept for developnent which could make use of the natural terrain of the land without destroying the beauty which now exists. The street mileage would be less than y¢ of that � encountered in normal single �'amily development. In order t�e to meke a determination of this issue, n number of questions u�ust be s.nswered. Among these are� 1. Is the question of traf'fic insurmountable? 2. Would the development have an adverse effect on the adjacent residential property? 3. Is the proposal undesireble to the community in general? 4. Would the proposal be an unjust burden on the school district? It is u�y opinion that the answer to all the c�uestions ia "NO", proving care is taken to make any rezoning to Planned Development or anything else, subject to a number of spacific conditions. I feel that our Planned Development ordinance �ive the City adequ�te control to insure that a plan� once approved� will not be substantially altered. The conditions written into the rezoning action to Planned Developnent become part of the zcning and must be accepted by the owners. They cannot be cha,nged without the a�proval of the Council after public hearings. Since public hearin� are also held on the plan itself� the public may become involved in thig step also. The point was brought up that PD does not allow single £amily residences. This not entirely true, aince they may be allowed by special use permit. The claim of undue burden to the school district has not been demonstrated to me. Ra.ther it appears logical that the city and schools aould benefit f'inanci=lly from such a development. The tra£fic patterns laid out by the petitioners� if accomplished, seem to be logi.cal and sho.ld take care of traffic as we11 or perhaps better than any single fnmily development. The outlets to Silver Lake Road� which are planned, are by no means a3sixred in any other type of develcpment. I am not cor.vinced that any of'the adjacer.t residential property will devalue as lon� as adequate iiufferin� is nrovided along tiatterhorn Drive� in particular� and trai'fic is discouraged f'rom using the residential streets to the west ns it does now. -1- �� ,F _,� �,_ �m � �;. � PEMTOM REZONING ZOA �69-01 Chairman Erickson's Summary 2/27/69 The land in question is undoubtedly some of the most �iff'icult around Minneapolis to develop because of the extreme terrain. In order to retain as much of the natural anenities th�t now exist, it seens logical to develop it with cluster housing such as townhouses, minimal lots and open space. This type of' development, which is impossiiale under our suhdivision ordinances, is only possible in Fridley under Planned-Development.� Certainly the owners o1' the lend have a right to develop the land. The co�munity does not have the right to continue to use it a a park at no cost to itself� while freely taxin� the owners. The only question then, it seems to ne, i3 whether or not the pet$tioner is requesting a reasonable use. I em prepared to vote "Yes" on a motion to recor�mend rezoning to Planned Development provided several conditions and limitations are includeu. 1. Acce3s to pSatterhorn Drive from Fiathaway be eliminated but utility easements be retained. 2. Matterhorn Drive and Arthur Street nust be extended and improved to Gardena. j. The two atreets shown on the proposal connecting with Silver Lake Road must be dedicated and accepted by P7ew Brighton together with az� 3greement to improve such streets within a reasonable time. 4. Construction on the East eide of Matterhorn nust be set back at least 60 feet from the street right of ony. 5. Interior street right of ways aust be at least 66 feet. 6. The density of the town house acreages shall not exceed 4.2. N6 increase ahall be allowed in other proposed densities. 7. IIse of the area Sor R-3 shall be limited to Areas �(x 8. Approval of New Bri�hton for zoning of any areas overlapping municipal boun�ries. ). Approvai of the zoning does not nece3sarily mean approval of the proposed plan� except that the townhouse concept is approved. 10.
