MCGREGOR, GENERALLY LOCATED SOUTH OF 69TH AVENUE, 1000 FEET WEST OF TtiE CITY LIMITS: (R-1 TO R-2) Mayor Liebl read the public hearing notice aloud, and announced that the public hearing is opened for any comments. The City Engineer showed the area on the overhead projector, and said the location is just west of the Roger Larson townhouse project. This plan would fit the overall concept the c;ity is aiming at in acquiring park land on Rice Creek. He said if the Council grants the rezoning request, he would like to suggest that there be some stipulations, such as the deed for the park property at the south end by the creek. He said the developer has some rough sketches ar►d a layout, and showed them to the Council and said the Planning Commission recommended approval of Lhe rezo�ing. Councilman Breider asked just where the 890 contour line is. The City Bngineer said that the creek meanders through here, but the 890 line is 60' - 80' noxth of the creek. The banks are very steep, so the flat area is proposed to be developed with the steep bank maintained as natural terrain. There is no flat area in that 890 contour line. He then showed the Council a contour map of the area. Councilman Utter asked if the road easement spoken of in the Commission Minutes is on the east or west side of this parcel. The City Engineer said it would be on the east side. The City has an easement from the Larson px�o- perty, so this road would serve both complexes and the park property to the u .. �;i'l:Clal. Mayor Liebl asked ,tilr. bfcGregor what he a,iticipated his construction costs wauld be for one i;nit. A9r. McGregor said aro:�nd �35,000 including the land, or about 4�32,000 -�33,000 without the land. 1�layor Liebl said he could not r�call what the price x�ange was for the Larson coiiiplex, and asked what it was. The City Engineer said the figures given at the Council meeting were low, but it is still less of an investment than h1r. McGregor is anticipating. Mr. McGregor agreed, and said that they intenc! to build single family dwellings to sell, the plan to the east of them is to rent the units. They hope to sell all 43 units, but if they cannot, they have thought of renting with option to buy. This is a flat piece of ground ancl they plan on excavating two ponds and creatirig a �r�ore aesthetically appealing complex. They had planned on draining into the creek, but there is a storm sewer to the east already, so they coulci drain the overflow into the storrn sewer. The ponds woulc! be main- tained with the drainage of the flat land, and would be their responsibility to maintain. They had thought of putting in a well, or pumping water from Rice Creek and then recirculating it back down. 'The overall idea is to create a little different setting. During the winter the gates would be closed off, and they plan on putting in a warmir,g house and using the ponds as a skating area for the chilciren. In that way it would be £unctional as well as serving as a holding po�id and adding aesthetic value. hlayor Liebl said this is a little different concept than we have seen in Fxidley before. He explairied to Mr. McGregor that his plans would have to be presented to the Buildin� Standards - Design Control for their recommendation before coming to the Council. The proper criteria must be laid out and the agreement would absolve Fridley from any responsibility ancl it would be the owners duty to maintain the area. h1r. McGregor dgreed and added that the poncls would have to be engineered so there would be no problem, and the gates should be able ta be opened up for cleaning. He said ttiey would probably be lined with asphaltp ; Mr. McGregor explained that under the zoning ordinance they would be allowed 4t3 units, but there is not room physically to put that many on the parcel. Councilman 13reider asked, when a unit is sold, how will the upkeep of the pro- perty other tha�i that which goes with the deed, be arranged? Mr. McGregor said there woulcl be a condominiwn association for the upkeep of all the com- munity property outside the home owiiers bouridaries, and would be maintained by the townhouse association. The City Attorney said he believed the by-laws would he available prior to ordinance approval. Mr. McGregor said yes, the by-laws must be approved by Council. Councilman helshaw asked if all the surrounding property owners were notified, aiid if there was anyone who wished to speak on this project. The City Engineex said they were notified. � � � ! _� � ' , , , � SPECIAL PUBLIC HEARING MEETING OF MAKCII 13, 1972 PAGE 3 ` Mr. Leslie Tikkanen, 1400 69th Avenue N.E., said he thought this property was'- sold before for apartments. The City �ngineer explained that at one time this property was considered for apartments, the hearing was held and the first reading of the ordinance was given. The proposal was not completed, so the plan is inactive. Mr. Tikkanen asked if the setback would be the same as the rest of the houses on the street. The City Engineer said it would be the same as for residential property, at least 35 feet. Mr. Floyd F. Foslien, 3345 University Avenue S.E., said he had propexty to the west of this project. He said he is familiar with the work of their archi- tect. What he has seen has been very nicely done, and he would be in favor of rhe project. MOTION by Councilman Mittelstadt to close the Public Hearing on the rezoning request by Robert McGregor, ZOA #72-02. Seconded by Councilman Kelshaw. Upon a voice vote, all ayes, Mayor Liebl declared the motion carried unanimously and the hearing closed at 8:00 P.M. Mayor Liebl informed the applicant the Council cvill take action on his request at the Meeting of March 20th, when they will consider the first reading of the ordinance. He added that before the second reading all the plans have to be presented'to the subcommittee. RECEIVING REPORT ON LIQUOR STORAGE COSTS: , The City Manager summarized his report dated March 10, 1972 regarding the re- modeling of the former Police Department area beneath the Fridley Fire Depart- ment offices, which could be used for liquor storage. At the present time the ' storage area is reduced because of the sale of Shorewood. The $2,100 for re- modeling would allow the City to move from the Shorewood basement and save $1500 in rental per year. The cost of storage and transportation of liquor stocks at present is about $9,867 per year, including clerk's wages, deliveries and vehicle ' costs. If the lease is terminated for the storage area in the basement of Shorewood, this would reduce the available area by 750 square feet. Nonsales areas in Shorewood Liquor Store are large because it is not a self service ' store as the other liquor stores are. Returned beer cases account for much of the use of the nonsales area and with wine sales becoming a bigger portion of the liquor business, storage space in the stores is critical. The remodeling ' , would utilize an area that is, as of now, no use to the City. Shipments coming into the City could be received at one place, at one time by the liquor inventory clerk, who is already at City Hall. Taking inventory of the stock in stoxage, which occurs four times a year, can be done at City Hall by the clerk during ' normal working hours without overtime expense. The utilization of this area for stoxage would reduce the cost of storage by $1500 per yeax by eliminating the Shorewood basement storage area. There is a good security system planned for 1 the liquor stock. It is near the entrance to the Police Department, and thexe would be an alarm system wixed into the Police Department. �J � � 1�OTION by Councilman Mittelstadt to xeceive tha report from the City Manager dated March 10, 1972 entitled Liquor Storage Costs. F'AGE 4 MOTION by Councilman Mittelstadt to authorize the remodeling of the old City Hall area under the Fire lle��artment offices at a cost not to exceed $2100, and to terminate the lease for the Shorewood basement storage axea upon completion of the conversion. Seconded by C�uncilman Kelshaw. Councilman �ireider asked what was the inventory value on warehousing in normal times. The Finance Director said tlie total inventory would be about $45,000 - $50,000 in storage, this does not include what is on the shelf. Councilman Breider asked if the case discounts are received on what is bought per month on a one time basis ar on a multiple delivexy basis. The Finance Director said it is on a one time basis. Councilman Breider asked if the same price could be obtained if some contract was entered into with multiple deliveries. The Finance llirector said he could not answer that without checking with the suppliers. At certain times of the year the City can make a large purchase and have the deliverie:s staggered, but this may not be true for every item. Councilman Breider thought it would be a good idea to check into et�tering into some kind of a contract whereby the amount of purchases needed for t}ie year woulci be projected, the City would receive a large discount for l�:uyi.ng in bulk, then the deliveries could be made, perhaps 4 times a year. The City h9anager said that one reason wholesalers o�fer volume dis�aunts is to cut down on delivery costs. Trying to predict future sales based or� past s:iles can be ctiancy, because of the rapidly changing tastes of p�ople. Councilman �reider said that buying $50,000 of liquor is taking a chanc.e too, and that amount of money is a lot to be lying around gathering dust wlten it could be invested. He said he would hate to remodel the unused area because of£ice personnel will be increasing and it may be needed. Then the liquor would have to be moved out and the City would have to get another building, and it would surely be more than the cast of the Shorewood basement. $2.00 per square foot is a pretty good price. Councilman Breider asked why an inventory is taken four tilnes a year. The Finance Director replied to get a 100% accurate profit and loss figure. The alternative would be a perpetual inventory which, he felt, wou�d cost the City more, and would not be 100% accurate. Councilman Sreider asked that during the next three weeks the Liquor Store Manager contact the liquor suppliers to see what their reaction would be to a contract for vne year, with the right to cancel, and with deliveries maybe four times a year. The City Attorney suggested that the contract need not be absolutely firm, and that there could be an iqterchange of brands w�.th the same dealer if necessary. Negotiations could proceed with the suppliers with the City agreeing to accept so many cases per month. Mayor Liebl agreed the City does not want dead stock, that is money being wasted. Councilmara Breider said that this plan, if possible, would move the responsibility of large storage back onto the supplier. Councilman Kelshaw asked if this program could be im�lemented, is Cour�cilman Breider still opposed to remodeling? Councilman Breider said he was not necessarily opposed to remodeling, but he would like to have the sup�liers be res�onsible for the storage of the merchandise. tie painted out that in other industries, there is a large contract �or the purchase of some item, but the deliveries are staggered as needed. If some product is running low, he �vondered if a supplier would make a delivery promptly. , Mayor Liebl said that it was very important to run an efficient business now that Fridley is out of the on-sale business. Now, if a product is not moving, it cannot be pushed through the bar. He said there were items pointed out in ' the survey by Ed Phillips and Sons Co., that could be changed for better profit, such as relaying the shelves, realigning of inerchandise and changing the traffic flow. The City Manager said that these have been done. Mayor Liebl said that ' Councilman Breider has raised some good points and suggested the Council could sit down in executive session with the Liquor Store Manager to discuss ways of making the operation more profitable. ' � ' ' Councilman Utter said that remodeling the basement at City Hall would save $150Q through the termination of the lease for the Shorewood basement, but the rest of the costs would remain the same, or may go up. There is $480 projected for vehicle costs, but it would stand to reason that if the storage is centxally located, the delivery costs would be more, because at least at one loeation, Shorewood, the liquor would already be there and would not have to be trans- ported again. Mayor Liebl asked what was the rental for other nonsales areas? The City Manager said that amounted to $5,665 and is the area in the rear of the other stores. There has to be some space for the empty beer cases etc. Skywood and Holly have a very limited space in the back. ' Councilman Breider said there would be a saving of $1500 per year now, true, but what about the future years? As the City gxows, this may not be so, and Fridley may end up having to rent some space at $4 per square foot, and added that the last proposal he saw was for $4. The Finance Director said that the figure ' of $9,867 represents the annual costs of liquor stoxage and transportation, and the only saving there would be through centralization would be the $1500. By centralizing, there would not be a significant amount saved in vehicle, ' transportation, or preparation of shipment costs. We are using Shorewood as the central location now. � � , �� ' C� Mayor Liebl asked if Shorewood wants the storage area for their use. The City Manager said they are not forcing the City out, but have agxeed to terminate the lease, if so desired, without penalty. Mayor Liebl asked the Finance Director his recommendation. The Finance Director said that the question boils down to whether it would be better to keep the Shorewood basement at $1500 a year, or spend $2100 for the renovation of the basement at City Hall. If the renovation is done, Fridley would have their money back in two years. He said he would agree with the suggestion made by Councilman Breider, and that more work should be done in that area. He added there was some work scheduled to be done anyhow with the addition of a sprinkler systera. He said it would be moxe economical, even if only fox two years, to spend the $2100. Councilman Kelshaw asked if there has ever been any trouble with vandalism or burglary. The Finance Airsctox said there have been some attempts, but the City has never lost money ox stock items. Mayor Liebl said that when $50,000 is spent, we must be very careful to have the proper merchandise to meet the market. Fridley has to be more frugal since we no longer have the on-sale operation. The City must not end up with too much dead stock. Councilman Breider requested the Administration to prepare.a plan which would show where the office personnel will be situated in the next five years. ile said he would like to see where we are heading and he certainly would not want to have to put an addition onto City tiall because some vacant space was used for liquor storage. The City Manager said he assumed that he should wait until there can be some meetings between the Liquor Store Manager, the suppliers and himself before he goes ahead iaith the remodeling. Thei•e is not a time limit on the remodeling, so it can be started after the investigation is completed on the proposal Councilman Breider has suggested. Councilman Mittelstadt said that the Council turned down the proposal to have a private firm come in and do a study, but he did not want to get the feeling from the Administration that they are stopping work on it, and he did not want the Council to get into the liquor store management business. MOTION by Councilman Kelshaw to concur with the recommendation of the City Manager and appoint Mr. Peter Herlofsky as Administrative Assistant. Seconded by Councilman Mittelstadt. There was a property owner heard that was in favor of the improvement and he believed there was another property owner that was also in favor. He said he noticed Mr. Richard Harris, who is a property owner, in the audience. Mayor Liebl asked Mr. Dick Harris if he was in favor of the improvement, and � added that the other property owners seem to feel it is more practical than the ditch. This piece of property was picked because of the size, location, and the large amount of shrubbery and trees already on the lot. There is an existing building on the lot, atid prese�ted a sketch of what the building looks like. He then presented a sketch of what they wquld like to do with the building, in making it appear more raodernistic and with a chalet flavor. He said he was associated with Leigh Investments, Inc. and they would divide up the interior into offices : to give it a feeling of spaciousness. They plan on adding a dormer acxoss the front and adding a lot of windqws. He said they figures they would need 10 parking stalls and showed a plat plan on the easel. There is 135 feet frontage an East River Road and 245 feet frontage on 63rd Way. The existing building is located in approximately the center of the lot: There would be about 80 feet between the building and East River Road and also between the building and 63rd Way. The parking lot would be between the building and East River Road. The access would be from 63rd Way, then out to East River Road. He said they feel that traffic will not be a great problem due to the fact that there are lights both north and south on East River Road just a few blocks away. He said they are willing to meet the Code in xegaxd to the parking and will have the proper setback. ' Mayor Liebl asked tlow many parking lots he ��s speaking af. Mr. Doyle said they anticipate one 1ot with 10 stalls, ho�ever, there wauld be access to the rear where there �ould be more than adequate parking. This lot is sheltexed from the neighborhood on the east and north by quite a few trees, ther� axe also many trees on the west side. Mayor Liebl asked if he knew of any opposition from the people on the west or north side. Mr. Doyle said o� the north, the property is zoned for duplexes. He said he had not talked to the owner, but he has talked to some of the residents. On the west side ` across East River Road and to the south thexe is a duplex. He said he had � not talked to the people directly across the street. He said he felt it would be an improvement to the area, because the building as it exists now would receive a face lifting. Councilman Breider asked what was the zoning. Mr. Doyle answered R-1. Cotulcil� mari Breider wondered what Zoning he would ask for. The City Engineex said there were two types of zoning available. He could fit undex the C-2 zon�ng,, or if the building is �nly to be used for offices, he could request a CR-1 zoning, which is more restrictive. If the plan is to use the building only �or offices, he would suggest that Mr. Doyle request the CR-1 as he could rece�ve �ess opposition from the neighbors if they were assured that it would be only office use and that at some future time somthing else, such as a grocexy s�oxy or a gas station, could not ga in. Councilman Breider said that �rhen the question �ras put to the peo�le in the neighborhood, they did not expxess any particular desi�e to rezone to c.ammercial. He said he assumed it would be acceptable when they come before the Planning Commission after the notification, they could give their views on rezoning their property. Councilman Mittelstadt said that he felt this shauld encompass moxe than just the 300' and should cover the area from 61st Way to Mississippi Street, and all those people should be notified. Mayor Liebl said that the City Engineer will have to proceed as ihe Charter provides, which is 300 feet. He added there is a fee for this request to cover publication costs etc. Mr. Doyle �aid that he has a list of the people within the 300' rad�.us; uld that he could get the names o€,all those from 61st Way to I�ississippi. The City filed a motion to quash the suit and Judge Bakke has taken it under advisement. There was an order issued for the City of Fridley to fi�e their answer within 10 days, That time has expired, but he had requested, and received, an extensio� o� time� The attorneys for the petitioners appeared before the Judge requesting a preemptaxy writ, which was denied. 'The Judge has the whole situation under advisement ax►d has not reached a decision, but the answer from the City is due. Throughout the Planning Commission Minutes ovex the past month, he said he has txied to explain what has happened. The Planning Com- mission has had 5- 6 requests for ciianges in zoning �rhich involve substandaxd lots. There are four lots across from Sandee's Cafe which wauld fit the 20,000 square foot xequire�t but have to be considered substar►dard now. lfiey have also had a request just north a� Sandee's Gafe by Mr. Walc{uist whi�h in- volved only 17,000 square feet. At the �ia�e the oxdinance was adopted, his recommendation was a minimum of 15,000 square feet �rhich he felt would be proger, but the requirement was made 25,000 square feet, so the 20,000 square feet would be in the nature of a compromise. Mr. OmCbedt explained there was an error made by them in drawing the proposed addition and garage onto the aurvey in that the a�asurement asked for in the front yard variance should be 33 feet 4 inches instead of 34.7 feet. Chai�an Minish stated the notices that were sent out stated 34.7 feet and the Board can ta%e action on that request but if the applicant wants to change zhe request to 33.3 feet, new notices will have to be sent out to the surxounding property owners. Mr. Harju stated he couldn't see why the addition and garage couldn't be jogged back to be more in the back yard. Mr. Dockter said the bacic wall of the addition is level with the cantilever from the kitchen. It would be more expenaive to jog the addition toward the back. Mr. Omtbedt said they would rather defer action on the xequest until the new variance notices were sent out since the road restrictions are now on. Chairman Minish stated the item had been tabled at the last meeting to allow the applicant time to get a letter "of no objection" from hia neighbor. Pictures of the lots and a verification survey were shown to the Board. " Mr. Doherty explained he wants to add on a 14 foot by 26 foot addition onto the front of the existing house. The problem is that the existing house is only 3 feet from the lot line so the addition will also be only 3 feet from the line. The existing house �aas built in 1946. He s�id his main purpose f�r the addition is to get more room since the mai� houae is small to begin with. It will be used for a living room, family room and a small office. Mr. A1 Williams, who has an interest in Lots 27 and 28, Mr. Dennis Berry, 680 Zronton Street and Mr. Raymond Weitbrecht, 690 Ironton Street, were present and interested in learning what Mr. Doherty was proposing. Mr. Williams stated he has a purchase agreement on the two adjacent lots to the North that are owned by an estate. The lota were probated in Wisconsin but have to be probated again in Minnesota. The owners live in California. � He said he owns the 3rd & 4th adjacent lots to the North. � Ci:ainnan Minish asked Mr. Belisle if granting the variance would create � problems for Mr. Williams in building on his lots. Mr. Belisle answered the variance would add to an existing non-conforming use and would restrict building on the adjacent lots as there haa to be 15 feet between structures and 20 feet between living areas. The addition would also be increasing the fire hazard between structures. He asked Mr. Doherty if he had considered building onto any other part of the house. Mr. Doherty stated that economics dictated which way they could add on. Thia is the only way to go to get the maximum benefit for them. Any other way would disrupt all of their plans. This plan would also blenci in very nice with the existing house. He said in answer to the Boards questions, that the addition will not have a second story and there wi21 be just a crawl space under it. Mr. Crowder asked if Mr. Doherty had talked to a builder and if the builder could build the addition as proposed. Mr. Doherty said his sketch is just a rough aketch and some ideas could be changed but he has had estimates from 3 contractors and they c$n build according to his measurements. Mr. Williams asked if it would make any difference on his lota if he placed the garage in the rear yard and ran the dziveway along the property line. He said they could put up a different type of bungalow that would meet all the codes but it wouldn't be as nice looking as the one that they propose. � Mr. Lennox said he had wanted to buy this lot and build a double bungalow � on it but the City Assessor had told him that this lot had only 9,770 sQuare feet. Mr. Christenson said he had discussed this plan with the City Engineering Assistant and they agreed there was 10,380 square feet. He said they are building a double garage on one side of the dwelling and a single garage on the other side but they also have to have a parking space or caxport in the rear yard to meet the code. They haven't decided exactly where the parking space would be yet but they do know they have to have the parking space. Mr. Belisle added the parking space would have to be 25 feet from the property Iine so the car would not be parked on the boulevard. Chairman Minish stated it is not the Boards responsibility to check the area of the 1ot, that ia the responsi6ility of the Building Inspection Department ' or the Engineering Department. If there is an error in the lot area, the applicant would have to come back for another variance request. The Board is only to act on the 5 foot variance that is asked for at this time.
