PAGE 2 Permit; A permit is the authority to keep a dog or other animal of the canine species within the City of Fridley. T^ags A tag issued to individuals who make application to City Clerk and are issued a permit to maintain a dog, or other animal for which a tag is required. License Year: The licenae year shall be from May 1, year of issue, to A.pril 30th of the year of expiration. SECTION 2. CONTROL Contro ; It sha11 be unlawful for any person who owns, harbors, ox keepa a dog or the parents or guardians of any such person under 21 years of age to a11ow such dog, regardleas of age of dog, to run at large in the City of Fridley. For the purposes of this section of the ordinance a dog shall be deemed at large and shall be considered to constitute a nuisance when; . 1. The dog is off the premises of the owner and not undex the Control of the owner or a member of his imcnediate fam�ly by a leash, not exceeding eight (8) feet in length. The dog must be with a competent person having custody of him and obedient to thet person's commands, or within a vehicle being driven or pushed on a public atreet. 2. The dog coaimits damage to the peraon or property of anyone ather ChaR the owner, or createa a nuisaace upon the property of one other than Che awner, except in the defense of the owner, his family or his propexty. 3. A female dag or cat in heat off the premiaea of the owner, unlese eon- fined in the process of being transported to or from the premisea of the own�,�. A person abandons.any dog, cat within the boundaries of the City of Fridley. 11. Owner or custodian fails to have dog vaccinated against rabies at , least once every two (2) yeara, or dog's vaccination has not been within the past two years. � � � � , � r �J � � SECTION 3. PERMITS (REGISTRATION) The applicant for permit must sign and agree that he is prepared to comply wiCh regulations eatablished by the City Council. Upon payment of the pertait tag fee the Clerk shall execute a receipt in duplicate, the original of which ahdll be delivered to the person who pays the fee and the duplicate ret�tined in tkte Ci�y reco�ds. The receipt shal� deacribe the dog or animal $s to bt'eed, age, color, owner and address as a minimum. � In addition Co the permit, suitable animal tags, the shape or color of which shall be different f or each registration year, ahall be iasued by the C�erk ac�d he shall isaue one appropriate tag to the owner when the fee ie paid. The owner ahall.cause said tag to be affixed by a per�aanent raetal �aatener to the callar or harness of the animal so registered, ia such a Aaa++r►e7r so that the tag may be easily seen. The owner ahall see to it that the tng �� _- aaas�an�ly worn by the ac�imal. In case any tag-is lost, a duplici�Ce mety b� issued by.the Clerk upon presentation of a receipt.ahowing the p�tyment of �h! �egietr�tion fea for the current year, A charge of fifty centa ehall be mi�de for each $uch duplicate tag. The Council may revoke any permit if the person holding the permit refuses to or fails to comply with this ordinance, the regulationa proawlg4ted by the Council, or any state or local law govexning cruelty to anica�ls or the keeping of animals. Any person whose permit is revoked shall, within 1S days thereafter, remove such animal(s) permanently from the City of Fridley or humanely dispose of animal(s) cited in the violation being owned, kept or harbored by such person and no part of the permit fee shall be refunded. An animal permit and tag may be revoked if an owner fails to provide animals with sufficient good and wholesome food and water, proper shelter and prot�ction from the weather, veterinary care when needed to prevent suffering, and with humane care and treatment. Also if an owner shall be�t, cruelly ill rreat, torment, overload, overwork, or otherwise abuse any animal, or cauae or permit any dog fight, cockfight, b�llfight or other combat between anim$ls pr bstween animals and humans, In addition such owner shall be liable to court action under the ordinance o� the City of Fridley, State Statutes and local laws for any of the actions cited above. If any person violating the terms of this ordinance 3 times in one permit year, his permit to own, keep, harbor or have custody of animal(s) �or which the affense was cited shall be deemed sutomatically revoked and no new peraait may be issued for a period of one year from date permit is revoked. SECTION 6. PERMITS REQUIRED a) No peraon shall awn, keep, or harbor any dog over the age of six monthe, w�.thin Che City of Fridley unless a permit therefor has fi�rs� be�n � e�+cured. Permit certificates shall be issued by tl5e City Clerk for a fee established by Council reaolution. It shall be the duty of each person owning, kpeping, or harboring a dog to pay the permit fee established to the City C1erk on or be#ore the first day of May in each year, or upon establishing resi- dence ;Cn the City'to forthwith pay such permit fee. The Clerk may canse a natic� af Che neceasity of paying such permit registration fee to be printed 1c� xh� official newspapex in January of each year. P�G� S A compulsory system of permit and regiatration ia establiahed Whereby the City will isaue City owner permita and license tags to owners of dogs over siu montha of age upon proof of rabies vaccination within the preceding yeaz�, all animal permits and tags expire on April 30. Permits and tags muat be ap�lied for and abtained and tags affi.xed on dogs or other cani,nes requiring, tags before they attain the age of six months. All permita in effect �tt ti.me of enactaient of thia ordinance shall be extended to an expiration date of April 30th. Fees wi,ll be based on a minimum of six mooths regardless of date of application. Fer�mit fees are as followst 1. For each a►ale dog, or apayed dog or other canin� species; $ 5.00 2. For e$ch un$payed female dog or other unspayed canine species; $15.00 3. Permits for livestock - See City of Frid3ey Code (Ordinances) 4. For each animal of other species an amount to be deter- mined by the.Gouncil and established by Council resolution, pxovided the Council approves the issuance of the permit for such aniiasl. SECTION 7. IMPOUNDING OF ANIMAL3 The Animal Control Officer, Animal Warden, Law Enforcement Offi.ce� or Humane Soeiety ahall Cake.up and impound acly dogs ar animal,s requiring pertaite or tags �ound in the City without the ta$s; or any dogs or animals whi.ct� are+ �,n violation of any of the other provisions qf this ordinance. Animals ah1�11 be impounded in an anipnal �helter and confined in a humane manner. Impounded dogs shall be kept for not less than five days, not including Sundays and Ha�,idays, unl�ss reclaimed by �heatr owners.
