As discussed with the Council at the October 6, 1969 meeting,
the line in Riverview Terrace is in need of repairo
The City has already awarded the contract for the Dike improvement
and the road work on this street a.nd we are proceeding with the work.
I discussed with Virgil Herrick, City Attorney, the different
-ways of getting sanitary sewer repair work do.ne immediatelyo His feeli.ngs
are that we could proceed under the Emergency Ordinance Noa 426, a copy of
which is atta,ched, passed on Jul,y 7, 1969�under which we have already expended
some funds for the inspectio.n of the lines and there are around $20,000 sti11
left that can be expe.nded on the repair oi the sanitary sewer lineso
We feel tha-t if these funds are not sufficient to take care of
� this work, then we should request the Council to pass an additio.nal E�nergency
" Ordinance to take care of the costso
Virgil Herrick will be at the Council meeting and maybe this
item could be discussed further so that Council can take appropriate actiono

ORDINANCE N0. 426
AN EMERGENCY ORDINANCE FOR THE MODIFICATION OF FLOOD DIKE
AND FZEPAIR OF SEWERS
THE COUNCIL OF THE CITY OF FRIDLEY DO ORDAIN AS FOLLOWS:
WHEREAS, the City of Fridley has previously constructed a
temporary dike for flood prevention purposes; and
WHEREAS, said dike was constructed under emergency conditions
caused by high water in the Mississippi River; and
WHEREAS, the City of Fridley desires to modify and improve so
as to raise the grade of Rivervie�v Terrace and 79th Way and provide
li.mited flood protection dike to protect a porL-ion of.the Riverview
Heights Addition; and
WHEREAS, the City of Fridley has received assurance from the
Office of Emergency Planning that a portion of the cost of said
modification and improvement will be paid for through federal
funds; and
WHEREAS, certain portions of the Fridley sewer system were
damaged by high waters caused by the flood and are in need of
immediate repair; and
�
WHEREAS, the normal bidding procedure as provided in the
City Charter and City Ordinances would require too much time to
accomplish the above necessary work.
NOW THEREFORE, the City of Fridley does ordain:
i
1. An emergency exists as contemplated by Section 3.06
and 6.06 of the City Charter of the City of Fridley.
2. That the bidcling requirements of Section 6.06 of the
City Charter are hereby waived because o£ the emergency; that the .
City may proceed at once to contract for the repair and improve-
ment of the flood dike in Riverview Heights and for the repair of
damaged sewer Iines at a price consistent Frith the const.tuction
costs normally involved and for a sum not to exceed Twenty-
Five �'housand and no hundredths ($25,000) Dollars.

Nasim Qureshi questian�d me as to the possibility of removing the
poic behind th� Adm.inistrative Office of th� Fire Department,
At tha time the siren warning system plan was develop�d, it was
inte�ded tha this pole woutd be used for one of the sirens. Mr.
Qureshi suggested that the new siren could be installed on the
hose tower. This is entirely passible but ( want to point out
that thc warnt�g system siren wouid have to bc on top of the
tower and not inside th� �nclosure. The reason for this is tha�
the warning system siren has a long horn that revolves in a 360
ci rcle�. .
If i� is agreeable to th� City Coun�il to have� the hase tower used for
thls purpas�, therc is no r�ason that the pole could not be rcmoved.

A RESOLUTION CERTIFYING CHARGES TO THE COUfdTY AUDITOR TO BE LEVIED
AGAINST C�RTAIN PROPERTIES FOR COLLECTION WITH THE TAXES PAYABLE IN 1970
WHEREAS, a nuisance condition has been found to exist on the lots
listed below.
WHEREAS, the owner of such property was given notice to abate such
nuisance, and
WHEREAS, the owner of such property did not abate such nuisance and
the City of Fridley, under authority of Section 145.23 Minnesota State Statute
of 1953 did therefore abate the nuisance at a total cost of $377.72.
NOW, THEREFORE BE IT RESOLVED, that the City Clerk is hereby authorized

A RESOLUTION DETERMINING THE NECBSSITY OF AND PROVIDI1dG FOR A TAX LEVY IN EXCB3S
OF NORMAL CITY CHARTER TAX LIMITS.
BE IT RESOLVED� by the Council of th� �ity of Fridley as folloWS:
SECTION 1: That the Council of the City of Fridley heretofore received from the
City Manager a pro�osed budget of the City of Fridley far the year of 1970 which
proposed budget when examined evidenced the necessity of an adc�itional tax levy
in excess of the City Charter limits and, accordingly, t�ere was then adopted on
the 2nd day of September 1969, a resoluCion declaring the necessity for an
additional tax levy and specifyin� the purpose for which such additional tax
levy is required.
FURTHER, the Council proceeded to hold public hearings pursuant to three (3)
weeks published notice in the official newspaper of the Ci*y. rhat such public
hearing was heid on the 6*h day of Octoher 19b9, and all persons interested therein
were afforded an opportunity to be heard and made objections, if any there be� to
the b��dget as then proposed. That after such hearing and after full diacusaion of
the contents of the budget and all ob,jecCions thereto the Council further proceeded
to correct and amend the budget in such way es was deemed neeeasary by the Council
to be in the best interestg of the City; and af ter such corrections and amendments
the Council did pass and adopt by Orc�inance on first reading on the
1969, a budget for the �ity of Fridley for the operatian of its business during the
year 1970� a copy of wh:ch budget is attached r.eret� for reference purposes as

SBCTION 2: Further, upon the examination of such budgeC originally propoaed, cor-
rected� end amended and adopted by *_hP C�tv of �ridley on the
1969, it reasonably appears� and the Council doea not find that the tax levy
necessary to provide monies for the operation of the business o£ the City of Fridl�y
during the year of 1970 under said budget, is and will be� when computed in accordance
with•laW� in excess of the normal City Charter limit of thirty (30) mills on each
dollar of the assessed valuation of the property in the CiCy� but that� nevertheless�
it is reasonable and to the best interest of the City in order to provide f or the
proper operation of the business and functions of the City during the year o£ 1970,
to exceed such normal City Charter tax levy limit� and to levy taxes thereof auffi-
cient to provide the monies necessary to the operati.on of the busines$ of the City
in accordan�e with said budget.
S$C� ON 3: That to provide money in accordance with the needs and purposea of the
budget of the City for the year of 1970, taxes shall be levied in accordance with
law sufficient to provide monies provided for any purpose herein shall be appropriated
to and used for any other purpose� except as might other�+is� be authoriaed by law�
either under the general law of the State of Minnesota or the City Charter of Fridley.
