REGULAR COUNGIL MEETING OF JULY 6, 1970 VISITORS: Mr. Carl PaulSOn: Hazardous Buildin at 415 57th Avenue N.E. PAGE Z Mr. Carl Paulson said that this.is re.lating to a dangerous building on Lot 4, Block 4, City View Addition. There is currently a district court case concerning this garage. There has been a hearing and there is another one coming up and he would like the Council to designate him as a witness so that he can testify. He said that there has been some erroneous information and he is in a position to clarify it. The attorney for this case is one held over froan the last Administration and he needs the authorization of the Council for Mr. Paulson to testify. He said that the property has been tax delinquent for four years, and the structures adjoini.ng the dilapidated qarage are nery close aa8 he cauld nqt see what would happen to this property. bSOTION by Councilman Liebl to authorize Mr. Carl Paulson designated as friend of the City and able to appear as a�itness. Mayor Harris Pro tem r.aid that because of tha �gnitude of the problems relating to this �question, t,h.is .i�em w�.l], be back on the Agenda for the next reguiar Meeting. Mike 0'Bannon.- Heather Hills Plat Mr. Mike O'Bannon said that in the Heather Hills plat, there will eventually be about 41 lots at the most. He hopes for three_entrances into the lots. He ' would likg to request that the 36' requirement be reduced to 31' for the entranve road. There is 50' riqht of way and he would be makinq the road 31.feet back to back. The City Fanqineer explained that the Council has adopted a policy of 36' roadways.in new pla.ts. An except�.an.could be made_baeause of.th,e steepness of the �lope of the roadway on that section of the road that will be conerete if the Council wants to allow a 31' road. Mr. O'Bannon agreed that the aoncrete would be on the steepest part of the street up the.hill, and pointed out there would be no parking on the hill. MOTION by Councilman Sheridan to grant a waiver of policy of the City Counail and allow Mike O'Bannon to put in a 31' road back to back on the concrete portion pf the street, ta start at Rice Creek Road and qo southerly 300'. Seconded by CounciLaan Liebl. Councilman Harris said that he would like to see the concrete extend through the interseation. The City Engineer added that of course, concrete i.s leaa costly to tnaintain. Mr. O'Bannon said that this would add onto the cost of the lpt� and they are high already. The City Engineer asked if he planned to keep the blacktop poztion at 36' within the plat._ Mr. O'Bannon said:that this wauld mean tak;i.ny out sane beautiful maple and birch trees. There is one maple tree that would be los� that would probably cost about $500. Co�ncilman Sheridan suggested off- aet�ing the street within the right of way to save the trees. This has been done before in the City to save soqne very lovelY old trees. He added that he understood that the streets would be done in 1970 and would be on the assessment rolls in 1971. Mx. Ed. Marciniac, 601 58th Avenue N.E., said that the east 30' has been in- corpoxated into their lots. Councilu►an Lieb1 said that if there is a motion made,. he would like to ac�aent that this is not full right of way width and the previous Cw�ncil gave � of thm street to Donnay, so that is part of their property. This malses this a specific case, and he felt that the people backinq onto Jefferson could not be assassed that iront on Madison. The street is there for the peaple living on �the west side and they should bear their share of the assessment. Since there is na curbinq, the assessment would be less. Mr• Giancola said that this is a foreclosure and he did not know what was going to happen with it. Councilman Harris said that there have been a numlaer of complaints about debris laying on the ground. The Council would surely like to see this area clea�ed up. Mr• Giancola said that he would make this request. Councilman Sheridan explained that it is the practice of the Council to hold the second reading of the rezoning ordinance in abeyance until all the plans and specifications are in and the building permit is applied for, and they are ready to start construction. The City has had cases in the past were a piece of property has been rezoned, then there is�never anything done with the property. This procedure is to eliminate this happening. There is no problem as long as the petitioner proceeds with the plans. The rezoning ordinance can be held in abeyance for 6 months awaiting the plans and specifications and if nothing has transpired, the petitioner has to start all over aqain and go through the subcommittees. Mr. Giancola said �hat he was representing the fee owner of the property and that Skelly Oil will have to take care of the plans and speeifications and the application for the buildi.ng permit. Mx'. R.G. Sundberq, Skelly Qii Company, said that the plans ar�_ready and they cari malee application for a building permit immediately. Councilman Breider said that he would like to see the adjoininq �ro�tY cleaned up also. There is an old junk ca�c sitting there that 1�e kn�'s of and. miscellaneous other junk. Mr. Giaracola said that he would urge hiaa to do so. He said that he has never discussed this problem with him sa he could not answer for him. The City Attorney said �� he believed that there was already some action on this. The City Engineer said that-a notice has been served to the property owner and then everything has been turned over to the Gi�y Attorney. The Gity Attorney said that he would check it out, and have a r�port at the next regular Council Meeting. Mr. Giancola said that he was also going to start with the r�gistered land survey to take care of Lots 7 and 8 and the south � of Lot 20. The Planning Gom- mission had suggested that this be under a registered land survey. The City Engin.eer said that he did not believe that the County would accept a registered land survey and that it would have.to be platted. The City Engineer said that their next step woul.d be to go to the Buildinq Standards-Design Control Subcoaamittee afor approval of their plans., As-to the special use permit he suggested that it should include the followinq stipulations: 1. That they would dedicate a 15' strip, plus a radius at 73rd Avanue and Cantral Avenue. 2. That they would pave the additional lane and put in curbing on the north and east sides, both to be dedicated to the City. 3. Curb all the blacktopped area. 4. Understand that the special use permit is for gas station and service station only. Mr. Richard Harris, Building Standards - Design Control Subcommittee, said that if the plans are ready, there is a meeting next Thursday and they may.be able to get on the Aqenda. Mr. Sundberg said that the plans are ready. DISCUSSION REGARDING STATUS OF PROJECT #93 (NOYES): � Mr. Comstock of Comstock and Davis, Inc., Consulting Engineers, handed out copies of a letter to the Council under date of July 13, 1970. He said that he had met with the consulting advisor of the bonding company and it appears ' difficult to arrive at a total estimate of funds to complete the woxk until the existing sanitary sewer ��ork is checked. Ae felt that it should be examined by televising so as to be able to estimate the cost of repairs to bring the project up to the specifications. He said that in the discussions , with the consultant there are three ways to get the project co�npleted. One would be to have Noyes complete the work, the second would be for the bonding company to take it over and coiaplete and the third would be �or the � City crews to complete the work. He felt that by televising the sanitary sewer lines the City would be in a better position to state an estimate to complete the work. � Councilman Harris asked if this would be a commitment of additiona� funds from the retainage. Mr. Comstock said that this could be a point of argument after the fact. The bonding co�pany could say that the cost of televising ' was a needless expense, and that the facility could be tested by normal means. Even so, he felt that this would be the best way to proceed. � Councilman Liebl asked how much of the total contrac.t has been paid. Mr. Comstock said that about $116,000 has been paid of a total contract of about $235,000. Councilman Liebl asked if 80$ of the work has been campleted. � SPECIAL FUBLIC HEARING MEETING OF JULY 13, 1970 PAGE 19 Mr. CautStxk said no, a�bout 80$ of the pipe is in the ground but saae of it is not satisfactory. He added that there is about 5400' of the pipe to be televised. Gouncilman Haxris said that it seems that this is the only way to proceed, the course of action for the City is rather limited. The City Attorney said that they feel that they cannot proceed until it is known what shape the pipes are in. He said that the bGnding caapany has shown quite a bit of interest in this job, and have shown a real in�ent to work with the City and pay their share. He agreed that there may be an argument about the televisinq later, but he did not want the City to accept worlananship that they would have trouble with later. Counci.lman Breider asked when the cleaning could start. Mr. Canstock said that the woxk could be started�in the morning and the television people have been alsrted that if the Council approved this action, they are to start Wednesdax morning. Mr. Camstxk asid that this is a big quest�on mark and once the televisinq and cleaning is done an estimate of time cauld be qiven. He said that he should •be able to give aui estimate of the am►o�unt of time left on the project in two weeks. He added that perhaps the industries that axe waiting fox the facilities, could hook onto the water line, rather than wazting for the completion of the project. There dces not seem to be any trouble with the water line. If they hooked on, it would be subject to the City Administration inspection and approval. DISCUSSION REGARDING RETAINING TAX FORFEIT LOTS: The City Engineer said that at the last meeting a map was shown the Council showing some lots that could be retained fran the tax forfeit sale for dumping street sweepings and material from const�uction. There are two lots along Alden Way that Councilman Breider had said that he would check out. He said that he talked to the Parks and Recreation Director and the Park Department would be very much interested�in these lots if the price is right. Councilman Breider said that he had talked to some of the property owners and they would like to have the lots filled but not necessarily with street sweepings. 'I"hese two lots are considered unbtiildable, but they Would give the Park Department access to ]11den Way. T'he people did not feel.that dwnping street sweepings would be desirable. Mayor Kirkham said that it sounds more abjectionsble than it really is. It would be fine sand and good clean fill. Councilman Breider wondered if thia would not mean that the sand would be blawing aUout. The City Engineer pointed out that the City has material that it must get rid of. No matter where it is put, someone would be unhappy. He said that a snow fence could be put in to try to keep the sand fran b�owing. Councilman Harris said that the lots are too law to benefit the Park Department without the fill. It would seem silly to purchase tax torPeit lots and also have to buy more fill, when the City needs a place to dump ciean fill anyhow. The City Assessor said that the lots would not be appraised very high since they are considered unbuildable. The City Enqineer said that there would be sane problem, but the lots have to be filled to use. ' 1 ' ' 1 ' ' ' � ' ' IJ � ' u ' The City Engineer questioned retaining Lot 10, Block 22 in Donnays Addition. This is a stretch of property that could be used for entrance onto 7th Street. No�w service is only fran T.H. #65 at Moore Lake. Z'his ccaxld be retained as public right of way for future development for access onto 7th Stxeet. He asked how n�uch this would cost. The City Assessor said about $6000 to $7000. Councilman Hsrris pointed out that this would not be a drive-in theater forever. He said that there would be more and more traffic generated. Would this be a way to avoid channelling all the traffic back onto T.H. #652 Councilman Liebl said that this is a long narrow stretch of land that the City could use ae right of way. It could be a sound investment to hold in abeyance. The City Engineer said that it would have to be part of a total plan involving the whole parcel. Whoever develops it would have to provide access onto 7th Street. The City could be spending $6000 for public uight of way that is riot neaessary. It would be up to the developex to develop the property. CounciLnan Harris said that he hated to see a piece of property remain dormant and continue to be a maintemance problem. He suggested alertinq the property owne� to the south with the suqgestion that it be purchased and added to the parcel. The City A�sessor said that the property owner to the south is interested in the land, but he did not know to what e�tent. Councilman Liebl said that the only one who would benefit is the man owning the drive-in theater and he is the one tha8 properly should pick up the land. Z"he City Assessor said that this lot has already been released. Councilman Harris asked that if the lot is not picked up at the auction, that the Council be apprised so that they may reconsider acquiring it. The City Assessor said that he would make it a special point to call the County the next day after the sale to see if the lot was acquired by somebody. The City Engineer said that regarding the lots on Pierce Street, Councilman Sheridan had said that he would look at the lots. He said that he did not seem to favor the ide8 as this is a nice reaidential neighborhood and there is a very steep bank. Unless Councilman Sheridan told any of the Council differently, he would recommaend that these lots be released. MOTION by Councilman Harris to retain those lots on Alden Way and south of 69th Avenye as outlined on the map submitted by the City Enqineer, and relsase those on Pierce Street. Mayor Kixkham brouqht up the queation oi what to do with unbuildable 40' tax delinquent lots. He wondered if there has ever been any cases where the assessments were forgiven, so that the lots could be picked up by the adjoining property owners who could not afford to pay the old assessments. In this way they could be qotton onto the tax rolls. The City Enqineer said that the assessments could be re-spread, but to his knowledge they have never been forqiuen. He said that the Administration could research this more and report back. Counci�man'-Harris added that these streets wovld be constructed in the construction year of 1971 with the assessaaent going on the 1972 rolls. He added that any s�reet could be accelerated into an earlier oonstruction year if the people so desired as the cost of con- struction is going hiqher every year. It could be to their advantaqe to do them sooner than scheduled, rather than waiting for the scheduled ysar. The City Manaqer added that the bids have gone up about 25�. Mr. Lewko�ticz said that their land is in the same con8ition as any other street, so why is it more. Mayor Kirkham said that this is all done by open Bid. Mr. Lewkary+iaz said that he thought that the price was way out ot line. He asked why sane streets are higher than others. The City Enqineer said that it depends on t�e eoil conditions and the lay of the land. This is also a curved street and is assessed somewhat differently. The proposal is to add saane catch basins to catch the water so it does not run so far. These things all affect the total cost of the street. Whatever the total cost of the street is, after it is bid, will be the amounZ assessed to each property oamer. Hopefully this esti.mate is high. He said that they try to keep the esti,mates high so the people will not be misled and upset when the bids cane in. The cost of construction has been going up at a fantastic rate. Mr. Lewkowic� said that maybe it should be let go for another tive yeara, the casts are bound to level off sometime. Councilman Harris said that as the Mayor indicated this is an improvement hearing not an asseasment hearing. He pointed out that when a project is iaid out, streets are grouped toqether in the same general area to try to keep the costs to the contractor down. This saving is passed on to the property owners. He added that there will probably be about 20 invitations to bid sent.out. Mr. Lewkowic� asked if that estimate includes the aost of the storm sewer work nnd the City Engineer said that it did. He gat a tag last year ,from the Health Officer because the gaxbage was not picked up, but the gax�bage haulers could not get down the alley. Counczlman Harris said that the City does not maintain alleys that are not improved. Mr. Mostoller said that he weuld be assessed both in the back and the front and his assessment would be quite h:>gh. He could not see what he got for his tax dollar. Councilman Harris informed him that 11C of every dollar is taxes to the City and for that tae get-s police protection, fire protection, parks, eto. This would be an assessment, not a tax. Mr. Mostoller said tha►t �ast wintex the Citx Police Department would not allaw cars to park on the street, but 'khey could not get into the nlley because it was not plowed. Councilutan Harris said that this would correct ths.situation, as�.inlproved alleys are maintained. He pointed out that if the plows tried to plow unimproved alleys, they would damage their equig�nent. Mr. Mostoller said that his llt shou�d buy something. Mayor Kirkham said that street and alley improvements are assessable and th�y do not come from general tax money. With the black- topping, the alley will qualify for snowplawing. Mr. Mostoller asked if there was any storm sewer work. The City Engineer said that the storm sewer was already in. Cowzca.lman Harris explained that normally when there is work to be done in an area, an opportunity is given for all the work ta be done necessary in that area, as it can be dane cheaper when the contractor is in the neighborhoad. She felt that there was a definite need for the alley, and that it was a good price. Mayor Kirkham informed the audience that the Council does not take action on any of these streets at the public hearing meeting. Action will be at a subsequent meeting. Councilman Liebl said that in the next week, he will check out these streets anci review the camments made at this meeting. On occasion, streets are deleted by the Council because of hardship cases. These streeta are in the l0 year street �provement program, and there must be a public hearing.held. He said that he would also check the people's tax problema. Upgrading the streets in the area, brings about an increase in property value, and would also take care of sane of the canplaints generated fro�a this area. Mr. Bailer Tiller, 1535 Gardena Avenue N.E., asked if just because the street is in the 10 year street improvement proqram, does t�►is mean that it cannot change. Counci].man Liebl said that this is the reason for the public hearing; to hear the wishes of the people affected. He said that he did realize that interest:is very high. Mr. Tiller a�ked why there was never a sealer put on every two years to preserve the old Gardena Avenue. He said that he wou].d have liked to see the old street saved. Mx.French said that he had covered every home but one, on the north side of Gardena from Central to Arthux' and the People were unanin►ously objecting to the sidewalks. Councilman Liebl said that he had walked up Gardena �ere Avenue and he felt that the street must be put in. Mr. French agreed, was almost unanimous appraval of the street improvement. It was only the sidewalk that the people objected to. It is felt that there would not be adequate room for snow storage, and the children still would not be using the sidewalks. Gardena is centrally located and there are blacktopped walkways in a wagon wheel fashion for the children to walk on. T1zeY are already there and have been paid for by tax money. The City Engineer said that if the water runs taward Stinson, he would not be in the assessment area. He asked why not do the rest of Gardena this year. The City Engineer said that this area is in the worst shape. They felt that the rest of Gardena cauld stand another year of wear. If the residents want the rest doae, it could be added into the construction project. He said that the asses�ment is $13.38 per foot and there ia sonae additional cost being picked up fran state aid funda. He added that there could be state aid money for the sidewalks. Mrs. Hazel 0'Brien, 1080 6ardena Avenue N.E. asked what happens when the sidewalks need repair. Mayor Kirkham answered that this problem has never come up as yet. Mrs. O'Brien said that she was not in favor of the side- walks. Mr. French asked how the storm sewer districts would be deteriained. The City Engineer said that he received a.notice because of the sidewalks. Mr. Gunzburger felt that his land was already ruined with the putting in of the street. He said that the sidewalks would be put in over his dead body: Councilman Liebl asked the audience for an expresaion of their sentiment in regard to putting in the street impro�rement. The Fire Department feels. that it is in bad shape and should be replaced. Mr. Gunzburger said that the black-between Baker and University is a race track. This street has been graded three times and blacktopped three timas sinc� he has lived there. The trend is that construction costs are going up faster than the cost of living. He explained that the 10 year program is so that everyone will eventually have a street up to eity standards. Maintenance funds came from the general tax dollar and it is not fair for those that have paid for a street to also have to pay for someone elses street,,through maintenance funds, because they do not warit the assessment. Once the streets are in to Cit�r standards, they are treated and seal coated to try to lengthen their li€e. Mr, Savelkoul said that he felt that the residents should be responsible for normal residential use but not for the extra wear and tear fraa ths trucks etc.' The usual standards of neighborhood traific do not apply. This is an unequitable proposal and he would be opposed to the $13.92 per foot assessment. Mrs. Warren Hanson��a�d that she lived next door to Don 5avelkoul and the statement was made that the cUrve would act as a traffi.c deterrent. She felt that this was not true as euery year there are cars that end up in her fxont �rard, and there are always several collisions in f=ont of her house. The City Engineer said that:the point waa that curbing was ueeded to help contain the cars and keep them out of h�r front xard. � CounciLnan Harris suggested that sane control over the traffic aould be � done by a three Taay stop between T.H. #65 and Able street. Between 61st._ and University the traffic is slowed down by the stop sign on 7th Street. The City Engineer said that he would study this and look over the accident records of the Police Department. - Mr. Francis Van Dan, 63a2 Baker Avenue N.E., said that he had the.south �S of Lot 10 and the north � of Lot Z1 and he did not think that he should be assessed. �he City Assessor said that there was an assessment �S voay up the block. Mr. Van Dan said that at one time 61st and West D�oore Lake Drive were county roads. The City Enqineer said that they were not to his knowledge. Mr. Van Dan said th�at he would have to agree that it was a race track. Fie suggested a"School Zone" sign, or iimiting fihe speed to 15 miles per hour, as there is a complex of three schools in the vi�inity. He suggested that it could be made one way.to the church. This would be sanewhat of a hardship, but it would reduce traf�ie to the residents. Mrs. Don Savelkoul said that in reqard to sidewalks. all the children are bused to Rice Creek School. All the children across T.H. �F65 are bused. There is getting to be fewer and fewer children that walk to schools.- The Senior High students drive cars and there are only a few Junior High that walk. She said that she could see no point in sidewalks, and did not want to lose any of her land. Councilman Harris said that the sid�walks were part of an overall plan that include$ a controlied access at that intersection. He suggested that the laying of the new line in Hickory Circle could be put into the street improvement project (although it would not be assessed) and have that contractor do•this work, and have G.L. Contracting Inc. continue to replace the joints. Councilman Liebl asked if this would save any money.
