RESOLUTION NO. 73 -1970
RESOLUTION AUTHORIZING ACQUISITION OF ADDITIONAL EASEMENTS AND RIGHT
OF WAYS FOR SEWER, SIDEWALK AND STREET IMPROVEMENT PROJECTS
WHEREAS, it is necessary to acquire easements and right of ways for construction
of Sewer, Sidewalk and Street Improvement Projects as listed below:
1) Street Improvement Project St, 1970 -1
A) A road easement for the northwest corner of Lot 9, Block 8, Donnay's
Lakeview Manor Addition.
B) A road easement for the southeast corner of Lot 8, Block 4, Adams
Street Addition,
C) A 10 foot temporary construction easement described as the easterly
10 feet of the westerly 15 feet of Lot 29, Block 1, Ostman's Third
Addition.
2) Street Improvement Project St. 1970 -2
A) A sidewalk easement along the west side of West Moore Lake Drive
from Highway #65 south end of West Moore Lake Drive to north end of
Donnay's Lakeview Manor Addition.
B) A 15 foot sidewalk easement along the southerly 15 feet of Outlet 1,
Donnay's Lakeview Manor Addition.
C) A sidewalk easement over the southeast corner of Lot 21, Block 1,
Donnay's Lakeview Manor Addition.
D) A 10 foot temporary construction easement described as the northerly
10 feet of the southerly 15 feet of Lot 15, Block 1, Donnay's
Lakeview Manor Addition.
WHEREAS, the City Council previously determined that the projects were feasible and
necessary and approved the plans and specifications.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley that:
The City Administration, assisted by the City Attorney, is authorized to
acquire the said easements and right of ways for the purposes of the im-
provements of public utilities and streets.
BE IT FURTHER RESOLVED, that if the Administration is not able to acquire said
easements and right of ways upon terms agreeable to the City Council, that the
City Attorney is hereby authorized to commence condemnation action in the Anoka
District Court for the above described easements.
