Mr. William Merlin, lawyer for Mr. Nelson, Sr. and the Investment Company, explained that the rezoning request was approved by the Planning Commission last year and the Council had asked that the request be held up until the apartment study was completed by the Planning Co�nission. At this atage, they were especially interested in making the middle of the lota favorabie tor proper development. Mr. Nelson, Sr. said they �+ould like to develop the South flalf of the lots for apartmenta constructing the kind of b�ildings which Nould be an asset to the courmunity and economically sound to operate. The area near R-1 would be used for parking and open space. They feel there ia a need for this type of units. Mr. Otto Schmid of Urban Planning and Design, Inc. e�lained further the plans for Lot 30. The rezoning request was for an R-3A Diatrict between a R-1 and R-2 District, and using the problem area in the middle of the lot for parking and recreation. Mr. Wyman Smith. representing Mr. Saliterman� explained to the Planning Comtniaeion that the preliminary plat involves the Shorewood Plaza Shopping Center. It's lengthy meets and bounde deacription hampera work and the City has wanted it platted for years for ease in processing. Also, the platting is needed for the dedications of easements for sewer and water that runs through the property. That is. a�erely a division of th� property into lota aad blocks. Chaira�►an Erickeon mentioned that the agreemeat concerning ths storm sewer eaaement through the property should be in the motion. They vould havs to agree to provide an easement to the City. The etorm sewer now in this area is just an open ditch but a new one would not be assessed to the peopls. Mr. Myhra mentioned that there was a 50 foot error in the North°South meaeurement of Lot 1, it should be ahottened 50 fcet to corform with othar Planned Development Districta. Upon a voice vote, Erickaon, Myhra, Fitzpatrick voting aye, Jensen abstaining, the motion carried unanimously. 2. CONTINUED PUBLIC HEARING: REZONING REQUEST LZOA �69-12, ROBERT V. PRITCHARD: South 2/3 of Lot 4, Auditor's Subdivision No. 108. Mr. Thomas E. Marxen - 1620 Onondaga St.- stated that he wanted the area developed in the right way. He has no objection to the development but he wants it done in the right way. He also stated that he had discuesed the probleme with Mr. Pritchard but nothing had been resolved. Chairman Erickaon commented that the Planaing Comaaission has been tabling this item for some time because Mr. Pritchard has not been here, and it was his understanding that Mr. Pritchard was going to gather more information before bringing it back before the Planning Commission. Darrel Clark added that Mr. George Nelson, Lots 30 � 31, had been in to •ee him last week and had stated that he was going to reapply for hia rezoning in thie •area. Mr. Erickaon commented that Mr. Nelson's rezoning had been tabled until the Apartment Survey was completed and he felt that Mr. Nelson's rezoning was a factor and Mr. Pritchard's could not be coneidered without it. Darrel said that he would epeak to both partiea. MOTION by Myhra, seconded by Jensen to continue the rezoning request ZOA #69-12, by Robert V. Pritchard, indefinitly, the purpose being to put it off until further information is received to reach a conclusion. Darrel mentioned that the Planning Comaniasion wae getting cloae to the 90 day limit. MATION by Fitzpatrick, seconded by Myhra, to ask the City Council to extend the Planning Conm►issjon time to act on the matter for 60 days. Chairman Erickson answered that this was not posaible unlese the City Ordinance was changed. Mr. Clark added that all Public Hearing noticea are published in the Fridley Sun. Mr. Saari comm�ented that there were others interested who did not receive the Sun. �hai�an Erickaon explained that it was not econrnaicallq feasible to notify all of the people who would be interested in every Yublic Hearing. Mr. Mittelstadt said that there is always this objection and he �ould like to see people within 1500 feet notified but it just was not possible. Chairman Erickson asked if there was any further discussion on the motion? Qpon a vo�c� vote, all votiag aye, the motion carried unanimou8ly. Chaiza�an Erickson then opened the floor for discuasion by the Plannina Coa�ission members. Mr. Mittelstadt com�nented that he felt the project should be turned down � at this time, but not for many of the reasons the people had given. It aeemed in thia case that just about all of the people were against the pzoposed devel- opment and he had to agree that the tight money situation would eventually ease. � Reeping this area open for singie family dwellings would invite residential deveiopers into the area. He was against the rezoning. 1 Mr. Jensen stated that he had mixed feeling towards the rezoning. He had sympathy for the people residing in the area and could understand their feelings that the project was not reasonable. Hawever, he also sympathized wi.th the owners of the property and th�. peCitiezer. The plans were extremelq ' well �eveloped and sensibly drawn anc; indicated a great deal of concern for the neighborhood. ' I ' I� ' � , This is a problem piece of property. It �a� m�ace� �� �c��l zo�ing to the West and is located near a major co�nty rosd. He realized the people of the area felt it was a wonderful place to live but unbiased lending institutioae don't feel that living close to a highly traveled county road is conduaive to high evaluations. They also take a dim view of comm�ercial propertq being so close. He felt that it might be a good idea to look for a compromise and wondered if the other members would like to coneider that. He did not feel that he coul,d vote favorably for the project as presented. Mr. Fitzpatrick mentioned that the peaple of the area had developed their property believing the area would remain zoned for aingle residencea. He was 1� PLANNING COMMISSION MEETING - FEBRUARY 18 1970 PAGE not convinced that the Riedel property could not be developed in the same way. Chairman Erickson asked if Mr. Fitzpatrick had any feelings about a compromise? Mr. Fitzpatrick answered that he didn't know what the compromise would be and he would have to hear it before making any decisions. Mr. Myhra arrived at 8:00 P.M. Chairman Erickson explained to him that the general consensus of the Planning Cammission seemed to be not to vote in favor of the petition and that Mr. Jensen had suggested a compromise could be worked out. Chairman Ericicson added that if a compromise was possible he would like to see it. This is definitely a problem piece af property. Even a retention pond would eventually overflow and n� matten c�st�t the land is developed the storm sewer will always be a problem. The prohlem would be worse if the land was zoned coa►mercial. � Mr. Myhra stated that there is always a conflict of interest in a case like this, between the petitioner, land owners, and the City. The plan as now presented meets the interests of the petitioner, who had done a fine job presenting it, and some of the interests of the City, who would like to � see the property developed, however it does not meet the approval of the people in the area. The City does need apartments but the Planning Commiasion has always tried to locate them adjacent to large areas of apartments, � com�nercial zaning, rivers, or wide roads. He co�iu not ev�.r r����;.;;,;�..; ;:�1e Planning Commission recommending approval of an aparttaent complex surrounded on three sides by homes. � ' ' � a , ` � ' Chairman Erickson asked whether any of the members of the Commission thought it would serve to delay the vote on the matter to try and come up with a comprc�mi�e and �sked if ti►e petitioner was interested in a delay? Mr. Wall said that tt►ey ciid not want their glans to go down the drain and they wzre willing to adapt to try and solve the pxoblem but they needed some idea of what the Planning Commission and the people wanted. The Wall Company feels that this plan is the most attractive design for the area. There is room for double bungalows between the apartments and 7th Street but they had preferred to leave it open space, hawever theq would consider an alternate plan. He did not feel it would ever be economical to build single family dwellings in the area. ?hey n�ed a suggestion to adapt their community to the existing community. Mr. Mittelstadt comment�d that he did not feel that the Planning Comm�ission should let the petitioners dangle or ask them to compromise. Double bungalows will not solve the problem. When you ask people to change the view that they have had for years they get emotional and won't accept it. Fridley will not remain quiet and peaceful forever but the people have a good arguement. Chairman Erickson said that the Planning Commiesion could either continue the discussion or move to recommend approval or denial of the rezoning requeat. This does not indlcate the feeling of sll the people but it at least ahows that some of the people might be willing to compromise. Mr. Mittelstadt said that fie thought that the petitioners agreed with him. Mr. Wall stated that he appreciated the attempt of the Planning Conmdseion to resolve the problem but upon discussing a buffer axea with his architect they did not feel it would wark, the area is too amall. If theq can't develop it right they would rather not develop it. ' , Northern States Power Company, 4501 - 68th Avenue North, Minneapolis, 55428, herein referred to as the Petitioner, hereby requests the City of Fridley, Minnesota for permit approval for the 13.8 KV Feeder Line located along the South ' side of Minnesota Transfer Railway right of way between T.H. #47 and T.H. #65. H. � 65, the draft that you prepared of their Petition is a little weak and really doean't obligate them in any way to put the line underground. , I know you have indicated that you do not have too much "bargaining power" but it would seem that we could ask Northern States Power Co. for a definite time period at which they will install it underground and it ' would seem that 1975 should be plenty of time. Therefore if you would just leave out Paragraph 2 of your proposed Petition and have 1 and 3 this would be enforceable to have them put it in by 1975 or earlier. The discussions have been held with union representation, , Department Heads and City Manager present. Seventeen men are not being provided uniforms in Water and Street Department and six men in Parks and Recreation. Cost are estimated for the balance of the ' year at $1,800 for Street Department and $550 for Parks and Recreation Department. Uniforms would be on a rental basis.
