RES 1970-77 - 0000972090 RESOLUTION NO. 77 -1970 RESOLUTION ON HAZARDOUS BUILDING AND EXCAVATIONS WHEREAS, the Building Inspection Department of the City of Fridley has, by inspection and investigation, reported that a hazardous excavation exists within the City at the following address: 101 Ventura Avenue, that the legal description of the above property is as follows: Lot 1, Block 5, Carlson's Summit Manor North Addition, Anoka County, Minnesota. WHEREAS, said hazardous excavation has been left open for more than six months without proceeding with the erection of the building thereon, and the excavation and the basement is not filled to grade and not protected after a building construction thereon was destroyed and, WHEREAS, said hazardous building condition constitutes a hazard to the public safety, WHEREAS, the records of said inspections and investigations have been reviewed and considered, NOW, THEREFORE,THE CITY COUNCIL OF FRIDLEY MAKES THE FOLLOWING ORDER: 1. That the property described above is determined to be a hazardous building and excavation within the provisions of M.S.A. Section 463.15 to 463.26 inclusive, and specifically in violation of M.S.A. 463.25 prohibiting hazardous excavations. 2. That the inspection department report indicates that said condition involves immediate hazard and danger to citizens and children in the area who may fall into the excavation or basement. 3. The condition may be remedied by specific repairs as follows: if the excavation is filled or protected or a building erected forthwith, the condition would be remedied. 4. That the conditions must be remedied as provided in paragraph 3 above within thirty days from the service of a copy of this order upon the owner and lien holder of record. S. That the City Attorney is authorized and directed to proceed with the enforcement of this order as provided by statute.
