AN ORDINANCE TO AMEND THE CITY CODE OF THE
CITY OF FRIDLEY, MINNESOTA BY MAKING A CHANGE
IN ZONING DISTRICTS
The Council of the City of Fridley do ordain as follows:
SECTION 1. Appendix D of the City Code of Fridley is amended as
hereinafter indicated.
SECTION 2. The tract or area within the County of Anoka and the
City of Fridley and described as:
Outlot 1, Rice Creek Plaza South, Lot 32, except the
South 2.7 feet, Block 4, Lowell Addition to Fridley
Park, together with the vacated Street lying between
the before mentioned parcels, all lying in the South
Half of Section 14, T-30, R-24, City of Fridley,
County of Anoka, Minnesota,
Is hereby designated to be in the Zoned District
known as R-3 (general multiple family dwellings).
SECTION 3. That the Zoning Administrator is directed to change
the of£icial zoning map to show said tract or area
to be rezoned from Zoned District R-1 (single family
dwellings) to R-3 (general multiple family dwellings).

AN ORDINANCE UNDER SECTION 12.07 OF THE CITY
CHARTER TO VACATE STREETS AND ALLEYS AND TO
AMEND APPENDIX C OF THE CITY CODE
The Council of the City of Fridley do ordain as follows:
SECTION 1. For the vacation of Madieon Street described as
follows:
All that part of the street right of way known
as Madison Street that lies between Blocks 1 and
2 of Oak Hill Addition lying North of the Westerly
extension of the South line of Block 1 and lying
South of the Westerly extension of the North line of
Block 1 of said Oak Hill Addition,
All lying in the Southeast Quarter of Section 23,
T-30, R-24, City of Fridley, County of Anoka,
Minnesota,
Be and is hereby vacated except that the City af
Fridley retains the North 10 feet together with
the South 6 feet for drainage and utility purposes
and also the City retains the South 25 feet for
a Standard Oil Company pipeline easement.
SBCTION 2. The said Vacation has been made in conformance with
Minnesota Statutes and pursuant to Section 12.07 of
the City Charter and Appendix C of the City Code
shall be so amended.

change of the road in the proposed plat of Heathe� Hi�.ls 2nd Additioq. �he �ul

Mr. Claxk continued that the Subcommittee recommended 8pproval qf Che� p�at
��d that the plan adopted in 1968 be changed to show tha cul de sacs. M�mbe�s
of the Peoples Church seemed to like this idea better that� having the street
xun through their property and exiting on Central Avenue. They were conce�cned
ir� Plats & Subdivisions-Streets & Utilities that Rice Creek Road and �enjatait�
Street sanitaxy sewers wexe not deep enough for a gravity system, but a��ex �heck-
ing further at the end of the meeting, they beXieve the sanitary sewex c�n b�
taken from the cul de sac, go to Benjamin Street and out to Rice Cree�. Road.
The lo�s are all standard size and larger. Utilities are in place now. Fox'
drainage, there will probably be a storm sewer installed and drain into Chs
$ou�hwest carnex.
Rev. Henderson said, speaking for the members of the Chu�rch, they �ee� that
this is probably as good a compromise that they have been able to work out.
They would look with approval on the cul de sac. They rathe� favor tt�is p�;�tn
over the one worked out earlier.
Mrs. Wayne Welch, 6115 Woody Lane: She asked if Chis meant that defi��tely
there would be no entrance on Central Avenue. The plan was explained to h�x
that the South road does not go through, however, there may be one from the new
nq�th�rly street.
� Mr. Schmedeke said his Subcommittee looked at this �equest a week �go. H�
was one of the members that worked with this study fxom the beginning. Thsy
felt they had something to start with and they did. Miller Homes are beirig
built pn the East area and Mr. 0'Bannon on the Westerly part. Mrs. Skog, pi�e
, of the three large property owners to the West, agreed. The Peoples Cttu�ch
looked favorably on this,present plan. Considering the three large prope�ty.`.

2. VACATION REQUEST: SAV ��72-03, GENE HETLAND: Vacate alleys in �lock 7,
Onaway Addition, North/South alley between Beech Street and �lm Street
and the East/West alley that exists now.
Mr. Gene Hetland and Mr. Ray Carlson were again present for this item.
Mr. Schmedeke said thfs item was before his Subcommittee a week ago.. They
appxoved the request, but asked that all the people owni�►g propexty in $lock 7
be n;otified of the meeting before the Planning Commission this evening.
� The reason Mr. Hetland gave for the request was the North/South alley was
not being used for anything. For that reason, he felt there was no pux'pose
having �t. There are utility easements in the alley, but as far as the buildings
are concerned, all access is from the front of the lots.
Richard Harris, 6200 Riverview Terrace: First of all, he sa�.d, he objects
to '�T" alleys. They serve no purpose, especially in industrial areas. He coulc�
see where there would be a possible use for the East/West alley becaus� it
do�s open on Beech and Elm. It probably would serve a purpose leavi�g the �ast/
West alley intact.
Mr. Schmedeke said it was a good point. There are small lots op 77th WaY
Richard (,DiCk) JohnsQn, Harstad Co.: He had no objection to the North/South
a11ey, but the East/West could be an access for the small houses and pnake easier
to build on the lots facing 77th Way.
Mr. Fi`tzpatrick noted that no one pXesent this evening spoke i� �avox o�
vacating th�e �ast/West alley. The signatures on the vacation application of the
property ow�ers were checked.
Mr, Cla�k added that the ditch running in the �ast/West direction through
�locks 5, 6, 7 and 8 will be abandon�d as a sto�n sewer is goi�;$ to be i.ns�t�lled

Mr. Clark said the total lot area measured 200 feet. The request Mr.
Schmedeke referred to was Lots 3 through 7, located to the reax of the lots
being considered this even�ng. There was some discussion and difference of
opinion whether or not we should try to make one standard lot and the othex two
60 foot lots. The request was approved by a majority vote and Counc�l $ppr�ved
the split as requesfied.
Mr. Dave Anderson said they have built several homes in this are�. They

Mx. Schtnedeke explained his abstentiot� by saying the reason being th�.s
paxti.cular type of lot split. He is Chairman of the Plats & Subdiv�.sions-Streets�
& Utilities SubepmmitteE and he felt if this man could come in and ask fox a �
66 2/3 foat lot, it would be hard for him, as Chairman, to ask anqther mar► to
plat 75 foot lots. He dtd not look unfavorably if it were a hardsh�p case. ��
there were three 44 foot lots and divided evenly; no objection. If thers were
�ive 40 foot lots, and two lpts could be €ull sized, he would agree to bui.lding
on a 40 foot lot providing the lot was wedged between two homes. The x�ason .
for abstaining was that by abstaining, he was voting witi� them but t�o� objecting

This is the second request. Another fact was that the previous requesC was

Design Control Subco�nittee urged off street parking stalls be made available,
but not necessarily on the streets. The streets are 26 feet wide and this
restricts travel through the area if parking were permitted on the street. The
City requires two parking stalls for apartment houses. The City also tries to
have the curves lengthened to make it easier for trucks. They feel we should
have some sort of turn around on the South end.
Mr. Nordaune said they have incorporated that in the plan.
Mr. Clark added that the City has not seen a sanitary sewer proposal or
water, but that is no problem. The storm sewer in the whole project is being
carried through a series of ponds with ultimate outlet in New Brighton. Negotia-
tions with New Brighton are in progress, but if not approved, an alternate route
will have to be effected which could affect costs and location.
The densities on the different phases, if the project ia completed, wauld
be 826 units. They are a little under the original f igure of 850.
Mr. Zeglen brought up the matter of the new Bccilding Code which goes into
effect on July 1, 1972. Darrel Clark said we can use our own Building Code until

a�t on that letter.
The problem of parking should be resolved before the project is developed,
Mr. Minish commented, because then the City would have some control ovex it.
Mr. Nordaune said if the tenants created a problem by paxkit�g boats,
recreational equipment and weekend parties, the Association would have Co �olve
that probl.em by providing additional parking areas. He stated they were required
to furnish two stalls per unit. He agreed that there should be continuous �ecess
for emergency vehicles. They could make the plan contin$ent upon a� agreeable
solution with the City.
The Commission members felt they would like to see on the plans wbei� the
streets in the whole area would go.
Mr. Clark said if a road should be continued South, it shou�.d be shoGtn on
the glan. The Commission would still be having another Iook at the plans. Naw:'
th�y should recom4nend whatever they feel is necessary. Gounci� will act, and
the petitioner wi11 have to come back to the �lanning Commiss�on. If Che P7.an-� ,

The members felt there should be more provisions for off street parking,
and it should be sketched on the plan as to the number and the ratio of parking
stalls away from the front of the garages.
Mr. Nordaune said it seemed the Commission was asking for more than two
parking stalls and it would be difficult in this situation to comply.
Acting Chairman Fitzpatrick said he did not accept the tandem parking space.
There must be access to each stall, not as the plans show, one parking stall in
the garage and the second one to be in the driveway in front of the garage.
A discussion followed regarding the use of brick with Mr. Zeglen saying
the Subcommittee felt there was enough brick on the buildings.
A further problem was the difficulty of the on-street parking.

mend approval of the Preliminary Plans for the Viewcon, Inc. (9 four unit

Bob Schroer, Jerry Schroer and Dave Rick were present.
Bob Schroer explained that the swimming pool venture was not handled satis--
factorily last year and now the Green Giant people requested your consideration
for a transfer and extension of the Special Use Permit to them. He referred
to a letter dated March 28, 1972 from the Green Giant Home & Garden Centers,
Inc., which the Planning Commission had before them stating they "were pre-
('� pared to accept full responsibility and accounCability for compliance with
� applicable codes". Mr. Schroer continued that one of the things not fulfilled
was that the sma11 house be removed. It is there yet. The pools were taken
down as recommended. The landscaping was done, but not kept up. The fences
were mandatory and still exist. The provicion to come back in October for
review of the permit was never done. This was not a profitable venture last
year, but the Green Giant people wish to remain in the swimming pool business,
especially as one of the competition in Fridley will not be in the business
this year.
The little house sitting in the fenced-in area is still there. It is a
well constructed building and very attractive. Its use is mostly for hand out
material and display of pool supplies. An extension phone was installed.

Mr. Schmedeke said this was a temporary building wiGh no �oundation at�d
no sanitary facilities. The Commission have tried to shy away from the
temporary buildings.

to Council that the Special Use Permit, 5P #71-07, be granted to the Green Giant
Home & Garden Centers, Inc. for the purpose of above ground swimming pool display
and to allow the cabana structure to be used again for a one year pexiod as of

Mr. Schmedeke said that these loopbacks are att�ac�ive for a service sGati.on
use. He felt a service station could be built behind a sexvi�� drive and there
would be no need for a loopback. The station would be 75 feet fxom the p�ain
tk�oroughfare under a regular loopback, but Che station built behind th� se�rvice

The Parks & Recreation Commission discussed this item about a yea� a$o.
Mr. Schmedeke said that the area abutting Highway ��65 should have a ch�n�e
to develop. If trees were planted in this boulevaXd, making a be�utiful n$tural
buffer, maybe there would be a chance to develop. The strip could have side�
walks to go to Locke Park. Or the schools could participate by p].an�ing �Tees
in conjunction with a conservation course. Mr. Brian I�$valson is the teacbex'
of horticulture at the Senior High School. It was felt that Mx. U�ter, �ouricil-
man at Large, be made cognizant of the request. The P�anning Commissian shpuld
take'advantage of Earth Week, if it isn't too late, and also Arbor Week.
8. STIRVEY OF 40 FOOT LOTS IN FRIDLEY:
Mr. Schmedeke said that after the survey of 40 foot lots in the Plymouth
Addition, he thought it might be advisable to have a survey of 40 foot lot� �.t►
other parts of the City. 7.'his time in R-1 and R-2 Districts. In particulax,
he was thinking of Oak Grove Addition. He felt that the people owning 44 foat
lots, if in the past they were told they could not bui7.d on them, would g�ve
up and not come back to check. He was trying to get these lots on the tax
rolls.
Mr. Minish did not agree. He did not feel the need to go on a wt�ole$ale
campaign.

as it was a better base and gave less water trouble.
Mr. Tonco asked if they were going to install a sidewaik around the

Mr. Tonco asked about ttie curbing around the blacktop. Mr. Rotter said
they inteaded to use bituminous curbing. Mr. Tonco said as this was for
a period of five years it couldn't be coasidered temporary, so they would
have to install poured 6"x12" concrete curbing. All members of the Board

' the units the only common wall is on the second floor with a drive
through area underneath. This common wall will have two 2x4 walls
with 5/8" sheet rocking on both walls and both walls insulated. The

joists on a laminated beam so there is no connection between the
floors of one uait to the other for the transmittal of souad.
The exterior will be a board and batten type of construction in
medium to dark hues of brown. Each unit will have a balcony. The

The Board brought up the separation between sCructures.
Mr. Ottem said there is approximately 12 feet between structures. He added
they wouldn't be adding onto the house but just converting what is already
there. He said he had talked to his neighbor and he meant to get a letter of
"no objection" from hi.un but he wasn't home tonight.
Mr. Crowder said there must be a window on the wall that faces the adjacent
propexty and asked if this window would be removed.

On March 3, 1972, bids were opened for a High Velocity Sewer Clesner for the
City of Fridley. On March 6, 1972, the City Council, upon my recommendation, 1et
the coatract for a Model FHY-602TMW High Velocity Pipe Cleaner to Flexible �ip� �
�Tool of Sauk Rapids. This was the model that I believed the Public Works Depart-
ment desired and the oae for which bid specifications had been written. It has
since come to my atteation that it would be advantageous for the City to considex
placing a change order from a Model 6Q2 to s Model 701. The Model 701 exceeda Ch�
original bid specificatioas. An aaalysis of all bids is enclased for youx informAtloa.
The Model 701 made by Flexible is the top of the line and holds soa� very
definite advantages for the City to consider. The greatest advantage that � see �R
this model over the other two models manufactured by Flexible is that the ut►it is
completely enclosed and heated, thereby protecting �t from the freezing wea�her
which could do considerable damage in Minnesota sinters to the pumps and other
equipment of the cleaner. It also has a remote control device which gives greatsr
accessibility to manholes on private property.without the necessity of d�'iving �
heavy vehicle over private property and thereby possibly doiag damage to the prop�rty.:
Additional advaatages iaclude a more powerful pump, a larger self-wind drwn $p�
greater cleaaing distance with one tank of water. A complete analysis is etielc►sed�
as well as a report from Mr. Ruaty Silseth, Sewer Foreman.

After aeeing a very good demonstration, I thought the points he had
undarlined Mould bs of benetit to tha City of Fridlep, and had hoped

8 sauge steel aad reinforced on the �ides and enda to pnclude dis-

14ie 701 ha• aa �acternal automatic fill �ystem, Whareby vhen the
tank is full, a valve autonatically stops the vat�r flow fram the hydrants, '
�►ith no spillag� on the st��et. It has remotR coatrol with switchee oa the
box ta controi the 'achine with an electrical cable 20' long, ao you can
aperate the machiae 20' a�ay over a manhole; �uch as w+orking off eaae- -
mant�. It also �iwa the operator a break in being able to move ��ray
irom the machine -- to get away from a noiay motor running at top speed
all day.
T6e reel has a S7" O.D• compared to 30" O.D. oa the 602. It has a
very narrow reel that ia self Winding; vhere oa the 602, tfie operator has
to guide the rewind. The larger the O.D. of the reel, the longer life
span of the hose in ahicb the hose is clo�e to $3.00 per foot.
' The pu�, ia a 70 G.P.M. pump compared to 60 G.P.H. pump on the 602.
In my opinion this ia a big a�set. The 701 machfne, when not in use, is
', ' .�ntirely closed up, so that no gaugee or reels, etc., are visible.

GENERAL
The entire machine shall instatf on a
truck chassis with a minimum GVW
� and a minimum CA of

be provided to permit access to the
engine and pumps. The underside of
the frame shall be undercoateii with a
bitumastic undercoating material. The
interior of the enclosure shall be
primed and painted with non-rub alu-
mirium. The exterior of the enclosure
and tank shall be primed and painted
with two coats of automofive tYpe
synthetic enameL
TANK
The.capacity of the tank shall be.,�(
gallons minim . It shall be con-
structed from gage steel minimum.
The tank shall e reinfor ed on the
sides and ends t prec ude istortion.
It shall be baffled to create not less
than four interconnected compart-
ments. The baffles shall be welded
to the sides and ends onEy. The battom
2096 of the tank shal� remain un-
baffled. All welds in the interior of the
tank shall be. continuous. The pipe
connection to the pump shall be
located in such a position that the
entire bottom of the tank serves as
a low-velocity settling chamber. A 2"
drain fitting equipped with a 2' gate
valve shall be provided in th� bottom
at the rear of machine so left over
water can be dumped directly into
manhole without moving the
Knachine. External sight gaga� si�all
be provided on each side. The ex-
te�hal sight gages shall be located so
that thgy are visible both during the
filiing oper'�tion and the cleaning
operation. An external automatic fill
sys i o p m an air gap an a
float valve s e supplied. The fill
system shall be operable from either
side oi the tank. TF►e tank sha11 be
vented at atl times to prevent the
buildup of either positive or negative
pressure within the tank from any
cause. The entire top shall be re-
movable for ease of inspection and
cleaning. A permanently attached
steet ladder to provide access to the
top of the tank shall be provided.
ENGINE
A six cylinder water cooled engine
having a minimum displacement of
220 cubic inches shabt be furnished.
The engine shall devetop sufficient
power at each point within its operat-
ing range to dnve tl,�e pump and all
other accessories at that pomt. �he
erigine shall be equipped with a 12
volt el@ctrical system which shall in-
clude a starter, alternator, voltage reg-
utator, battery, and a key type starter
ignition switch. The controls for the
engir�e shall be brought to the opera-
tor's station. The exhaust pipe shall
be protected by an industrial type
weather cap.
CONTAOLS AND CONTROL PANEL
All gages, switches, levers, etc., neces-
sary for the operation of the machine,
with the exception of the fill system,
shall be grouped together at the oper-
ator's station so that the operator may
have complete control of the cleaning
operation at all times. A fixed control

an engine water temperature gage.

bination ignition starter switch, a reel
speed control, a reel hydraulic system
pressure gage, a water system pres-
sure gage, and a quick disconnect
type of connection for the wash down
hose. In addition to the controls and
gages attached to the fixed control
panel, there shall be a portable control
station which may be attached to the
fixed controt panet or detached from
it and carried by the operator at will.

linked to the machine by a multi-
conductor flexible electrical cable and
it shall contain two switches; one
switch to turn the water on or off,
the other to raise, lower or �top the
nozzle and clear�ing hose. �y means
of the portable control stafro� it shall
be possible for the operato� to cont�ol
the machine either at thefixed control
panel or at his option fronl �nY loca-
tion within a twenty fast /A►dius of it.
A large hinged door sha11 be provided
immediately adjacent to �e fixed con-
trol panel to give convenient access
to the rear side of the co�trols and
gages mounted on the fixed cont�o)
panel. The operator shall be com-
pletely shietded from al1 of the appara-
tus and high-pressure piping by the
fixed control panel and the door
adjacent to it.
HYDRAULIC SYSTEM
The hydraulic system that powera the
hose reel shall consist of a five gallon
tank, a return line filter with replace-
able element, an electrically controlled
directional 4-way valve, a detented
speed cQntrol valve, high pressu�e
hoses with integral swivel type fit-
tings, a pump drive� by a V-belt from
the front end of the engine• s�nd a
reversible hydraulic motor. The pump
shall be a gear type pump capable of
delivering 15.5 GPM against a 2000
psi head when it is ope�aiing at 2000
RPM and it shall be equipped wlth an
outboard anti-friction beanng at the
sheave end af the shaft. The hYd�au4ic
motor shall be of the gearotor type
capable of delivering at least 9000
inch-pounds of torque at the hose
reel shaft.
PUMP
The pump shalt be a heavy duty trlplex
plunger type. It shall be capable of
delivenng �p,.GPM against a 1200
psi head at �00 RPM maximum. The �

corrosion-resistant metallic alloy. The
drive shall be multiple '"V" belt of
' tne "'power band" type and it shall
be of adequate size to transmit the
power from tP�e engine to the pump
without slippage. A screw jack type
of tensioning device shall be provided
i' on the engine so that proper tension
can be maintained in the belts. Posi-
tive means to prevent total shutoff
�, of the outlet of the pump shall be
provided.

A multi-purpose valve shall be in-
corporated. This valve, in the proper
position, shall direct the flow of water
to the cleaning nozzle under increased
pressure or provide water to the wash
down hose. or direct ihe water to the
recirculatory system as required.
PIPING
All piping shall be suitable for the
intended service. All high pressure
piping, both pipe and fittings, shall
be of steel and shall be suitable for
continuous operation at 1200 psi vvith
adequate provision for over pressure.
All suction and low pressure return
lines may be of standard weight pipe
and malleable fittings. No cast iron
fittings may be used. The piping sys-
tem shall be designed so that it may
be drained if the machine is to be
exposed to sub-freezing temperatures.
HOSE REEL
The hose reel shall be of heavy duty
construction and shall be capable of
withstanding any mode of operation
without collapsing or distorting. The
ends shall be rounded to prevent
damage to the hose when it comes
into contact with them. It shall be
capable of holding 600 feet of one
inch ID high pressure plastic hose. It
shall be power driven in both direc-
tions. The primary source of power
shall be the engine that drives the
pump. The controls for the power
drive shall be located at the operator's
station on the fixed control panel and
in the portab{e control station. The
reel shall be equipped with a manual
means of emergency operation. The
reel shall be not less than 57" OD
and designed so that it wili n'i�tt5e
necessary for the operator to guide
the hose onto or off it. The direction
of the reel shall be controlled from the
portable control station. The speed of
the reel shall be controlled from the
fixed control panel. All drive chains,
sprockets, etc., shall be provided with
guards where necessary for the safety

Joint Powers Agreement for Purchasing Between Anoka
County and Various Governmental Units within the County
Anoka County is establishing and will service a joint purchasing agreement
far the various governmental units at no cost to the other units of
government.
The operation will be the same type of program we, (City of Fridley)
are participating in with Hennepin�County.
It is my recommendation that the City Council approve a resoluCion to
participate in the joint purchasing program with Anoka County.
Attached find a copy of the Joint Powers Agreement stating the purposes
and performances of such agreement.
Anoka County would appreciate the City of Fridley's approval or
disapp roval by Tuesday morning, April 18, 1972.

WHEREAS, the League of Minnesota Municipalities proposes to engage a

2. Net revenue of the municipal liquor store for 1910 was $221,577.00
3. The financial participation of the city (village) shall be in the amount of
$ $100.00 to be paid out of the liquor store fund upon notification that a
sufficient commitment from other municipalities has enabled such study.

SUBJECT:_ Dram Shop Insurance
For several years the insurance premiums charged for dram shop insurance have
been escalating rapidly and in many instances the limits of the coverage offered
have been reduced. During the same period the number of insurance carriers wi1Z-
ing to write this type of coverage has dwindled from ten, about five years ago,
to two companies at the present time. This problem can be addressed in two ways;
by legislation to limit the liability of municipalities under the Dram Shop Act,
and by acting jointly to obtain adequate insurance coverage at lower cost.
Legislation has been proposed in each of the last several sessions of the legis-
Iature to place limits upon the financial liability of municipalities under the
Dram Shop Act and make other changes aimed at reducing the risk and therefore the
premiums for this type of insurance. While some of the desired changes were en-
acted into law during the 1969 session of the legislature, these changes have not
reduced the problem significantly. Although continuing efforts will be made in
future sessions of the legislature to obtain further beneficial changes in the
Dram Shop Act, our experience to date would seem to indicate that we should not
rely solely upon this course of action to solve the problem. This means that
serious consideration shou].d be given to the second way of addressing this problem,
namely acting jointly to obtain adequate coverage at lower cost.
Over the past few years there has been considerable discussion of how the affected
' municipalities might address the problem of procuring dram shop insurance coverage
but no clear cut alternatives have emerged. This is because considerable expertise
is required in the field of insurance in order to assess the present situation,
, to explore alternative ways of providing the required insurance coverage, to re-
commend the most workable alternative and to formulate a plan of implementation.
In other words, if the affected municipalities are to move beyond the talking stage,
' they are going to need some good professional advice and they are going to have to
pay for it.
' In recognition of this, there have been several meetings during the past year between
representatives of the Minnesota Municipal Liquor Stores Association, the League staff,
and William Peet, the League's insurance consultant. Out of these discussions emerged
' the enclosed study proposal.

� There is also enclosed a postcard and a draft resolution for the use of those
municipalities that wish to participate. If no meetings of the council are
scheduled before April 27, you may want to sample council opinion informally
' and respond on that basis in lieu of a formal resolution to participate. If
a sufficient number of commitments are received by May 1, the study will begin
immediately and should be completed in time to be considered at the appropriate
� workshop session during the League convention, June 14-16. Approximately 150
out of the 405 municipalities having liquor operations will have to participate
, if we are to proceed. If we do not receive enough affirmative responses by May 1,
we will all have to acknowledge the fact that there is not sufficient interest in
� solving this problem to warrant any further efiorts by the League staff.

A PROPOSAL TO CONDUCT A STUDY OF THE DRAM SHOP INSURANCE PROBLEM
Purpase
T'he purpose of the study is to explore all aspects of the problem of securing
adequate dram shop insurance coverage at a reasonable premium cDSt by municipalities
having municipal liquor operations and to recommend a specific course of action to
accomplish this end.
Recommended Approach
It is proposed that an independent insurance consultant, William Peet, be en-
gaged for the specific purpose of.conducting the study. Mr. Peet (who does not
receive any compensation either directly or indirectly from any insurance company)
is the only independent insurance consultant in Minnesota and is widely recognized
for his competence in the field. He has advised many private corporations as well
as public jurisdictions concerning their insurance problems.
Mr. Peet has agreed to perform a complete study of the problem including the
following specific facets: - -
1. �xamine the information that is reasonably available concerning the
coverages provided, the premiums charged and the losses experienced by
those insurance companies that are writing this type of coverage in

Minnesota.
2. Aevelop an insurance pzogram which would provirle adequate coverage
and explore alternative ways in which this coverage'could be�provided at
reasonalile cost, including the joint purchase of a blanket policy, jointly
funded self-insurance, organization of a reciprocal insurance arrangement,
or the joint purchase of re-insurance covering part of the risk.
3. Development of a specific recommendation which will provide the required
insurance coverage at the most reasonable cost along with a plan for its
implementation.

by May 1, it should be completed and ready for discussion during the League convention,

Mr. Peet has agreed to perform this study for a fee not to exceed $7,300.
� Since municipal liquor operations in the 405 affected municipalities generated
1 more than $10 million in net income in 1970, funding the study would seem to be
well within the financial capability of those communities that would benefit from
� it. Since the potential benefit which will be derived from the study will accrue
to the affected municipalities somewhat in relation to the size and profitability '
Iof th�ir municipal liquor operations, it is suggested that the studp be funded
� somewhaf in proportion to the net income in 1970. Specifically, the affected
munic3palities are requested to contribute to the funding of the study according

' Work was then abandoned. Letter written March 16, 1970 that a new permit
would have to be taken out if work was to be completed. Stop work order
posted on dwelling site. On July 2, 1970 a building permit was taken out and
' was double feed as they had started the construction without a new peYmit.
House is still not finaled out.

I talked to Mr ?•'illiam Kayser in regard to the following matters and would
advise you that, subject to the noted exceptions� I see no unsurmaountable problems.
It would be our opinion that there are sor�e ob jections to the site but recogrtizing
the need for close prox.imity to large groups of people we feel it could be handled.
Location of the Carnival rides
The actual location of the rides will be directly �outh of the Spartan Store
building. l�ir Kayser was advised that an obstruction free fire lane would have to
be maintained around the Spa.rtan building.
Overflow of par.king into the Skywood �hopping Center lots
' l�ir Kayser stated that this had been discussed and th�t the manager of the
Spartan Store was to contact the people at Skywoad and arrange this. It was felt
that there would be no opposition to this..

Traffic Congestion
Mr Kayser was advised that the intersection of 53rd and Hwy 65 would become
further congesUed by the carnival traffic. He agreed to inform his people who
park the cars to be especially aware of not contributing to furthe r congestion
by expediting the entrance and exi.t of traffic. It must be further noted that
Hwy 65 is very congested in this area already due to the 100 Twin Drive—in
traffic. I feel that altho this is a recognizable problem, it could be handled
by the traffic signal most of the time and r:Light require the use of our Officers
to direct traffic through the intersection during heavy tr�.ffic periods,
Policing of the Carnival grounds
' Mr Kayser asked ii the same arrangement could be r.iade as in the past. He
explained that the carnival owner pays the Police Department $200,00 for two
men to patrol the grounds each of the five nightso Chief NfcCarthy had allowed
' meanbers of the Jaycees who were also l�uxilary Police to provide one man while
he (Chief 1�IcCarthy) worked hi.r.iself to provide the second man. The money was then
divided evenl�r r��ith the Jaycees receiving ha.lf (�100.00), I advised i�jr K_ayser
' that I would be of the opinion that this arra,�ement could reznain with us
providing an Officer who would work t�rrith one of their mens but would check
this out.

I would suggest that in granting this permit, it be taken into consideration
that during the operation of the car-�iva1 rides it is necessary to have several
large diesel engines running. The resulting noise may generate c�plaints from
the residerts on the hi11s directly above Spa.rtana.

since it is new and I have no meterial in regard to ita

The City had planned to add an additional position in both the w�ter d�vision
and the sewer division of the Public Works Department this year. The sewer
division crew, with the exception of the Foreman, is a fairly new erew, �c�d
I feel they would benefit greatly by the return of a man with Mr. Swanson's
expexience in sewer work.
The City does not have a reinstatement policy, per se, although the
, entire �ersonnel system is under evaluation by Mr. Herlofsky, AdminisCxativs
Assistaat. Because we did not want to necessarily set any precedent on �
reinstatement policy, we have drafted an agreement between the City aad
Mr. Swanson all�wing for his reemployment. I have discusaed this with Che
' ahop steward of Zocal #49, Mr. Uon Carrigan, and made the Frid�ey unit o�
Local #49 a party to the agreement, so that the Union agrees to the methud
that we are reemploying Mr. Swanson.

Mr. Swanson has provided a statement from his doctor certifyfng he is
physically capable of performing the duties of a Senior Sewer Man. I� would
be my recommendation that l�fr. Swanson be reemployed with the City of Fridley,
and that the City Manager be authorized to execute the attached employment
agreement with Mr. Swanson.

Still alarms and Fire Outs are handled by the men on duty.
Fire Outs are cases where a fire has occured, and is out
when discavered. Between the hours of 8:00 A. M. and
8:00 P.M. these calls are handled by Fire Prevention
Chief Robert Aldrich or myself. After 8:00 P.M. they
are handled by the men on duty.
Four department drills were held this month wixh a�l
average attendance of 24.9 men.
Four Special drill were held this month for the probationax'y
firefighters, with an average attendance of 8.12 men.
The regular monthly meeting of the department was held March 2nd with. 28 members
attending.
Fire losses for the month of March 1972 were approximately $3,000.00
Fire losses for the month of March 1971 were approximately $15,000.00�
�aptain Ottem and myself attended the North Suburban Mutual Aid Meeti.�ng at Goldan
Va11ey City Hall March 28th. Discussed new State �uilding Codes.

` After January 1, 1973 members of �ire Departments driving fire trucks, will be required
to ltave class B or Class C licens�es. At the pres�nt time they are nat required to
have a Chauffeurs License.
