The Council. if the alley ware to be closed, would have to gsant waivers of the Ordinanca to alloa the front yard parki:rq. Mrs. Lucille B. Calguire, 6008 2nd Streat N.E., said that she had just bought this property and ie not aware of the backqround, but has already eean the probYem of the blowinq sarxi and jurilc, and would like to see the alley closed off. She said that as it is, it is very hard to maintain. She felt that gart of her land was beinq used as the alley. Mr. James Rudnitski, 6035 Main Street N.E., said that since tha storm sewer was put in on 61st Avenue, they have not had the water drainaqe problems. He said that in 1964 they qot flooded out, but no trouble since then. The City Engineer commented that there is, however, a low area that dces not have an outlet. A visitor to the Meeting froan the area felt, that by improving the alley, it would create greater drainage problems, since thera would be more blacktop. He asked if the alley were to be put in, would this eluainate the parking problems. The City Manaqer explained that the people living there have fencad off the alley and aze using unimproved parking lots in the front. He said that an in depth atudy was made to see about the front yard parkinq. He asked the City Engineer to show the diagonal parkinq plan on the screen and explained that this would put the cars within 11' of the curb and would not provide ample room to back up. The Council would then have to qive permiasion to back the cars out onto Main Street. . A visitor to the Meeting asked why adequate parkinq was not provided in the first place. Mayor Kizkham said he did not know, that this was before any of them vere on the Council. The visitor then aske8 if this would not meaa drivinq +►cross eomeone elsee property. Mayor 1Cirkham said no, that thia is a public dedicated tlley, but that the people juat built apon it illeqally. Councilman Hasris said that the Council canaot conjecture on �+hat the fee holders want to do, that the City needs the signatures, and suqgested sendinq a certified letter to each of the fee holders to try to qain their concurrence. Mra. Calguire saisi that she had not signed the petition and came forvazd and did so. When askad if ehe was the fee holder she said that she was not, and it was pointed out that.tbe fee holder's siqnature was needed as a co-signer. Nlayor Kirkham said thank you for this honor. RATIFICATION OF RESOLUTION #77-1969 - FLOW AND SAFETY: MOTION by Councilman Harris to ratify Resolution #77-1969, passed May 5. 1969. Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried. REQUEST FOR A VARIANCE OF SECTION 45.23 FOR ELIMINATION OF SIDEYARD REQUIRE- MENT TO PERMIT CONSTRUCTION OF A DOUBLE GA�RAGE UP TO THE LOT LI1QE B8CAU6E TERRACE. THE SAME BEING 7664 ARTHUR STREET N.E.. FRIDLEY, MINNESOTA. The City Manager explained that the Board of Appeals had granted a vaziance to Mz. Becker July 2, 1968, but he had not applied for a buildinq permit. Since that time, he has a new neighbor. At the last Council Meetinq he was told he would have to go back to the Board of Appeals, but he now has a letter of concurrence by his new neighbor, and questions the reason for qoinq through another Public Hearing when he does have the aqreement of the neiqhbor. It was pointed out that had he applied for a building permit, he vrould not have any trouble now, as a buildinq pexmit is good for one year. Councilman Liebl asked if there ware any objections. The City Manaqer said no. MOTION by Councilman Harris to approve the variance requeeted by Hernard Heckez. Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried. Councilaen Liebl said that he was qlad to see the chanqe 1n maximum on major ' nedica2 from $10,000 to $25,000 per year, and also th� lovered deductible on the major medical from $100 to $50. ' REGULAR CWNC2L MEETING OF MAY 19, 1969 PAGE 6 ' , The Financa Director said that it was the faeling of the committee that a 58 hiqhmr pr�ium is a good buy. He said that the experience has not been qood during the past year, and the checks were more than the pr�niums paid by the City. Their feelinq was that they would experience a qreater than Ss in- crease if there was a change in plans. Councilman Liebl said that he falt that the City should always go out for open bids and that a better coverage might have been received, both as pertains to premi�s and coverage. The Finance Dtrector pointed out that the Insnrance Coneultant was present at the last 2 or 3 meetings. Also that the committee represents employees of every department, and their votes reflect what the employees want. Caincil- man Liebl asked Mr. John SraSk, Inaurance Consultant, if he felt that Mutual of Omaha would come in with the lowest bid. Mr. Brask said that Mutual�of Omaha would stand behind the benefits quoted. THE VOTE UPON THE MOTION, being a voice vote, all voting aye, Mayor Kiikham declated the motion carried. RECONSIDERATION OF A REQUEST FOR ASATF:MEivT or' Srrx:itu, eaa5�a5r.civia EXCEPT THE EAST 200' AND EXCEPT THE NORTH 30' FOR ROAD, AUDITOR'S {{89: {On the Aqenda at the xequest of Kutzik and Leavitt) Mr. Walter Thuftedal, 3212 32 Avenue N.E. was present on behalf of Mr. Kut2ik. He aaid that they were not asking for a canplete abateenent. He pointed out on a cul-de-sac there are only a faw people asaessed. He asked if there vould be more aseessmente next pear for a storm sewer. The City Engineer aaid that there is a ditch, and a culVert was installed. Mr. TAuftedal asked if this r+as the assesmnent that would be going on next year. The City Engineez said no� that would be the street asses�ent. Mr. Thuftedal said that there woUld be about $16,000 in asses�ent which wuld figure out to be about $750 per unit for 24 units. He eaid that land can be bouqht-fer$1000 per unit with asaesmnents in and paid. He said that tne=e ras an agreement worked out with New Hope for a reduction. On a cul-de-sac the asses!ments are higher than usual, and on this basis Re would like the Council to reconsider their actlon. Counoil�mn Liebl explained that in the City of fiidley, if thls abatement were granted, the cost vrould have to be borne by the Fridley residenta. The Assistant City Attorney explained that at one time Mr. Balthazor came in and applied for a special uee permit to allow for a two family dwelling. Since that time, the Suilding Inspection Depart�ent discovered three electrical aervices qoinq into the house and reported it. It was checked out and found that there were three families residinq there, and a sun¢nons was issued. He said that it was his position that the Conncil could not leqally grant anything under R-1 zoning under the present Ordinance. Mr. Balthazor said that this is a double lot, so there is plenty of room. He caid that there were two families in the other section, no children. Council- man Liebl asked how this was first brought to his attention. HUBERS AND JUI.IAN JOHNSON: (Generally located south of 61st Avenue between Stinson Boulevard and Benjamin Street) The City Engineer said that the Public Hearing has been held and the plat basically meets the City standards, however, there is one point of conflict. There has been some disagreement between the owner of Lot 3 and the developers on how the street grade should be set. He said that he had requested that both the developers and the owner of Lot 3 be present at the Meeting tonight. Mrs. Zander said that she and her husband were the owners of Lot 3, and she hag been confused about the street grades. It appeared to her that her house would be sitting up too high in relatioa to the rest of the land. The City Engineer explained that by moving the street, it would be farther from her house, so the slope could be more gradual. The cul-de-sac;as originally planned wuld have taken more of her land; the present plan will take less. He aaid that he felt that the developers should be asked to grade back and fix hez' front yard, while workinq in the area. He said it may need a retaining wall. He suggested that'if they were to put irt a garage, that it ba a tuck-under type. Mrs. Zander said that she just could not visualize thie slope, and how great it would be. The City Enginear aaid that the house would be about 70' back fraan the road, so the slope would be gradual. Mayor Kirkham added for the benefit of Mrs. Zax�drs that it vrould be ccxi�parable to the base of one side of tha Council Chambers to the ceiling on the other side, looking east and west. Kessler, General Director of the Younq Men's Christian Aesxiation of Metropolitan Minneapolis read a letter to the City Council dated May 16, 1969 which atated that the YMCA has selected the Siest Moore Lake site for a full faciiity YMCA. This site contains 6.97 acres owned by the City of Fridley, .98 of an acre owned by School District #14, and approximately another 2�3 acre could be obtained if 60th Avenue were to be vacated. Dr. H. Strait added that an ad hoc committee has been meeting for many monihs and has been broken dovm into a program committee and a site comnittee. This wou3d be a full facility to serve all the northern suburbs, and would be a femily centered "Y". The propoaed facility would cost about one and one half million dollars, and this wuld not include any cost of land acquisition. The preaent predictione are for about 900,000 cubic feet of useable building space. This facility includea rooms that could be used by other organizations. Dr. Rufus Putnam, Chairman of the General Board of the YMCA added that the , aite was eelected last week, if the land could be made available. Council- man Sheridan asked if this proposal has been made to School District k14. Dr. Strait said not as yet. He said they wanted to talk to the City Council firat. Mrs. Pett said that theze are already so many peopie trying to get onto East River Road now, and with all these added paople the problem will be greatly compounded. If it is felt that there ahould be further negotiations, then the question arises whether or not to pave xississippi Way. If the City should get the underpass the storm ' se�rer would have to be changed, and some of Mississippi Way would have to be torn up. The busi,nesaes on Missiesippi Way need their street, however. Councilman Sheridan ca�ented that the replacement of the blacktop would not be too ezpensive then anyhoa+. Counci].aian Harris asked how this lines up with the intersection configuration plan, arid mhat is the atatus of moving the gas station that is in the vray. The City Engineer said it is at an impasse with the County. Councilman Harris said that he could not see any reason for spending money, if it would have to be torn up later. As long as there is going to be some work done at thie intersection, perhaps now is the time to go shead and acquire the gaa station land, and get the work done all at once. He said that other than the zoninq, the major coasideration is the health and safety of Mr. Voaika und his employees. tie said that he did not feel that the Couacil could allw a busirness to go into any bnilding that the Firemen are not allowed to protect. WEED MOWING CHARGE COMFLAINT - MIKE O'SANNON: Couacilman Sheridaa said thBt he had received a call from Mr. Mike O'Bannon, who said that he and a neiqhbor cut the grass and waeds in a lot, and within a few daya the City contractor came out and cut them again and he received a bill for about.S100. Gouricilman Sheridan asked if there had been many caar plaints of thia.nature against the contractor. The City Manager said that since the program was initiated, there have only been about 10 complaints, and most of these have been resolved. The City Msnaqer coaimented that the Parks and Recreation Cwimission nill be diacussinq this, and a concern of many people, he felt, would be whether the public would have beach privileges. Councilman Liebl said that tha people who callad him were perturbed because they did not know about it. They rondered ho�r tha City could qive away about 7 acres of land without informing the public. Councilman Harris said that the City would be givinq away about $3500 per aere of land and getting in return a million and one half facility. Councilman Liebl asked if there would be any taxes received. Mayor Kirkhaa said rio, but the City would be gaining a swiaminq pool, plus many sport facilities. Cwncilman Sheridan said that this woald not be a City facility. He eaid that he felt that there is a lot of explaininq to do. He felt that properly, at the last Council Meeting the letter should have been received, but �thinq mora done. Tlie Motion Carried. PROPOSED Y.M.C.A. BUILDING A letter has been received by the City Council from the Y.M.C.A. of Metropolitan Minneapolis regarding the building of a full facility, Y.M.C.A. Center. They have considered many possible sites and have selected the West Moore Lake site in Fridley. They request the donation of this land to them from the City of Fridley. A citizens committee from the area surrounding the site was present at the meeting to make known their views of such a building. They presented to the Commission a letter summarizing their questions which briefly are: Is it possible to give or sell property designated as park property to a private group? Would our last natural site be lost? Is it desirable to build another swimming pool righi across the street from the Junior High pool? Would it present heavy traffic and parking problems? Is it feasible to develope the lake into a swim- ming teach? They feel that this building would be very beneficial to the City and surmunding communities but feel that a different location would be better. Chairman Fitzpatrick told the group that if the land was donated to the Y.M.C.A., an agreement would be made where by the land would revert to the City if nothing is done within three years or if the Y'.M.C.A. abandons their plan. Civil defenae purposes are those directed at minimizing and relieving the effects of an attack upon the United Statee, The normal public safety activitiee of a community, such as a warning system to alert the local popu- lation to a threat of a tornado or other natural disaeters, do not fall within the atatutory definition of civil defense, However, if the warning ayetem is inetalled for civil defenae purpoees it may be used during aud in preparation for natural disaeter, , All of the FY 69 funda available for financial contributiona to the � 3tates for purchase of equipment for civil defenae purpoees have been obligated. We have a remaining hacklog of applications for financial aaeiatance, which coupled with applications we anticipate ' receiviag before the end of the fiacal year, will exceed funda expected to be available in FY 1970, Approval of projecte in FY 1970 will, ae in FY 1969, be based on the priority of the program for wrhich ' asei�tsnce is requeeted and the date the application was raceived. Fridley, Minn. 55421 Gentlemen: On behalf of my father, Stanley C. Dahlberg, I would like to comment on the requested lot split M69-14. The Plats � Subs Committee approved this request for the following reasons: 1) The precedent had been established on the Easterly end of the plat. � 2) It would be impractical to split the line only; leaving a very large lot lot on the East-west remaining. (125' x 131.78') , The Planning Commission denied the North-South split because it would not meet the 75 foot frontage requirement, (line "B") At the Planning Commission meeting it was suggested that my , father purchase the land to the East to meet the 75 foot frontage requirement. Chairman Erickson's co�pany of Bronson-Erickson is the fee owner of the abutting property ±o the East. I believe that ' his decision not to approve the North�S�uth split could have been �nfluenced by this fact. ' I am at this time requesting the Council to approve the lot split �69-14 as apgroved by the Plats $ Subs Committee and to waive the required certificate of survey until the time that the building permits are acquired. �� 1 ' ' A' The main purpose of the certificate of survey is to prove that no permanent structures encroach upon the proposed new property line. The attached drawing shows the distance from the garage (the most 5outherly permanent structure) to b� 73 feet *. This leaves little doubt that any encroachment could exist.
