I have reviewed this material and believe that the points that Mr. Zylla makes in his memo of October 11, 1972, on page 2, regarding the objections of Mounds View to the New Brighton interceptor acquisi[ion are valid. I have checked with Mr. Burandt and this matter will be heard before the Metropolitan Council Referral Committee on November 2, 1972; however, there is a possibility that the Fridley City Council will not meet.between now and November 2, 1972, and I would therefore recommend; A. That you review this material and that this subject be placed on the Agenda for October 17, 1972 B. That you direct the City Manager to prepare appropriate statements in opposition to the New Brighton request for acquisition of an interceptor sewer line and direct this communication to the Referral Committee of the Metropolitan Council. Davis City Manager � � MEMO T0: SUBJECT: OFFICE OF THE CITY MANAGER FRIDLEY, MINNESOTA October 17, 1972 THE MAYOR AND CITY COUNCIL CORRECTIONS IN THE DRAFT OF THE CATV pRDINANCE In a review of the ordinance since it was given to you on October 13, 1972, a few minor typographical errors have been discovered and should be corrected prior to first reading, In addition, the section on Grant of Franchise has been added, which was overlooked in the preparation of the initial draft. The correc- tions are as follows: pn Page 8, Section 9, A, It was suggested that the words "after the effective date of this ordinance" be stricken from the ordinance, and the words "after December 1, 1972" be inserted. Under the present interpretation of the Ordinance, this would mean that the company's franchise would be ten years from the effective date of the original passage of the ordinance, which was in early January of 1972. I believe it is the Council's and CATV Advisory's intent to give the company a ten year franchise from the effective date of the amended ordinance. The amended ordinance, if passed on first reading on October 17, 1972, and second reading on November 6, 1972, would go into effect November 24, 1972. On Page 8, Section 9, B(2), the word ��Commission" should be replaced by the word "Company��, On Page 33, Section 22, g(3) and (4), the service rates for the 5- 19 unit category for Commercial and Mobile Homes should be corrected to read: "5 - 19 Units - Not to exceed $4.?5 each". These rates then would be consistent with the 5- 19 rate for Multiple-Family Dwellings in Section Section 22, B(2), The last change in the ordinance is to add Section 34 to the ordinance as follows; SECTION 34. GRANT OF FRANCHISE - There is hereby granted a franchise to General Television of Minnesota, Incorporated, pursuant to a11 the terms and conditions of this ordinance. October 17, 1972 Subject: Receiving Bids for Fire Truck Sale The bid opening for the sale of the fire truck was held at 11:00 a.m., Tuesday, October 17, 1972. One bid was received from the Village of �kabena, Minnesota, in the amount of $750.00. It is reco�ended that the.bid be received and accepted.
