PLEDGE OF ALLEGIANCE: Mayor Kirkham requested the audience to stand and join the Council in reciting the Pledge of Allegiance to the Flag. INVOCATION: . Reverend Bergren, Redeemer Lutheran Church offered the Invocation. ROLL CALL: MEMBERS PRESENT: Sheridan, Kirkham, Liebl, Harris, Breider MEMBERS ABSENT: None APPROVAL OF MINUTES OF THE REGUI.AR COUNCIL MEETING OF MARCH 2, 1970: MOTION by Councilman Liebl to adopt the Minutes of the Regular Council Meeting of March 2, 1970. APPROVAL OF MINUTES OF THE SPECIAL PUBLIC HEARING MEETING OF MARCH 9, 1970: MOTION by Councilman Harris to adopt the Minutes of the Special Public Hearinq Meeting of March 9, 1970. Seconded by Councilman Sheridan. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. ADOPTIOI3 OF AGENDA: Mayor Kirkham stated that there was one item to add under cammunications: D. Letter from Chamber of Commerce regarding favoring competitive private garbage pickup. MOTION by Councilman Harris to adopt the Agenda as amended. Seconded by Councilman Breider. Upon a voice vote, all votinq aye, Mayor Kirkham declared the motion carried unanimously. VISITORS: Mr. Carl Paulson came forward and submitted a letter to Mayor Kirkham and asked that copies be made and given to the Council Members. Mayor Kirkham read the letter aloud which called for the resignation of Councilman Raymond Sheridan and Councilman At Large David Harris, with a request for time on the next Council Agenda to explain the reasons why this request is made. Mr. J.R. Nichols, 931 Mississippi Street N.E., said that he w�ould like infor- mation on the refund of the REC cha:_ges. He said that in his case he paid the plumber, and the plumber paid the City. He felt that he was entitled to the refund of the $100. Mayor Kirkham told him that this was an item on the Agenda. REGULAR COUNCIL MEETING OF MARCH 16, 1970 PAGE 2 CONSIDERATIDPI OF SECOND READING OF AN ORDINANCE FOR REZONiNG IN HYDE PARK AND CITY VIEW ADDITION: Councilman Liebl said that every member of the Council is fully aware of this item, and the only member with any questions would be Councilman Breider. Councilman Breider answered that he had no questions. MOTION by Councilman Liebl to adopt the Ordinance on second reading and waive the reading. Seconded by Councilman Breider. Councilman Sheridan suggested that as the first reading was on November 3, 1969, and over 120 days have elapsed, that perhaps someone in the audience would li�e to have it read. There was no�response, so Councilman Sheridan withdrew his suggestion. Councilman Harris said that this plan presented by the City Manager is an off-shoot of the plan drawn up by the planner the Planning Commission hired for the development of the overall area and the Council felt at that time that it would be difficult to implement. Since that time he has talked to some of the Planning Commission members and studied the plan further and is of the opinion that the plan presented by the Planning Commission could be implemented. He said th�t he must vote against this proposal as he felt that the original plan is superior. UPON A ROLL CALL VOTE, Liebl, Breider, and Sheridan voting aye, Kirkham and Harris voting nay, Mayor Kirkham declared the motion FAILED. (A 4/5 vote is required on any rezoning ordinance). CONSIDERATION OF APPOINTMENTS TO LEGAL COUNSEL, BOARDS, COMMITTEES AND COMMIS- SIONS: � Planning Commission MOTION by Councilman�Sheridan to appoint Oliver R. Erickson, 1315 Hillcrest °' Drive N.E., as Chairman of the Planning Commission. Seconded by Councilman xarris for discussion. Councilman Harris asked if this was done with the concurrence of the dates as suggested in the Agenda. Councilman Sheridan said that at this time he would prefer not to go by the dates as set out. Mayor Kirkham agreed that the appointments will be made subject to a later definition of the length of terms. Legal Counsel MOTION by Councilman Liebl to appoint the law firm of Hall, Smith, Juster, Feikema, and Haskvitz, with Leonard T. Juster to be named as City Attorney effective April 1, 1970. Seconded by Councilman Breider. Councilman Harris commented that he would abide by the wishes of the City Attorney, and not debate the issue, but he had to say that he felt that this is a shame and a disgrace to the City of Fridley, and that Virgil Herrick has served the City Council excellently. He has served in all fairness to everyone throughout the City. He thought that the City ought to recognize that Fridley got more than a City Attorney in Virgil Herrick as he took an active interest in trying to entice new firms into moving into the City. He was always willing to meet with him to talk about the virtues of this community, in his dealings with a prospective company. He felt that the decisions on the part of some of the firms to move into this City was due in part to his contributions. The question was asked of him if he did not do the job, however, this move was politically motivated, and the citizens of Fridley are the losers. He said that he would like to take this time to say "Thank You" and further say that it has been good working with him. Mr. Virgil Herrick, City Attorney, said that he w�ould like to say that he has enjoyed serving as City Attorney and that he recognizes the riqht and privi- lege of the City Council in having whom they want to serve as Legal Counsel. He said that he understood the reasons for their vote, and bore no personal animosity. He tried to do a good job and he thouqht t.hat he had. If he had erred, it was not due to lack of effort. He said that he would pledge his support to the City of Fridley and the City Council in the future. The City Engineer said that copies of the necessary document have been provided and he handed out copies to the Council. The City Attorney said that he would look at them and suggested that the City Manager and.the Mayor be authorized to execute them when they are proven correct. MOTION by Councilman Harris to authorize the City Manaqer and Mayor Kirkham executing the easement for the water line leading to the water treatment plant. Seconded by Councilman Sheridan. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. ORDINANCE #449 ° AN ORDINANCE UNDER SECTION 12.07 OF THE CITY CHARTER TO VACATE STREETS AND ALLEYS AND TO AMEND APPENDIX C OF THE CITY CODE: (Thomas Albers, SAV #69-10) The City Engineer said that the City has received the necessary easement, alonq with the agreement for the relocation of the fire hydrant. MOTION by Councilman Sheridan to adopt Ordinance #449 on second reading, waive the reading and order publication. Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. - CONSIDERATION OF CASINO ROYALE LICENSE: Councilman Breider asked if the previous motion that failed included operation on regular hours.and Mayor Kirkham said yes. Mr. Carl Rostberg, 2217 Humboldt Avenue South, of Casino Royale, said that he had his license suspended because of mis-management. He said that he hired a manager and since that time he had two violations. If his license is returned to him, he will be operating the business himself and will abide by the City regulations. Mr. John Lindell, Representative of Shorewood Associates, said that he felt that Mr. Rostberg has done a good job. He said that it was unfortunate that Mr. Rostberg, due to mis-management, allowed the violations to occur, but if his license is returned to him, he will be there in person to supervise and he felt that it would be operated as a contribution to the co�nmunity. Councilanan Harris asked what protection the City has under the Ordinances when an owner has a manager operate a buainess under his license. The City Attorney said that the owner would still be responsible for the manager operatin;g the business. In this case the owner just did not keep close enough watch on what was going on in his establishment. Councilman Harris asked if there was any way that the City could be notified in the event an owner would not be managing the business and hires a manager to rux� it. The City Attorney said that there is included information relating to managers in the on sale license forms and with very little trouble it could also include 3.2 establishments. Councilman Sheridan suggested that this be updated for the new licensing period. The City At�orney said that as concerns the City of Fridley - Clemron, Johanson et al lawsuit they have said that they are entitled to the money and further that they would hold the City harmless. He said that he had talk�d to a gentleman and he told him to contact Clemron. It may have to be arbi- trated. Mr. Dick Waldstein, 7373 Memory Lane N.E., said that Clemron has said that the people are not entitled to the money, �et the people feel that they have been indirectly charged for this connection. Clemron has said that this was not part of the pt�rchase agreement. He asked if, since the Council has approved the refund of the money, will not that have to be macie up samewhere e15e. Councilman Harris said that this money was only held by the City and will not have to be made up in any way be levying taxes. He asked the City AttornQy if both names could not be put on the checks. The City Attorney said that the plaintiffs in the law suit were handled flifferently. If less than.$200, letters were sent out to ascertain if anyone other than the payor would be entitled to the money. Were a party to present evidence that they paid the contractor, the money should be paid to them. If more than $200, both the payor and the property owner should be ori the check. The Finance Director sacid that he has received many calls fro�n people �ayinq that they either paid the $100 directly or indirectly. He said that he under- stood that the check should be made out to the person the money was received froen. Thexe have been no refunds sent out to date. The City Attorney said that these people should be told to send in evidence of payment. The Finance Director asked what criteria should be used; just their word, or should they be required to sign some document. Msyor Kirkham said that he thought that Che money ehould be returned to the person who paid the City and if anyone else feels that they are entitled to the monay, that is their pri- vate affair. The City Manager said that so�ne feel that the connectfon charqe is part of the purchase price of their h�ne. Councilman Breider said that he aqreed with CounciLnan Liebl, that this should be settled in court. It could not jast be thrown up for grabs. The Finance Diractor said that he has told people that nothing will be done for perhaps 30 more days. Councilmari Liebl said that the people should be told that the Council is not clear on what position to take and that this should be a court determination. Mayor Kirkham said that the question arises, how do you ascertain if the person making the request is entitled to the money. The City At�orney said that if both names are on the check, then they would have to resoZve it. Councilman B�eider asked if there was any time limit for paying the money back. The Finance Director said no, that most people seem to be worried that the money will be returned too soon befoYe they have a ohance to talk to their builder. There have been many more telephone calls than have written letters. Mayor Kirkham said to tell the people that all refunds would be delayed until all the replies are in, then the �ouncil will proceed according td the new City Attorney's instructions. Councilman Harris added that he felt that by the time it was brought up to Code and made to meet the speci- fications set down in the Liquor Ordinance it would not be salable. Council- man Liebl said that the Council would have to consider replacement revenues. There inust be a smooth fiscally sound takeover. If both bars ate ciosed up, other money will have to be used for a replacement. � The Finance Director said that the 37th Avenue off-sale business is quite profitable. He added that there has been a suggestion that it be used as a warehouse to serve all the off�sale establishments. This would be a. Counc3l decision. Councilman Sheridan said �hat he was not in disagreement with the 37th Avenue Lounge appraisal, but he did not think it shoul.d be advertised at the same time. He said that he did not see the reasoning for holding up the Shorewood bid for the appraisal of the Marshall Street operation. He said that he had reservations on the use of that opera{:,ion as a warehouse. He felt that in this day and age, h� could see no reason why the City should have a.warehouse. With the ability to make deliveries, it would be a poor investment to tie up the land and building as a warehouse. Councilman Harris agreed that the one should not be held up for the other. As it has to be a supper club or a hotel- motel type of operation, it does not seem feasible at that site. The Metro- politan Sewer Board may be interested in purchasing so�ne land in this area. The City Attorney suggested that Shorewood also be advertised in the txade journals. - MOTION by Councilman Harris to authorize advertisement for bids for Shorewood Lounge with the change that all the coordination should be through the City Manager's office and that sealed bids will be received until 1:30 P.M., June 1, 1970. 5econded by CounciLaan Sheridan. As far as they kne�t they wer.e still responsible. He said that he also talked to D.M. Noyes _ Constructian Company and it seems that they made a bad bid and are losinq money on the praject, and are having trouble paying their subcontractass. Mr. Ice Comstock, of Coanstock and Davis, Inc., Consultinq Engineers, s8id that they have not been paying their suppliers. There had been no payment up to the lst of March and he did not believe that there had been any since. This normally would be of no concern to the Council, except that the question atose on the bondinq company. He said that there �as an astimate in the Aqenda for payment to D.M. Noyes`Construction Company and he felt that the City �ta� entitled to an agreement that this money would be applied to the !'�idley job, rather tha�a some other job that the company is currently workinq on... Councilman Liebl asked if a good job has been done so far �nd Mr. Caaastock said yes. The City Attorney asked how must is still unpaid. Mr. Comstock an�wered that if the estimate is authorized to be paid tonight, it v�rould leave about $75,000 I.eft unpaid. He said that he would like some protection so that the money is applied for materials on our site. The City Attorney suggested makinq the payment jointly with the bonding company and D.M. Nopes Construc- tion Company, with an agreement that the maney will be used on the Fridley site. He said that the City w�ould have to watch to make sure that it was dorie, and if not, no more payments w�ould be made. He advised that the City would be all right, unless the bonding company and the bidding company both go out of business. Aa long as the bonding company is authorized to do busineas in the City of Fridley, he did not feel that there was too much cause for worry. He said that an alternate sugge�tion has been made, that the poles be placed in Locka Park with the lines.running up to 73rd from the park to eliminate the need for poles on 73rd Avenue. He expiained the proposal on the screen for the Council. The poles would be along the south right of way of Minnesota Transfer Railway. This is in the vicinity of the 345 KV line. The,re are poles now on the north side of 73rd Avenue service road for street lights. rIt is not known haw the property west oE Carter Day will be developed. The poles wauld be the same. size as those on the north side of 73rd Avenue now. Councilman Harris asked why not use the same poles as for the 345 KV line. Mr. Larry.Benson, N�P, said that that could not be doxie, the voltage interference would.be uncontrollable. He said that the line on 73rd Avenue was originall,y proposed as an undergraund feeder. He said that �t this time it looks feasible to connect onto .the line in Locke Park. Councilman Harris asked if all the lines for Coon Rapids do not have to be undergraund. Mr. Benson said yes, by Ordinance.- If the �ouncil should insist on an underground line, NSP would then have to go back and look over the entire area aqain. Councilman Sheridan explained that in a discussion with John Pearce, NSP, he understood that if the cable was buried, but the property not fully de- veloped, there would be no way to know where:to place the splice boxes. He said that he understood that the splice boxes have to be put in at the time of burial of the cable. Councilman Harris asked if that cauld not be done later and Mr. Benson said that it was quite difficult. It w�ould mean that a customer w�ould be without service for sane time. Each splice box would take several hours. Councilman.5heridan said that Mr. Pearce_indicated that.they were not saying that the line �rill nener go underground, but rather that they would rather go along with an overhead until the potential developinent is known for the area abutting Carter Day and ir. Commerce Park. This would allow them to properly size the line. - Counci].man Breider asked if he understood correctly that if this was to go underground, that the whole area wou�.d have to go back to the planning stage. Mr. Benson said yes, and perhaps there would not be an underground line on Osborne Road in that event. The whole area would have to be redone as concerns feeder lines. Councilman Breider said that it may never go underground. Mr. Benson said that as the area develops it may be required to furnish necessary power. It i$ not felt feasible at this time. Councilman Harris sai.d that he did not like to consider more poles through the park. Counci Lnan Sheridan asked if there was any connection to Columbia Arena and 13rd Avenue. The City Engineer eaid yes, there is a line on the west side of Carter Day already through there. - Councilman Sheridan asked if the poles could be mov�d from�the north�-side of ' 73rd ]�venuEa service road into the median to light both sides of the road with long extension azms. The City Engineer said that the boulevard is�vety wide there and i:he light would not reach. The maximum overhang is 20 feet. He � pointed out that the 345 KV line would be on the north side of the txacks and this propoaed line would be on the south side. Mr. Benson added that this would be the limit as to how close they could be. He said that he tavorad following the right of way. Councilman Liebl said that he vranted to make � sure that t:he duct line went in on Osborne Road. Mr. Benson said that it is proposed at: this time. Councilne�n Liebl said that he felt-that�to.put in burial cab�.e on 73�d Avenue also would be � wa$te�of money. He felt that it was � necessary t:o get a commitment from NSP that they wi11 put in duct lines under- ground from University Avenue to T.H. #65 on Osbprne Road. Mayor Kirkham said that he fel.t that they should be allowed to put the lines in along the railroad � track right: of way along Carter Day. He felt that thia would be only a minor detraction. Councilman Sheridan agreed, and said that he w�ould ntuch prefer them there, rather than on 73rd Avenue. MOTION by C'ouncilman HaYris to approve the reute along the south right.of way of the Minn�esota Transfer Railway for a 13.8 KV feeder line reqt�ested by NSP, with the ad.ditional agreement that NSP must put the line on 73rd Avenue under- ground by 1.975, or show justification at that time why not, unless development in the area. makes it necessary to go underground sooner. Seconded by Council- man Liebl. Mr. Benson said that the Council would have to realize that to install an underground. feeder the loads would have to be there. It is possible that.the area might develop into several small industrial firms and the load still would not be too great. It may not be necessary in 1975. Councilman Sheridan said that it may not be that the KV is changed, but in the event it ia, tiian it should go underground. Councilman Harris felt that this agreement should be in writing and asked the Administration to prepare one covering these stipu- lations. . The break down pr!ovides that N.S.S.S.D. will pay for blacktopping, base and the boulevard work on the south side in the amount of about $20 thousand, and the City will pay for concrete curbing and the boulevard work on the north side in an amount of about $27 thousand. The reason for the City's share being larger is that there is some storm sewer work necessary. Councilman Liebl asked if this agreement will be advantageous to the City. Hanson, 1476 Onondaga Street: He reiterated his former co�ente, and said the neighbors and he were wondering why R-1 property should be rezaned to apartments when there ie plenty of R-3 land still available. Further, there Was never a request to put a street through the middle of the lots. The neigh- bors have recently received a notice from the schoolboard that they are going to bus 150 children from that area to Blaine. He felt apartments would briug in more children and this would ag�ravate the problem. Chairman Erickson explained the easement through the center of the lots was ' put there in case the people would want to sell off the back part of their lota, but it would not be used if they did not wish to sell. Mr. Myhra, referring to the Apartment Study the Planning Co�ission recently completed, said that what we have always thought to be true is not necessarily so. People do move out from ap�.rtments and the ratio in older apartments is lawer than the new ones. The co�nents most heard were basically the mobility of the renters which presents problems of children coming and going. Mr. Fitzpatrick added that the apartr:ent study showed that the oldest apartments in Fridley do n�t have more children than the newest ones. RICE CREEK NATURE TRAIL. , Mrs. Betty Ann Mech was invited to ihe meeting to better explain her proposal for a Nature Trail and Nature Center along Rice Creek. She opened her presentation with a 20 minute film on tt�e importance and operation of such a ' center. Mrs. Mech stated that she had already met With the Parks and Recreation Commission in New Brighton, Minnesota, and that they are planning to build a Nature Center along the east side of Long Lake, which could be very easily connected with one in Fridley. She indicated that Metronics owns some of the ' land along the creek and that they plan to put picnic tables in this area �vith the hope of preserving its natural beauty. ' ' � � Mr. Ron Burton, a teacher in the Fridley School System, stated that he felt a Nature Center would be a great asset to the schools. He said that they are already using the creek for study in Conservation and Horticulture classes. Mr. Burtori, a member of M.A.C.E., said that with the over population problem as it is, soon there will be very little, if any, natural habitation left. Mr. Burton felt that people are using all the facilities along Rice Creek and especially Locke Park. He said that he knew of several people who would be willing to man such a center, so it wouldn't necessarily involve money for manpower in the actual operation of the center. Mr. Fitzpatrick stated that we°ve had this in mind for some time, but that we've been waiting for the owners of the homes in this area to request such a project. - , Mr. Blair asked if a Citizens Committee could contact some of the people to see just how many of them would be interested? Mr. Burton said that.they would and that he felt that Locke Park is over-used to the point that if Me � worked at it hard enough, he was relatively sure that we could $et sone firtancing for the proj ect . � Mr. Wayne Wellan, a represen�ative of th� Fridley Jaycees, was prese�tt and said that he was sure his organization would be willing to back a Nature Center as long as it didn't involve a lot of land purchasing. The Motion carried. FRIDLEY YOUTH FOOTBALL ASSOCIATION. Mr. Larry Stickler, Mr. Frank Hart, Mr. Glenn Engstrom, and Mr. Sam Iaquinto were invited to present their rec�mmendations for the 1970 - 1971 Youth Football Season. Mr. Iaquinto said that there were 325 boys, ages 8 to 13, registered for the 1969 - 1970 season. There are three traveling teams and they play with 8 other communities. The three divisions are Pee Wee, ages 9 to 10, with a maximum weight of 100 pounds; Light Cubs, ages 11 to 12, with a maximum weight of 110 pounds; and H�avy Cubs, ages 12 to 13, with a maximum weight of 120 pounds. Each team has a maximum of 25 boys. The classification for divisions that they use are set up by the N.R.P.A. The Fridley Parks and Recreation Dixector, plus the Fridley Parks and Recreation Commission, are members of the N.R.P.A. For the 1970 - 1971 Season, they plan to have 6 P�e Wee teams, ages 8 to 10, with a maximum of 100 pounds, and 4 Cub teams, ages 11 to 13, with a maximum of 120�pounds. The season will begin the third week of August and will run until the second Sunday in November. The 3 t�°aveling teams are covered by a Major Medical Insurance policy and the other teams are covered by Major Dental. Mr. Iaquinto said he f�lt the fields were inadequate for play, due to the�turf. He said there wers plenty of fields and the size was no problem, but that they were overly dry. Mr. Brown stated t',_3t �n overland irrigation system for parks is planned for the coming season. Mr. Iaquinto made a request �or a fui�-time coordinator for Football, like there is in several of the other sports. The Association said that all the Cubs try out for the traveling teams before � the House teams are formed. The registration fee is $2.00 and each boy must have at least one of his parents present to register. The parents must sign a waiver. � � The Football Association's main complaint was the overlapping between the Football Season and the Hoekey Season, along with the condition of the fields. The Canada Dry Company provides the pop machinery, so it wo�ld only involve the purchasing of a pop corn maker, and a freezer for the ice cream. Mr. Brown felt that it would eventually be self-supporting. Mr. Ash asked to amend the Mot�on to include only the sale of pop, pop corn, and ice cream. All agreed. The Motion carried. DONATIONS. Mr. Stimmler suggested that the three donations being held in the General Fund £or the Parks and Recreation Department, be used to purchase a camera and projector, as requested by Mr. Brown in the 1971 Preliminary Program Plan, under division "F". WHEREAS, the contractor has proposed to do towing and storage of police impounded automobiles and automobiles deCermined to be, and found to be, in violation of the Fridley City Code or ordinances and the State Stautes. AND WHEREAS, it is in the best interests of the City that the contractor show responsibility to the City and the public and indicate the charges and rates for towing and storage of motor vehicles, ANH WI�REAS, it is the intention of the City and the contractor that this agreement shall run for the period of a year from to NOW, THEREFORE, it is mutually agreed; 1. That the contractor will do towing, removal, and storage of vehicles promptly upon the order of the Police Department of the City. 2. That the contractor will file a certificate of insurance of public liability coverages with limits of $10,000 for property damage, and personal injury limits of � $100,000 for any person, and $300,000 per accident protecting the City of Fridley from any loss or liability by reason of the act or acts of the contractor. The certificate of insurance is to be filed with the City Clerk of the City of Fridley and the insurance is to remain in force during the term of this contract and for any renewal thereof. It shall be the responsibility of the contractor to provide additional outside storage if needed to meet storage volume requirements. The outside storage yard shall be screened in accordance with the policy established by the City Council of the City of Fridley and all storage shall conform with City of Fridley Code (Ordinances) and Minnesota State Statutes. 4. She had requested luzther study into the matter of the pending�assessments at the last meetinq. He wondered if there was any time limit. Mrs. O'Berq said si�s did not believe there was any. time limit. She said that if this rezoning was voted out and the rezoning would not qo through, she assutae8 that she would get her money back from escrow. Councilman Harris said that there would be a pending assessment as 1on, as the resolution orderinq the improvement was passed. If it would,have been passed conditional on the rezoninq going through, it would sti�l be questionable whether FHA Mrould consider it a pendinq assessment. Mrs. O'Berg said that it should have not been ordered in until after the rezoninq was passed. Counctl- aaan Liebl said that the Council ha3 to adopt the resolution to indicate to t�e ,people that tiiere would be pending assessments, and give them an idea of how much it w�uld be. Also, to indicate to the Hiqhway Department that the City is serious about pursuing this project. He said that he felt that to be responsible to the people in that area, the Council �hould adopt the Ordinance on second reading. If it is voted out, there �rould be no pendinq assessments. Mrs. O'Berg said that she was told on the telephone, by the Third Ward Councilman, that there could be no pending assessments. She said that she objected ta beinq given the wrong information. She said that she would have priced her hous� for sale differently had she known that she was goinq to have to put money in escrow. Councilman Liebl pointed out that Mrs. O'Berg and Mr. Ken Strand are the only two people opposed to this rezoning and that about 98+t of the people in the area are in favor of it. Mrs. O'Berq pointed out that there was also a petition for the rezoning first, then the people could sell their hoznes to c0�nercial enterprises and they could put in the improvements. Councilman Harris said that the Council is bound by the existance of the resolution on the books. The resolution perhaps should have been worded so that the im�rovement would be depenc:ent on the rezoninq passing. He said that he was sorry that ther.e was a laak of communi- cation. The City Attorney said that the FHA de�ermines whether there is a pending assessment or not, and he did not know if modifyinq the resolution would have any effect on the FHA's 8etermination. Council- man Sheridan pointed out that if the reso_'_ution was worded to be depen- dent on the rezoninq, it would have served no purpose. When digging was completed it was discovered that the blockage was cau�ed by roots in the portion of the service (stub in from main iine) that was installed by the City. The line installed by Mr. Porter was free of blockage. PORTER 6870 CHANNEL ROAD I received a call fram Mr. Porter on December 12, 1969, regarding a backed up sewer in his home (above address). I sent the aewer man up to see what could be done to give Mr. Porter some relief from hie pro- blem. I then went to said home and after conferring with our sewer man, Arthur Silseth, we both agreed that the only way to detex�ine what was wrong with the service would be to expose it. I informed Mr. Porter of this and proceeded to help him find a sewer contractor that could do the work im�ediately. After exposing the sewer service, we found that the part of the service that was put in by the City was completely plugged with tree roots. As there were no roots in the section of sewer service line that was put in by the homeowner, I can only assume that the City service was faulty; thereby throwing the responsibility of the plug-up to the City, as it was in our service line. I would recommend that the City pay all or at least part of the cost of repair to our service line. �ur Ordinance states that the pro- perty owner is responsible for his own service, from the home to the sewer main in the street. Earninga for the year totaled $268,691.50. This campares with $220,399.02 in 1968. The higher earnings are due principally to higher interest rates obtained on im►est- ments. The intQreat earned by each of the funda ia retained by that fund, aa required by law, and ia credited as income of �he fund earning the interest. A large part of the interest earned will have e�t�� a direct or indirect affect on taxes that Will have to be levied in 1970 ox in future years. As an example, ' interest earned•by a bond fund that requires a tax levy, will �ean that leas taxes will have to be levied by that fund in the future. Interest earned by' , a fund such as the Liquor Fund, means there i� that much more money available for tranafer to the General Fund. A great deal of the intereat earned is for apecial assessment funds. Interest ' earned on apecial assessment construction accounta is credited against the , cost of the project as the interest the City is paying on the bonds during construction, is charged to that pro�ect. The money available for inveatment � � � ' � � in the apecial assessment principal and interest accounta as available primarily because of prepayments of apecial assessments. When apecial assessments are prepaid the City no longer collects interest on them, therefore, it ia important that the maximum amount of interest be earned on imrestments in these funda.
