PLEDGE OF ALLEGIANCE• Mayor Kirkham requested the audience to stand and recite the Pledge of Allegiance to the Flag with the Council. INVOCATION: The Invocation was offered by Reverend Bergren, Redeesner Lutheran Church. ROLL CALL: MEMBERS PRESENT_ Harris, Breider, Kirkham, Liebl MEMBERS ABSENT: Sheridan APPROVAL OF THE MINUTES OF THE REGIILAR COUNCIL MEETING OF MARCH 16, 1970• Councilman Liebl drew the Council's attention to Page 14, the second paragraph and stated that his vote was nay, rather than aye, and asked that the records be changed. MOTION by Councilman Liebl to adopt the Minutes of the Regular Council Meeting of Maxch 16, 1970 as corrected. Seconded by Councilman Harris. Upon a voicc vote, all voting aye, Mayor Kirkham declared the motion carried. ADOPTION OF AGENDA: Councilman Liebl said that there was one item to add which was the Auman Relations Committee Minutes of April 2, 1970, and a memorandum from them dated April 2, 1970. MOTION by Councilman Breider to adopt Councilman Liebl. Upon a voice vote, the motion carried. VISITORS the Agenda as amended. Seconded by all voting aye, Mayor Kirkham declared Mx. Douglas Osieczanek complained of a hazaxdous building at 101 Ventura Avenue. He said that it has been in the same condition since the tornado There is a basement and subfloor and it is half full of water. Mayor Kirkham advised him that the Council is aware of this problem and it will be taken care of tonight. OF REMAINING APPOINTMENTS TO BOARDS, COMMITTEES, AND Building Standards - Design Control Subcommittee MOTION by Councilman Harris to appoint Tony Gnerre, 12D2 Hathaway Lane N.E., Telephone 788-8595, to the remaining vacancy of inember at large on the Building Board. He added that Mr. Gnerre has indicated a desire to be of service on some committee within the City of Fridley. Seconded by Councilman Breider. P1ats and Subdivisions - Streets and Util7ties Subcommittee Councilman Liebl said that inasmuch as the remaining vacancy is an appointment £rom the Second Ward, he suggested that this be tabled to April 20th due to Councilman Sheridan`s absence. Human Relations Committee Mayor Kirkham said that he had contacted Mrs Katherine Moss, Reverend Gerald Keefe and W.R Starwalt, and they were willing to continue serving on the committee. He said that he had a very long list of people that would be willing to serve and it takes time to interview each one. This commrttee is supposed to be a cross section of the community, as close as can be ob- tained. He has been trying to get an even distribution, representive of the City. CARL PAULSON COMPLAINT: Mr Carl Paulson came forward and talked to the Council concerning some sections of the Code regarding nuisances, parking cars and trucks on the street and the legality of operating a business fsom the home in a residential distsict. He presented a compilation of data concerning past political matters to each Council Member, the City Attorney and some members of the audience. CONSIDERATION OF BARTENDER - WAITRESS WAGE A1QD BENEFIT NEGOTIATION RL�COM- MENDATIONS: Mayor Kirkham said that he felt that the City Manager's recommendations should be followed. Councilman Liebl asked if all these items have been agreed upon and the City Manager said yes. Councilman Liebl asked the cost of the total package. The City Managex said that he did not have the exact figures, but that it would fa11 within the 9�% range. MOTION by Councilman Liebl to concur with the recommendations of the City � Manager and approve the agreement between the bartenders, waitresses and the City. Seconded by Councilman Breider. RECEIVING THE MINUTES OF THE PLANNING COMMISSION MEETING OF MARCH 18, 1970 REZONING REQUEST, ZOA #70-03, GEORGE NELSON: The north � of Lot 30 and the north � of Lot 31, except the north 125 feet of Auditor's Sub- division #129 to be rezoned from R-1 (single family) to R-3A (apartments and multiple dwellings) The City Engineer said that the Planning Commission had approved of this rezoning request. The City Engineer explained that there is one house that is set back 111' and another that is set back 36'. According to the Ordinance, this setback should be 67.5' and the petitioner is requesting a 35' setback. There were no ob7ections at the Board of Appeals Meeting. The Board recommended approval. This house faces Oakley Drive. Councilman Liebl asked if this would not result in a land locked parcel, and the City Engineer explained on the screen why this would not be so. (REQUEST BY WILLIAM H. HAM, 159 LONGFELLOW STREET N.E „ FRIDLEY, MINNCSOTA)- The City Engineer explained that this request is for a radio antenna in excess of City Code on Longfellow Street_ The property to the east is in- dustrial and on the west is resi3ential, The man on the east, Mr. Frank Zimbal, 161 Longfellow, has voiced an ob�ection as he is afraid that during a storm the tower may fall onto his property. The Board received a petition signed by five nezghbors stating that they had no objection. He said that the Board of Appeals recommended approval subject to their stipulations. Mr. Ham is a member of a military organization for radio operators. Councilman Liebl asked if Mr. Ham had insurance in the event that the tower should topple. Mr, Ham replied that he did. Mr. Ham then came £orward fox discussion and pzesented a sketch of the tower at the Council table. Mapor Kirkham said that wrth the contingencies built in by the Board of Appeals plus a hold safe clause for the City, he felt that it aould be approved. The City Manager questioned whether the hold safe clause should be a separate agreement or if it could be made part of the permit. The City Attorney, Mr. Leonard Justex, said that there should be a special indemnity agreement in addition to the permit. Councilman Liebl said that the permit should also state that Mr. Ham must renew his insurance every year. The City Attorney said that the renewal of the permit could be contingent upon the renewal of the insurance every year. MOTION by Councilman Liebl to grant the permit for a radio tower 50 feet above the roof fos Mr. William H. Ham, 159 Longfellow Street N.E., sub7ect to the stipulations set forth bp the Board of Appeals with the addition of a special indemnity agreement, and with the requirement that the permit must be renewed every year, with renewal contingent upon the renewal of his insurance. CONSIDERATION OF AWARDING CONTRACT FOR STREET IMPROVEMENT PROSECT ST. 1970-1 AN➢ ST. 1970-2. (NOTE: Bids listed in the Minutes of March 16, 1970) The City Engineer reminded the Council that at the March 16th Meeting, he had requested that the bid award not be made as yet. He reported that an agreement has been executed with New Brighton ior the improvement of Stinson Boulevard, so that street wi11 be included in the pro�ect. He said that he had investigated the lowest bidder, Minn-Kota Excavating, Inc., and did not feel that the recommendations on the company were entiirely satisfactory, however, as they were the lowest biddes and they do have the equipment, he felt that the award would have to be made to them. Councilman Liebl asked how this bid compared to last year's bid. The City Enga.neer said that this year's bid was 25°s higher than last year's bid £or the same type oE work. Councilman Liebl asked how the pro�ection given to the , public at the Public Hearing compared. The City Manager said that the bids were higher than the estimate by about 5%. Councilman Harris questioned whether the bid award should be made to the lowest bidder, if the company is not exactly what it should be. I3e pointed out that the money differential between the lowest and the second lowest �?�� REGOLAR COUNCIL MEETING OF APRIL 6„ 1970 PAGE 6 bidder may be more than offset by the increased work the City Engineering Department may have to do. He reminded the Council of a situation pre- viously, involving a bid award to the lowest bidder, wherein the tune and effort spend by the Engineering Department made it seem in retrospect that the second lowest bidder was, in fact, less costly. He said that he was not suggesting this only in this case, but he wanted to question at what point can f.he Council use it's own discretion. The City Attorney said that the City of Fridley must award to the lowest responsible bidder. If there is evidence that the lowest bidder is not responstble that would be grounds to re�ect the bids. Rumors of irresponsibility are not enough, there must be substantial grounds. If there had been trouble with a contractor within the City previously, this would be grounds for not awarding a bid. The City Enga.neer said that there was no actual knowledge, but the information received from other sources was not encouraging. Councilman Harris asked if the award could be delayed a week to allow time for the City Attorney to review this with the City Engineer, The City Engineer replied that it could be delayed a week. Ouotes were taken, but the work was over $5,000 so the project was let. The recommendation by Comstock & Davis, Inc., Consulting Engineers, is that the award be made to McCarthy Well Company. C_1 � 1 ��l ld ri � REGULAR COUNCIL MEETING OF APRIL 6, 1970 PAGE 7 � CONSIDERATION OF TOWING SERVICE SPECIFICATIONS Mayor Kirkham asked if there were any substantial changes. The City Manager said that the specifications were made more detailed Iae pointed out that one change was that before there was required so many outside storage spaces and so many inside storage spaces. This has nc,w been combined to total 24 spaces erther inside or out. Mayor Kirkham said that he understood that the Police Department was in favor of all inside storage. The City Manager pointed out that whether inside or outside, they would still be responsible. In this way, more businesses could bid. Councilman Harris questioned whether people would try to operate the business from their home, while senting stozage space elsewheze. Mayor Kirkham asked if there was no danger of impounded vehicles being stored in a back yard. The City Manager said that this is all spelled out in the specifications and is prohibited Councilman Liebl asked if the present contractor would bid and the City Manager said that he supposed so. Councilman Liebl pointed out that last time bids were let there were two bids submitted. He said that Shorty's service has been excellent. He asked if there were any violations. The City Manager explained that the contract had a continuation clause and has run for two years. He said that there were some complaints. Mayor Kirkham said that the City could not expect a contractor to keep his prices at the same rate and should be given a chance to raise them if he wishes. The City would then also have a chance to re-write the specifications if so desired. � The City Manager suggested that it could be written so that a snowbird, when towed out of the snowed in area, could be moved 7ust ahead to the cleared area by the curb. The people would still be responsible for the towing charges, but they would then have the car to go to work in the morning. Councilman Liebl said that he felt that this was a good idea. He has received ca11s regarding snowbirds and the people do not know where their car is. He felt that this would go far towards good public relations The City Manager said that this would also eliminate the problem of where to put all the snowbirds after a snowstorm. Councilman Harris said that he would like to see included that the place of business must be other than a residence. He pointed out that there may be a wrecker paxked at the residence, however. Mayor Ka.rkham ayxeed, inasmuch as there is 24 hour service, a wrecker should be allowed in the driveway. The City Manager said that it could be re-wrrtten slightly to exempt a wrecker bea.ng parked in the driveway from the ordinance for the successful bidder. Councilman Liebl conimented that he felt that the specifications were well laid out. MOTION by Councilman Harris to approve the spe�.ifications with the additions as indicated in the discussion, and advertise for bids for towu'iq service for the City. Seconded by Councilman Liebl. CONSIDERATION OF TIME EXTENSION OF PERMIT FOR SHELL OIL STATION AT OSBORNE � ROAD AND T.H. #47, AND DISCUSSION REGARDING RIGHT OP WAY ACQUISITION PROM SHELL OIL AT 61ST AVENOE AND UNIVERSITY AVENU�: The Ca.ty Engineer explained tihat the pe.rmrt for the station at the corner of Osborne Road and T.H #47 expired in March, and Shell Oil is now requesting a time extension. He said that he also wanted to discuss the status of the loopback at 61st and University with the Shell Oi1 people_ �� :�� REGULAR COONCIL ME�TING OP APRIL 6� 1970 PAGE S Mr. Stan Johnson, 5he11 Oil Company, said that they ran into some soil � problems, and had soil borxngs made, and the time limit expired. They would naw like to get an extension, so that the work can proceed. He said that in regard to the 61st Avenue and University Avenue loopback, there have been surveys made, but there is now some delay in getting the legal documents drawn up. Councilman Harris asked if they were planning on spring con- struction on the Osborne Road station. Mr. Johnson said that they would proceed as soon as the tank anchoring plans are drawn up. He felt that they should have this done in 30 days. The City Engineer said that the City Council authorized sending a letter to Shell Oil Company at the Meeting of March 2, 1970. He questioned what the answer to this was. Mr. Roger Ilstrup, Rea1 Estate Department, said that they have gone ahead and made the survey He asked that all legal documents be prepared by the Crty for him to submit to the home office in Chicago for their approval. He said that because of the increased cost of construction, he could not say for sure when the station would be rebuilt, however, he said that he did recognize the need for the property and that could be gone ahead with. He said that their budget has been cut drastically as far as con- struction is concerned, but that whether or not they rebuild right away would not preclude the land exchange. The City Engineer explained that there are others involved in this total land exchange than 7ust Shell Oi1 and the City. There is also the State of Minnesota and the Church. It seems to come down to a problem of who moves � first. Councilman Harris suggested that the City Attorney meet with the City Engineer on the best way to handle this and to draw up all the necessary docu- ments. The City Engineer said that as to their rebuilding plans, the road work could still progress with the station located where it is. MOTION hy Councilman Harris to grant a 60 day extension of the building permit to Shell Oil Company £or their station on Osborne 12oad and University Ave. Seconded by Councilman Lieb1 for discussion. Councilman Liebl said that last year Shell Oil aqreed to the exchange of land. Shell Oil gave the City a letter statyng that they would fulfa.11 their part within a certain amount of money. If they wait longer, it will cost even more. Mr. Ilstrup said that they started talking about rebuilding the station in 1967, then there was the talk of the loopback, so this caused a delay. Since that time the price has ballooned from about $36,000 to about $78,000 wrth the further delays. Councilman Harris pointed out that the City must deal with the State of Minnesota a1so, Councilman Liebl asked if Shell Oil still agreed with the letter. Mr. Ilstrup said that he can only submit the application to the home office for approval. In .TUne they were still in agreement. He said that he did not think the home office would fight tha.s, but he could not say when the rebuilding would be done, but he was sure that the exchange of land could be accomplished. Councilman Liebl pointed out that the land on the south side of 61st Avenue has already been acquired, and Shell Oil is holding up the proceedings. Mr. Ilstrup said that they were in in 1967, with plans for rebuilding the station. Councilman Liebl said that � he would like to see this expedited, and he would like to ask that�Mr. Ilstrup press for approval from Chicago. CONSIDERATION OF T F3. �47 SLIP-OFF IMPROVEMENT IN HYDE PARK AREF1� The City Manager said that the last orders were to continue work toward the slip-o£f, and wondered what the Council's desires were. Councilman Liebl said that it was voted unanimously on February 2, 1970 to go ahead with the negotiations for the land. He then read the motion aloud. Since that time there has been the second reading on the rezoning ordinance which failed because of the vote of two members o£ the Council. In previous action the previous City Attorney has stated that the improvement was not dependent upon the rezoning. Councilman Liebl said that he would recommend gmng ahead with the improvement. Mr Ken Strand, a resident of Hyde Park, asked if he meant to go ahead with the slip-off even though the rezoning did not go in. Mayor Kirkham said that is what Councilman Liebl said. Mr. Strand said that the rezoning included 2=, Street, but 2'� Street is completely blocked off from the slip- off. He said that he could not see why he should have to pay, living on 2'� Street. He felt that the property on 2� Street should be taken out of the assessment area. Councilman La.ebl said that 90a of the people were Por the rezoning and Mr. � Strand and Mrs. Marvin O'Berg were the only ones that were opposed to it. In 1965 when Mayor Kirkham ran for re-election he was against the urban renewal, and he said that he agreed wrth him. Here is a srtuation where a number of people got together with great determina�ion to get this area cleaned up and get some commercial development in. He said that he had received a verbal commitment from one of the Council members that they would vote in favor of the rezoning, but when it came down to the vote, he voted against it. He said that he would like to see this area get some tax revenue and get it cleaned up. Mr. Strand said that he brought in another petition from a number of people against the rezoning, so how could Councilman Liebl state that 90o were in favor of the rezoning Councilman Lieb1 said that the City Manager was instructed to conduct a survey to see if the people were still in favor of the rezoning, and the survey showed that they were. Mrs. O'Berg said that the people on 2'-z Street were not in favor of the rezoning and signed a petition against it. She felt that the people became confused on the issue She said that originally the people did not ask for commercial, they wanted to keep apartments out of there She said that she could not fix up her house with commercial zona.ng, nor sell it. She said that she would like someone other than Councilman La.ebl, who is pre�udiced, to tell her what the benefits to hes would be. Councilman Liebl said that i£ he could be called pre�udiced because he upheld 900 of the people's wishes, then he was pre7udiced. , Mr. Andrew Kohlan, Attorney engaged by Mr. E1don Schmedeke, said that he was asked to help these people with their problems. Both east and west of University Avenue the area is an eyesore and needs improvement He said that he had taken some poloroid shots this afternoon showing that the area is a mess It is basically in the same condition it was in 10 years ago. He said that he lives in the Ca.ty and is interested in what happens within the City. He felt that this rezoning stopped abruptly, and was a serious, and perhaps a legal mistake. There is not a piece of property that could be said �'°� ;: !� _ REGULAR COUNCIL MEETING OF APRIL 6, 1970 PAGE 10 faces University Avenue, and it cannot be made to face the other way. � Certainly the traffic pattern is a part of this. He said that this Council would be negligent if this were to be dropped. After a period of time the cost wi11 go even higher. He said that he understood that this was a plan worked out by the City Administration. He said that dropping this would be a disservice to the people immediately affected, and also to the entire City of Fridley. He asked that the Council not turn back, but continue to consider thas improvement. There wz11 be further action as far as the rezoning is concerned. Mayor Kirkham said that the slip-off is being considered, rather than the rezoning. He could not see the reason for a slip-off since the rezoning did not go through and the area is residential. He could see no point in saddling the people with further assessments for the pro�ect. � Mr. Kohlan asked how would the Council proceed further. He said that rt may be zoned residential on the map but all you have to do is look at the area to see the problems. He said that he was sure that you could not get good homes next to a high speed traffic lane, and University Avenue is a high speed road. No one with any sense would want to build a home along University Avenue. He said that he understood that the rezoning was not before the Council at this tune, but he suggested that this procedure would still be in the best a.nterest of the City and asked that this be looked at again. Mrs. 0'Berg said that there were a lot of people that have put in a lot of � time and expense into their homes. If there are buildinqs that are not up to par, they should be condemned. She said that her house has been unproved and is worth about $25,000 now. She said that she could not see why they should be required to chip in on the expenses of a driveway for Mr. Schmedeke, Councilman Liebl said that he Would recommend that the pro�ect be left in until the legal ramifications are concluded. Councilman Harris said that the Council authorized negotiations and the survey work, with the idea that nothing would be lost if the project did not go through. He felt that the City would have a hard time proving a benefit for the slip-off with the property as it is presently zoned, The approval of the State was on the basis of the land being used as other than residential. Mr. Kohlan said that perhaps this project could not proceed beyond a certain point at this time, but it should not be shelved. He said that he was going to institute action as far as the property owners are concerned. Councilman Liebl said that he would not vote to take the improvement pro�ect out until the action is resolved in the courts. Mr. Strand said that they were still obliged to pay the assessments on their property. This legal action, iP it comes to that, could carry on for years. The City Attorney said that there is a legal problem in that the improvements have been ordered in by resolution, therefore the assessments would be con- sidered pending. Mayor Kirkham asked the City Attorney if he would review all the proceedings to date and report back The City Attorney said that he ' would study all the background and have a report ready for the meeting in two weeks. RECEIVING NSP REPORT REGARDING 115 KV LINE The City Engineer reported that there has been another report received from NSP dated April 3, 1970, and passed out copies to the Council. He indicated that things seem to be proceeding nicely. As far as the inductive inter- ference problem is concerned� NSP plans on meeting with the railroad this week. Councilman Breider asked what affect, if any, would the line have on radio and television transmission. Mr. Larry Benson, NSP, said he did not believe there would be any, but he would check this out further. Councilman Breider wondered what would be done if it is discovered that there is interference after the line is in place. Councilman Harris said that he appreciated the � efforts of NSP to keep the Council informed on their current activities. He asked if they still think that they oan meet the August 15th deadline. ALL-STATE DISPOSAL SERVICE� INC.: NOTICE OF CfIANGES The City Managex pointed out that in the notice it states that leaves must be in containers and placed on the curb on pick-up day. He asked if this is acceptable, as the Code states that garbage cans must be at the back or on the side of the house with adequate screening. Councilman Ereider asked if the Code designates anything specific as to leaves and the City Manager said no. Councilman Harris said that he could see no problem as long as the leaves were in containers. MOTION by Councilman Harris to receive the communication with the notice from A11-State Disposal Sexvice, 2nc., dated March 17, 1970. Seconded by Council- man Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried. B. ED PHILLIPS AND SONS: OUTSTANDING JOB LIQUOR STORE MANAGER HAS DONE MOTION by Councilman Liebl to receive the communication from Ed Phillips and Sons Co. dated March 18, 1970, and commented that he would like to have the Council meet with the Liquor Store Manager concerning the of£-sale stores. Mayor Kirkham said that the Liquor Manager has been meeting with the Finance Director and the City Manager. Councilman Liebl said that he would prefer to have a meeting set up and get the information first hand THE MOTION was seconded by Councilman Harris. ROBERT HAYES: QUESTIONING ASSES5MENT AND REFUND OF R�C CHARGES MOTION by Councilman Liebl to receive the communication from Mr. Robert Hayes, 5751 7th Street N.E., dated March 25, 1970 Seconded by Councilman Breader. The City Manaqer read a memorandum from the Finance Director dated April 6, 1970 answerinq the complaint in full, and explaining how this assessment came about and that it was entirely legal. � Councilman Liebl asked then if the City had acted legally. The City Manager said yes, in some cases the notice does not get to the right person because of a change in ownersha.p, or a contract for deed. However, the State Statutes provide that a notice published in the legal newspaper cons�itutes a legal notice, and this was published. DISCUSSION OF STORM SEWER PROPOSAL FOR ONAWAY ADDITION AND EAST R71NCH �STATE$• Mr. Rtchard Harris asked if there was any progress with the storm sewer proposal with Spring Zake Park. Councilman Harris said that there was a meeting scheduled for April 13th. The City Manager added that the City Engineer and Mr. Comstock have met with them several times. Councilman Liebl said that it would behoove the Crty Attorney to look into this. Fridley has been trying to get this storm sewer participation by Spring Lake Park for about 2'� years. The water problems in this area make it largely unbuildable. Councilman Harris extended an invitation to Mr. Richard Harris to attend the meeting April 13th. The City Manager said that he would get the information on the meeting out to him.
