RESOLUTION NO. 61 - 1969
FRIDLEY REQUEST FOR PERMANENT FLOOD CONTROL FOR
A PORTION OF RIVERVIEW HEIGHTS
WHEREAS, the Riverview Heights Addition of the City of Fridley has been
plagued by flood waters from the Mississippi River; and
WHEREAS, Section 205 of the 1948 Flood Control Act as amended provides authority
for the Corps of Engineers to consider small flood control projects having a
Federal cost of less than $1,000,000, subject to certain conditions of local coopera-
tion; and
WHEREAS, the Corps of Engineers will make a preliminary investigation to
determine whether local protection works at Fridley would be eligible for consideration
under Section 205 authority; and
WHEREAS, the Corps of Engineers requires indication of the City's willingness
and ability to provide the required local cooperation before making a preliminary
' . investigation to determine whether local protection works at Fridley would be
eligible for further consideration under Section 205 authority.
NOW THEREFORE, be it resolved by the Fridley City Council that the Council will
provide local cooperation within its scope of authority as follows:

1. Hold and save the United States free from damages due to construction
works and adjust all claims concerning water rights.
2. Maintain and operate the project after completion without cost to the
United States in accordance with regulations prescribed by the Secretary
of the Army.
3. Provide within the scope of Council authority all lands, easements, rights -
of -way, utility relocations and alterations and highway or highway bridge
constructions necessary for project construction. Submit to referendum the
City's project and project costs where such costs are beyond scope and
authority of the Council to approve.
4. Submit to referendum, if necessary, the question of the City assuming full
responsibilities for all project costs in excess of the Federal cost
limitation of one (1) million dollars.
