RESOLUTION NO. 183 -1971
RESOLUTION AUTHORIZING ACTING CITY MANAGER AND
MAYOR TO SIGN AN AGREEMENT BETWEEN THE BONDING
COMPANY AND CONTRACTOR: PROJECT NO. 93
WHEREAS, Noyes Construction Company,. .Incorporated, did
enter into a contract with the City of Fridley involving the construction
of Sanitary Sewer and Water Project No. 93;
WHEREAS, Noyes Construction Company,.the Contractor, did
default in performance of the obligation of such construction contract;
WHEREAS., the City has made formal demand on Home Owners
Insurance Company, the .surety for the contract to complete the project
pursuant to the obligation imposed upon it under the surety under-
taking;
WHEREAS, the City Attorney has submitted a proposed agree -
ment.between the Home Owners Insurance Company, the surety company for
the Project No. 93, and the City of Fridley in regard to completion
of Project No. 93.
NOW, THEREFORE,.BE_IT.. RESOLVED,...by the .City ..Council of the
City of Fridley that Acting City Manager and Mayor are hereby authorized
to sign the said agreement.
