Councilman Harris asked about the Ordinance requirements for a garaqe. The City Engineer said that on substandard lots there is not a requirement to build a garage, the only requirement is £or a hard suxface driveway. H� pointed out that if this is granted, it will be the first persait without a garage this year. The Coux�cil studied the side yard varianCes, and agreed it would be a difficult lot to put a garage on. Councilman K�;lshaw mentioned the possibility of a carport, but Mr. Williams was not �.n favor of this. Councilman Harris asked haw many similar lots were left i.n the area and the City Engineer answered there were about a hali dozen �n this area. MOTION by Councilman Breider to approve the building plans and issue the buildinq permi�. Seconded by Councilman Liebl. Upon a voice vote, all votinq aye, Mayor Kirkham declared the motion carried unanimously. Robert Schroer, East Ranch Estates, Permit for Swimmin Pool SaleS : Mr• Rc�bert Schroer introduced Mr. Andie Haugen who is interested in leasing space from Mx�. Schroer for displaying his swimming pools. Sales would be conducted from a moveable building which would also be saleable as a dressing room or cabana type building. Mr. Schroer said they were nqt clear whether they would need a permit to sell swimming pools and also whether a permit was needed for the building. Mr. Schroer explained just where.the pool sales w�ould be located and said that the area would be lanclscaped. The Council studied the plan that was presented. Cauncilman Harris said that this would require a special use permit and he read the part of the Ordinance covering sale of inerchandise in the open rather than in a salesroom. The City Engineer explained that there is not a yearly license required, but will be a special use permit covering a certain time livait. The Council said that this would need a hearing before the Planning Com- mission, and the Commission would ordinarily set up a public hearing before the surroundinq property owners, but a� there are only a couple of surrounding property owners, perhaps if they were willing to waive the public hearing, it could qo to the Planning C�nission for their recqn- mendation at their meeting of May 6th, and come back to the Council at their meeting of May 10, 1971. There was a discussion regarding the building that will be used. The City Attorney said that he would really think this would be called merchandise rather than a building as it is saleable, and will not be there permanently. Councilman Liebl pointed out that each year Holiday puts up a temporary building outdoors which doea not require a permit. Councilman Harris asked if the building would be removed after the season is over. Mr. Schroer said that aqr�e�nent with the swimming pool company was for one year, with a one year option. Councilman Harris felt that the Planning Commission could set some mutually agreeable stipulations on how long the building could be on the premises. Councilman Harris asked Mr. Schroer if all items under his oriqinal permit have been completed, as normally the Council would not issue any further permits until all things have been taken caxe of. Mr. Schrcer said that 10 or 15 more parking spaces are the only thinqs not in. Councilman Harris suqgested he check with the City Engineer on this. The Council di,scussed tabling Item 16 on the Agenda, "Consideration of Reques� by Shelter Homes C�rp. to Locate Model Ho�e S�le� Genter on Target Property" to the next ��t�ng also to give the Planning G�ission a ctaa�ac� to look at the reque��. MOTION by Councilman Harris to table the special use permit for selling swin►ming pools and the special use permit for selling campers requested by Robert Schroer, and the requ�t by Shelter Homes Corp. to locate a model haae sales center on Tarqet property to the Council Meeting of May 10, 1971, so that the Planning Coannission can review the requests at their Meeting of May 6, 1971. They are to be notified to be at tkie Planning Commission Meeting of May 6, 1971. MR. DON NEUMFIN, 615 IRONTON STREET N.E., AND MR. STEVE GRAVES, 620 IRI�NTON STREET N.E., COMPLAING ON D('lGS RUNNING LOOSE: Mr. Neuman, 615 Ironton Street N.E., said that they have a probletn in their neighborhood with dogs running loose and they do not feel they are getting any satisfaction from th� Dog Patrol or the Police Department. He said that most of the dogs are larqe and they are worried about the children, so soanething must be done about it. ii� said that their area has a larqe open field and the river which seems to attract the dogs. Councilman Harris said that the Council has just had a meeting with the B& E Patrol President and they are talking about more than doublinq the amount of service. Mr. Robert Schroer said that he lived south of Mr. Neuman and he agreed there Yfeve been a lot of dog packs around. Just last week a child had been bitten by a dog. He said the Police Department had canvassed t.`�e whole area door to door and had done a fine job in findinq the dog. , Mr. Steve Gxaves, 52� Ironton Street N.E., asked if the awners were not required to keep their dogs leashed. Counciliaan Harris said that the Ordi- nance xequires dogs to be licensed and leashed or under voice c�aand at all times. He said that B& E Patrol is picking up about 50 dogs each � month. Mr. Graves said that B& E has told him he could go alonq with them any day he wanted to, but that was hard when you are workinq. � REGULAR COtJDiCI� MEETING OF MAY 3, 1971 PAGE 4 � Mx. Graves said they had another prablem in the neighborhood and this was a lot o�` cars driving fast in the area, some without mufflers. Mayox Kirkham said he felt that this was a problem all over and not just in this area. He sald that all the patrolling is being done that is possible, but you have to admit, that the Police cannot always be there on the spot. Mr. Graves+ also saia that there is a problem with children leaving books and things on the zoads foraing drivers into the other lane, also children are sitting riqht in the street. Councilman Harris sa�d that this was a parental responsibility, and he thouqht the parents of these children would like to knpw this is goinq on. Mr. R.�chard Harris said that Dr. Dudley of the Veterinarian Clinic had a good idea. He had suggested that every dog licensed in Fridley be tattooed. The number coul,d not be removed and could correspond with the registration number fox easy identification of the owner. He said that out of 450 doqs picked up in Fridley the previous year only about 30 doqs were reclaimed. He felt our present ordinance cannot be enforced, and the Council should take another look at it. Mr. Caxl Paulson said he understood there was a new ordinanc.e and he asked if there is not a provision for the City to hire an individual to do some work on the situation. He said no�r that the coet of a license was $5 there should be some money to hire this person. Mayor Kirkham said that the Council was doing some work on revisinq the situation. They are reviewing the contract with the Dog Patrol Service to get better results. Mr. Paulson suggested maybe a letter could be sent to the people informing them of the requirements. Mayor ICirkham said that this had been part of the discussion with the Dog Patrol President. • MRS. MECH, 1315 66TH AVENUE N.E., PARK RESERVE BO�iRD BII.L: Mrs. Mech said she would like to discuss the Park Reserve Board Bill. The Oouncil has previously passed a resolution regarding this bill, and re- affirmation of their previous action is on the Agenda as Item No. 26. Mrs. Mech said she believed they had received a letter on this subject frora Mr. A1 Kordiak, County Comnaiasioner. Mrs. Mech reminded the Council that she and Mr. Jeroane Hegstrom, Metropolitan Council, had appeared before them several montha ago, and at that time they had pramnised to go alonq with the Rice Creek Nature Trail. She told of the labbying she has been doing beiore the Leqislature on the bill. Councilman Liebl asked how much money it will cost and how much would the City get in return. Mrs. Mecla said that we have been promised the Natuxe Center which is going to cost $200,000. Councilman Breider asked if this bill gave the Board the power of eminent danain. Mrs. Mech aaid yes, except for homesteads. Councilman Breider said that this was his objection to the bill. He thouqht th� Nature Trail was a good idea, but he did not want saneone else cominq in with emi.nent danain. Mrs. Mech said that the Board will not come in where they are not wanted. Councilman Liebl asked if the money will be rai�ed frcro sales tax or pro- perty taxes. Mrs. Mech said that 2 mills can be levied, bu t the property tax would be a backup for the excise tax. Mayor Kirkham said his abjection to the bill was that it provides for an already appointed body �to be the Park Bosrd and it given them power of entinent dar►ain, and taxing power. ORDINANCE #479 -� AN �RDINANCE B�NDING AND RECODIFYING CHAPTER 46 OF THE FRIDLEX CITX CODE, KNOWN AS THE BUILDING ORDINANCE: Counc�.lman Liebl asked Dick Harris if he was aware of the minor chanqes n►ade in the o�dinance by the City Council. Mr. Dick Harris said that while he was on the Planning Commission he had missed one of the meetings at which this had been discussed, but frosa what he remembered some of the provisions in the building ordinance are good, but s�ne are very unnecessary, such as having a�tair hatch to the roof in a very small buildinq. Councilman Liebl eaid that bas�.cally it will be adopting the 1970 Building Code. He thought it would m�alce our requirements a little tougher and upgrade our coaimercial and industrial buildings. Mayor Kirkham said the Council would be interested in any constructive criticism Mr. Harris may have to offer, and the Ordinarice can be amended �t any tis�e there are improvements to be made in it. He suggested Dick get a copy of it and look it over. MOTION by Counc�lman Harris, with the thought in mind that changes can be made to the Code if justifications are shown, to adopt Ordinance N479 upon second reading, waiving the reading, and publish. Seconded by Councilman sreidex. Upon a roll call vote, Harris, BreiBer, Kelshaw, Liebl and Kirkham voting aye, the motion carried unanimously. PROGRESS REPORT FROM NSP: Mr. Warren Johnson from NSP brought the Council up to date on the progress of the relocation of the transmission line. He stated that one section of the line has been built fraa I. 694 and Main Street north to 61 Way. They ran into a conflict with the railroad facility at 61st Way where the line will cross over the railro�d property, and they are working with Burlington Northern on this• They have �d five meetings together since he last reported to the Council March 5, 1971. He said they are close to resolving the in- duction probl,em, but t-hey cannot commni�t them�elves to a date that an agree- ment will be reached. This will have to be completely resolved before energizing the line. Mr. Johnson wae thanked by the Council for his report. WILLIAM'S CHU�CH FOR TRUNK HIGHWAY #47 SERVICE_ ROAA DETACHI�TENT NOR�'H OF 61ST: The City Engineer gave the Council a copy cjf a letter received fram St. William's Church dated I�a.y 3, 1971. He sai.d th�t �t is in_regard to the proposal worked out with the Church commi-t�ee with several minor chan.ges. He read Item #7 which asked that the City pay the sum of $275 to the Church for expenditures incurred. in the appraisa� of the property_pnder discussion, and Item #10 which asked that the City pay all legal fees and other costs for transfer of said property to City. Councilman Harris asked the City Attorney if there would be any problems with Item �k10 and the City Attorney said no. MOTION by Councila►an Harris to change the figure in Item #6 which the City is to pay the Church for professional traffic flow survey to be made of Church parking lot fram $600 to $875, and approv� the agreement with these changes. Seconded by Coux�cilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkhaaa declared the motion carried unanimously, DISCUSSION REGARDING ACQUISITION OF PROPERTY FROM SHELL OIL COMPANY FOR TRUNK HIGHWAY #47 SERVICE RAAD DETACHMENT NORTH OF 61ST: The City Engineer pointed out that in their,letter, Shell Oil Company suggeata workinq out an agreement to reaolve.the deed, and the City can proceed on that basis. Th� City has agreed to pay $23,�50.00, and i.f they aomply with the conditians the City can pay the money. MOTION by Councilman Fiarria to reaffirm our proceedings on the acqui$ition of property from Shell Oil Canpany. Seconded by Councilman Liebl. REQUEST TO $UILD GARAGE IN COMMERCIAL AREA� BY RICHARD BISTODEAU: The City Engineer explaine3 that Mr. Bistoci,eau �rned a 60 foot wide lot with a single family dwelling and he wished ta gut up a garage. Our ox+dinance requirss that non-conforming use cannot be expanded �n, and hi� lot is in a com�aercial axea. The Council looked at the plan showing where Mr. Bistodeau wished to plac� the garage. The garage wi�l be way at the back of his lot and the driveway will come out on Main Street. Mr. Bistodeau explained that he would like to build a garage to house lais camper truck and boat and trailer so people will not be aware when he is away. He poirated ou� �C�t if Mr. Bistodeau wanted to se11 for caamezcial purposes he ran the risk oi possibly not getting the money back that he has spent on the garage. Mr. Bistodesu said that he realized this, but he planned on living there and needed this garageo MOTION by Councilman Harris to authorize the building permit for a garaqe with the stipulation that the owner understands this is a non-conforming use. RECEIVING PRELIMINARY'PLADIS ADTD COST ESTIMATES - ADDITION TO CITY GARAGE: The Acting City Manager introduced Mr. Patch, the architect, to the Council. Mr. Brunsell said that Mr. Patch has taken the requests submitted by the Parks and Recreation Department and the Public Works Department and has drawn up three proposals for adding onto the City garage in different ways. The size of the addition has been cut fram the original request. The Acting City Manager showed the Council the three plans and explained what would be included. Counci Laan Liebl asked if it would be the same type of construction as previously, and what the cost would be. Mr. Patch said that it would match the construction of the existing building and that the preliminary cost estimate was $16 per square foot. Councilman Liebl asked if the buildinq would be cotnplete at $16 per foot. Mr. Patch said yes. Mr. Dick Harr�s asked if thie price w�ould include land�capinq, blacktopp�nq and all the other requiraments the Council asks of other builders, or would they be running hose from fire hydrants as they df.d before. He said that the City paid $14 a square foot for the original buildinq and had not qotten all the floor poured. Mr. Harris felt that tha new addition ahould be cheaper than 516. The Council reminded him that these were just preliminary cost estiiaates, and that the City does everything by bids, and it will be awarded to the lowest responsi.ble bidder. � ' Councilman Kelshaw aaked if these plans would go before the Buildinq Standaxds - Desiqn Control Coaimittee. Mayor Kirkham said that the original buildinq plsns had gone to the Board, but this would be just matchinq the oriqinal. � � ' � The Actinq City Manaqer said that the 1971 budqet provides for the pre- liminary plans. They have brouqht it before the Council to get approval of the concept so that final plans can be drawn and bids let this year, if the Council desires, so that it can be built in 1972. CONSTDERATION OF AN ORDINANCE AMENDING AND RECODIFYING SECTION 45.053 RELATING TO SIDEYARD REQUIREMENTS IN THE R-1 DISTRICT: The purpose o�' t,his ordinance was to set $xdeyard requirements in an R-1 distxict t.o allow for fut�ire double garages� Tha City Engineei handed out copies of the sketches studied by the Planning Commission. He read Section 1 of the ordinance which was the only change made in the ordinance. The Council discuased what the minimum side yard requirements should be, and how the section should be worded so that a double car attached qaxage could be built without a side �►ard vaxiance. The City Engineer said that it would work if a minimum of 11 feet is set on the garage side yard and 10 feet on the house sideyard of a 7� fopt frontage lot with a 40 foot wide house. If the house is narrower, the qarage side yard require�aents would be increased accordinqly up to 15 feet. The Council aqreed with this. MOTION by Councilman Kelahaw to request the Administration to prepare the ordinance with sideyard mini.mums as discussed by the Council this evening and bri.ng it back to the Council for first reading. University Avenue to the City limits. � Counci]man Breider asked if the City still had plans for a signal liqht at Riverw�od School on East River Rnad. The City Engineer said that the County has ordered this signal. The City Engineer said that the City has had plans for this area since 1961, but because of the new developments in � the area, the information and data was given to the Planning Commission to look at aqain. � � � Councilmar� Breider asked if there was same way to direct the traffic to�ward Univexsity at the 79th Avenue crossing when it is opened. He wondered if a crossing at 79th Avenue would decrease or increase the traffic on East River Road. Th� City Engineer said that t�affic is going to increase on all roads through norm�al p�ogress. He felt that the traffic will travel the better iacility in this area, which is University event�e. East River Road will not be as convenient because of the signals. If all the proposed signals are added there will be 8 signals on East River Road from I 694 to the north border of �Y►e City. Aick Harris asked about the recammendation to do with a temporary ally between Elm and Beech Street. CounciLnan Liebl read Motion 4 to hini recommending that 78th Avenue fro�s Beech Street to Main Street not be vacated and reaawmendinq a temporary surface from Beech to Elm Stree�. Mr• Harxis �aid that originally he had been opposed to it, but_now he is not objectinq as hard as before, although he felt the City would be putting sane pretty tough assessments on the property south of 78th Street and it is not usable for anything. He thought if a reque�st is made for a small building between the czeek and 78th, the City maybe could waive some of the require- ments for parkinq or so�nething to make it easier on them. Councilman Harris said that whatever develops in that area does not preclude the City from doing sanething. He said it is certainly within the realm of possibility there could be a closed culvert. UPON A VOICE VOTE, Councilman Breider votinq nay, the motion carried. Councilman Breider said that he would like to vote nay on the first motion, but would concur with the rest of the motions. Councilman Harris asked if there will be all blacktop parking. The City Engineer said yes. He said that Mr. Bonnett is doubling the size of his building. He said he believed Mr. Bonnett was interested in getting an address on Osborne Road, but he thought this could still be done with ingress and egress on Baker Street. The Council discussed requiring all cars that he is working on be parked south of the existing area rather than in the �;parking lot. CODTSTDERATION OF PURCHASE QF PROPERTY AT 5981 3RD STREET: (LAPIDES ESTATE) The City Attorney said that technically these lots were still R-2, because when the Council rezoned thie area, these lots were oa►itted, hawever, if thi� went to court they w�ould argue that the reat of the area was re�oned and the City did it eo as not to have to pay the co�ercial price. Counci3.uian Harrie asked what the oriqinal price had been. The City �ttorney said 'he balieved he had asked �or $17,000. Councilman Liebl thought that $15,000 was a fair price considering what other lots have sold for in this aren. The City Attorney said that the City vrould get right of entry once the papers were filed so condemnation would not hold anything up. Mr. Eldon Schmedeke said he thought the house will be in the way and something should be done as soon as possible. REPORT ON STATUS OF CI3'Y'S REQUEST FOR ACCESS PERMIT, T.H. �47 SLIP OFF AT 60TH AVENUE: " The City Engineer said that the City had received a copy of an interoffice memo in regard to the City's application to the State Highway Department last year for a slip off at 60th Avenue. We still have not receive per- mission, but this is to qet permission going. The City Engineer said that if Mr. Schmedeke could give the City a letter about his plans and what he has on his property, and if he talked to the other businesses in the area to get lettera in to be sent on to tdze State, we may be able to convince them that there are enough cott�aitments to open up the slip off. He explained that it was not the local office but the Federal Bureau of Public Roads that has control on it. Mr. Schmedeke brought forth a letter he had written to the City Council that could be forwarded on to the Minnesota Highway Department. It cannot be left as it is at present because previously only the north side had been dedicated, but naw the south side is being acquired also, so the road will be put in the middle of the right of way. 77th Avenue cannot be cicsed at this ti.me because there is no street at 79th Avenue so that crossing cannot be opened to replace 77th Avenue. The City Engineer said that a street c�ld be put in at 79th Avenue this year if the Council wished as the utilities are in all the way. He said they were trying to impress upon the legislatora that Fr�dley is having problems with some of the things they are �acing in the legislature. He said that this is one tax bi11� but there ax'e alreaciy so many tax bills before the legi.slature right naw, that � perhaps the Council should not go in favor af one tax bill, but just point out that they are concerned about the taxes and other sources af revenue. The Acting City Manager said that if there is a taa� f�eeze, we wri11 have � to have samething else. Councilman Harris felt the Council should stand up for one that is good for Fridley, and he €elt this one looked like the best one. Councilman Breider said that the school taxes are 70$ of the � total, and he thought it would be presumptious on his part if he only wanted to deal with the 10$ rather than the larger portion. Councilman Harris said that the school people are working on proposals that will help the school tax burden, and he did not think the Council should assume what � the school might think is best for them. There was a discussion on whether business and industry would pay as much of the tax burden as they are presently. The Acting City Manaqer said that the proposed tax bill would allaw a lower tax levy. The City would receive a].most as many dollars as with the property tax. Mr. Brunsell said that the Council will have a'tax increase or a mill rate increase this next year if they ar� going to meet the Guidelines Act. If there is a tax freeze the City would really be in a bind. This could mean a quarter million dollaxs out of some other operation of the City's budget eventually. Councilman Harris said that if they did not spend any of the fund, they would not have to meet the Guidelines Act. The City Attorney said he felt that this was the action that had to be taken. The Acting City Manaqer said that the money budgeted in 1972 would have to be under the Guidelines Act, Councilman Liebl asked if this would mean that under the Guidelines Act, the County Auditor could fo�cce the Council to levy that amount. The Attorney said that this was corxect. Councilman Liebl said he thought it had been worked out at 21� for the City and 7$ for the Officers. Mayor Kirkham said that several of the men have said they thought they could go along with this as a teanporary tYiing until the 1973 session of the Legislature. Councilman Harris asked how difficult it would be to prepare a bill for this session. The Attorney said that it was too late naw. If the Association did not change their By-Laws, the City could start action in District Court to intexpret the City's responsibilities. Councilman Breider said he felt 21$ was more than generous. Mayor Kirkham said that the City has made their offer, the only thing to do now is wait for the Police Pension Fund Association to reply. Councilman Liebl s�id that in the past the Council has made people spend a considerable amount� of money on commercial areas to comply with the Code and this has been an�orced. He felt that it wauld be well to continue on this ba$is, or t,hey wc�uld be accused of favoritism. This $8,000 to $17,000 cost does not include the land and it dces not include the ca�apletion of the home. The finishing work could be left tp t.he hqa�e owner or sub-contracted out. They have land available in E1k Ra,ver fox sites that are 2 to 5 acres in size. The reason for qoing farther out in the suburbs is that the land costs are cheaper. Target fesls that this proposal will brinq in custessers to them. This is only fox a six month trial basis and if Tarqet does not find them a suitable tenant they would not renew the lease, or if they find that the locatipn �s nQt suitable for them they �tould not renew the lease. Cauncilman Harris asked if they are providing financinq. Mr. O'Brien said yes, at 7��. This would b� interim financinq. Councilman Harris asked if this could ccane under F.H.A. 235 program. Mr. O'Brien said yes, and also under the Farin Hoane Administration. The interim financinq could be for fraa 2 to 12 y�ars. He added that the two to five acre lots in Elk Ri.ver could be �urehased for about $5,000. � Councilmar► Breider said ti�at it appeared that it would be up to the individual ta do the other work after roughing in. Mr. O'Brien said that they put t�p the exterior and the fram�, and they provide a list of sub- contr,actozs for the home awner. They do fin�nce the materials but not the labor for the sub-contractors. They offer their homes at zero dawn. They feel that it is better for the home o�wner to use his liquid assets on the la�bor and the finishing of the home. Councilman Kelshaw asked what would happen with the house if, in six months time, the lease is not renewed. Mr. O�Brfen said that they have arran� �o have the house maved to the nozth within a ten mile radius. Counailm�n Harris asked if there was any particular reason why this would have to be acted upon at this meeting. Mr. O'Brien said that of course, they wQUld like to c�naence as soon as possible. Ordinance No. 443 was adopted on December 15, 1969 but tite publication was to be held up until certain agreements were signed. Theae agreements referred to the Southern most part of the property whi�h was to be deeded to the City escept 160 feet which could be used as density. Darrel Clark said he understood the probate court would be able to release the portion to the City prior to settling of the entire eatate. He did not believe the petitioner was the fee awner yet. In discussing the rough drawing of the tawnhouse development plaaned for this area, the first impression was the area was full of buildings and parking lots. , Chairman Erickeon said the townhouse section of the ordinance is a new one. It was not studied by the Planning Co�iasion, but was added after the Co�is- sion finished their study. The ordinance permits townhouses in Fridley. Mr. Hoffineyer eaplained what information he had ready and said he had ' ordered a topog of the area but hadn't seen it qet. The lots are fairly flat and slope dcwn to the river. The development will be 56 townhouse units, nine of which will be aloag Anna Avenue, the balance will be in blocks of nine and five. There will be a swimming pool in the middle and green area throughout. , There will be a two car tuck under garage in the basement, and the laundry snd workroom will also be there. There will be a split entry, living room, deck loolcing over the back towards the river and dining area. The second floor will � have a half bath and two bedroo�s. The units will be ataggered to get as much light and shadow as possible. Materials will be brick with wood infill. Under the present program, they will be rental with the possibility of conversion ' and then they would convert to a cnndominiwa. They meet the requirements of the land coverage, in fact, they were a few units under. Darrel Clark volunteered that there is sewer and water in Anaa Street, but ' if it will be deep e�pygh for the apartmenta next to the river, they would not lcnow until Mr. Hoffineqer presented his topog. Target property. Mr. Steve 0'Brien explained that Shelter Homes Corporation is a subsidiary of Shelter Corporation of America, Inc. With him this evening was William Silver of the firm of Gingold, Pink Architecture and Gerald Bond of Shelter Homes. He said that several of the men working with Shelter Homes were for- merly with Pemtom, and they have brought fresh and unusual ideas for this type of home. , The hotue is to be constructed on Target property. The area of the home is 1,230 square feet, and it is a three bedroom L shaped rambler. It would be put on a post and beam foundation, and is a temporary structure. All rooms and the second half bath would be finished except the master bedroom. The reason for the unfinished room is to identify the various walls, the various steps of construction that the house could be left in. There is a triple garage. The house might be considered as an office if you can call taking dawn cash payments office procedure, but the final closing would be at the main office at 78th Street and Cedar Avenue. The location at Target would be easy to find because of the highways. They could not estimate the volume of people their display would attract, but they could live with a figure of 3A0 a week. Mr. Henrikson stated that the Church owns this lot and are in the process of obtaining the two adjoining lots. There is an old foundation on the lot where the Church will be built and this will be removed. ' The building will be face brick part way up and cedar siding the rest of the way with shutters on the windows. The roof will be asphalt shingles. The doors will be metal with same sort of design in them. There will be , two entrances to the building. The main entrance will have 4� stairways and the back entrance will have 3` stairways. The Board questioned whether these stairways were wide enough. They ' stated that for functions such as funerals, these stairways may aot be adequate. ' Mr. Henrikson stated that this was a good point. He said that perhaps they could move the outside wall out a little ways. He said they would also like to move the back stairway outside with a covering over it because the � stairway was interferring with the place.ment of the pulpit. Mr. Henrikson stated that they had agreed to put in storm sewer and that this had been discussed with the Engineering Department. He also said that they would verify the location of the storm sewer on the site with the Engineering Department. It was stated that the structure will be a two-part building. One half will be 192' x 101' and 40' high. The second half will be 34' x 131' and 60' high. There will also be a steel sludge storage tank 84' in diameter and 40' high. The building will be poured re-enforced concrete below grade. There will be face brick around the entire building part way up with metal panels the rest of the way. Face brick will also be used on columns running up the building which will project out from the building about 12". Otherwise the sign would get tangled up with the highline wires. He continu�d the present sign is on the public sidewalk and is also to close to the property lines so it has to come down. The present sign is 7 feet by 10 feet and the proposed sign is 6 feet by 10 feet. The actual square £ootage is only 53 square feet as th is is an oval sign and this is below what the code requires. Aapka about a sewer backup in his home at 281 - 57th Place N.E., Fridley, Minnesota. A call was made to our Police Department in the evening on April 2�, 1971 (about 7:00 P.M.), requesting the use of the City sewer tape. The caller was given the phone number of Mr. Silseth, City Sewer Man, and he made the same request to use a sewer tape. He told our Sewer Man that the plugup was in his home laundry line. He w�as given the uae of our sewer tape. On Thursday, April 22, 1971, at about 10:00 A.M. a call was made to City Hall informing us that they were still havin.g trouble and that they t�ad called in a man with a roto rooter machine. He stated that the plugup was probably in the City sewer line. A Sewer Crew was immediately dispatched to the home to check, and the;y did find a plugup in the main aewer line. The City Crew brought our r�odding machine and opened our line in about one-half hour. Then, th�e base- ment drained. 1 I believe if the party had allowed us to check on� the first day of trouble, we could have prevented any further problems. We install additional speed limit sign on the South side of Jackson Street. 2. Crosswalk lines and pedestrian warning signs be installed on Jackson Street on both sides of the intersection with 75th Avenue. 3. Police patrol the area more frequently and m�aybe do some saturation enforcement action over a certain. period. 4. Citizens in the area report to the police wh.en they see people speeding on the street. Installation of "Stop" signs on 75th and Jacksc�n is not recommended at this time because speed control is nc►t the proper function of "Stop" signs and there are studies showi.ng that unwarranted "Stop" signs can cause additional traffi.c hazards due to people getting irritated and also, there is �i problem of noise when these people speed away from the signs. We are working with the Highway Department for installation of traffic signals at 73rd Ave. and T.H. #65 which would also help the situation. If the State Auditor does not use the new 1970 figures, the City of Fridley could lose $43,018. In making up the budget for the year 1971, the City of Fridley, as well as most of the other municipalities, used the new 1970 census in computing the amount of money it would receive from these taxes. In that the 1910 census data was certified by the Governor after the first-half distributions of 1971 State Aid funds for liquor and cigarette taxes were made, the State Auditor made these distributions on 1960 or 1965 census data. To ensure that the second-half 1971 distribution of State Aid funds pro- vides for the necessary adjustment of the first-half distribu- tion, it is the opinion of State Auditor Rolland Hatfield that House File 1272 must be approved. It is understood that this bill has been passed by the House and for the last few weeks has been before the Senate Corronittee on Taxes. At a hearing before this Comnittee last week it is understood that Senator Dean Nyquist, who is the chief author of the Senate companion file, did not appear on behalf of the bill and that the chances for its passage now seem remote. If such a bill is not approved, the Vi�lage of New Hope will lose $19,532 from funds for liquor and cigarette taxes. Also, State Auditor Hatfield has said that it is a strong passibility that the first-half distribution of general sales tax State Aid will not be made on the 1970 census data. This could mean an additional loss of over $42,000 to New Hope. In that New Hope has increased in population from 11,620 in 1965 to 23,180 in 1970, or a total increase of 11,560, I would assume that the potential loss to the City of Fridley would also be very significant due to the increa�se in population which your comnunity has experienced since the last census. ' In the last several weeks, it,was learned that the first-half distrtbutions of 1971 State Aid funds tor liquor and ciga�ette taxes had been made or 1960 and 1965 census data. Thfs distrtbu- tion means a loss of funds to the Vtllaqe o� Nw �b� ef i19,532. On further investigation of this matter, it was found that the first-half distribution of general sales tax State Aid which is to be made on June 15th each year may well be based on the 1960 and 1965 census data. (State Auditor Rolland Hatfteid has said that there is a strong possibility that this will happen.) It this Is the case, the total loss in revenue to the Village of New Hope would be over �62,000 on the first-halt dtst�ibutio� for State Aid for general sales, liquor and clgarette taxes. It is thought that additional revenue losses in the am�unt of over $40,000 would result if State Aid funds for fire insurance premium tax and highway use� taxes were based on 1960 anC 1965 census data as these sources are in part based on population. (NOTE: For each source, 50 percent of tunds are based on popu- lation). If the loss to the Vitlage of New Hope is only fpr the first- haif di5tribution of funds for general sates, liquor and cigarette texes or in the amount of $62,000 this would seriously affect the vtability of the i97! Ope�ating Budget as it would represent almost 6 percent of the total 1971 Operating Budget. (NOTE: Total Operating Budget is E1,094,951.) Thi"s loss in funds would equal almost 3 I/2 milis in property tax of ove� 10 �p�t of sll revenue�from property taxes. The Village of New Hope could not, of course, increase the property tax for this year. Tfie only alte�native aould be�to seriously cut back on the levels of municT• pal services provided to our citizens. The Village departments that would most likely be affected would be the Police Depertment and the Park and Recreation Department each of which have an annual budqet of approximately $250,000. It, for examp{e, the cut back would be applied to the Police Department almost one-third of the police personnel would have to be dismissed. If the cut bt�ck is aRP�1ed to the Park and Recreation Depa�tment the municipal swimming pool could not be operated in 1971 and most summer pro- c�rams would be seriously affected. 61 O� - 3 - In b�ief, the loss of these State Aid funds would be cdta�fi rophic for the Viliage of New Hope and many cortimunities and sehool districts In the State of Minnesota. Such governmental bodies will be penalized fo� planning their 1971 Operating 8udgets based on the opinion of the Attorney Gene�al. The only �emedy to this dilemma is to enact legislation.that will authorize the State Auditor's Office to adJust the second-half 1971 dlstribu- tion of State Aid�funds to compensate for the fact that the first- half distribution was based on 1960 and 1965 census data. New Mutual Aid Contracts were entered into with the other 13 communiti�s. The new contract differs from the old contract in that there is no charge for assistance. An Emergency Care Seminar was held at North Memorial Hospital April l, 2, � 3rd. Those in attenance were; �im Bates, Gary Larson, Don Sachs, Arthur Silseth, Howard Simonson and Durl Smith. The Minnesota State Fire School was held April 26th through the 29th. Five men from the department attended the school: Dennis Ottem Fire Inspector Training Charles McKusick � Howard Simonson Fire Inspector Training Ron Schoneman Larry Peka Fi re Inspector Training C'' �� r Ralph Messer Robert Aldrich taught a course on Fire Inspector Procedures. I served as an Evaluator of the Basic Firemanship courses. Rescue Training Tactical Procedures Elements in Firefighting Fire Prevention Chief Robert Aldrich, Assistant Chief, LeRoy Blomster, and myself, apent a day at the Seagraves factory in Clintonville., Wisconsin, checkdng out the construction of the Seagraves Aerials.
