Retroapective - one year no penalty plan - Plan II. Employers Mutual's plan on a no penalty basis using a hasic pre�um of $7,707, a minimum premium of $14,339 and a maximum premium of $29,642 is the best one year retru-, spective. The one year bid should not be considered in view of the subatan[ial impcovement in fac[ors in the three year plan. Federated Insurance through EaYl M. Commerstad did not bid on the specifications but did present their "Variable Dividend Plan" which is attractive because of its simplicicy. Because of not having bid on comparable apecificat�ona and be- cause there is no apparent appreciable benefit to the Clty ih considering this, we have diaqualified Federated. It is your consultants opinion that [he interests for the City of Fridley Y cap best be protected at this time, by purchasing a three year plan. The i variance of your loss ratios through the years, together with the questionable k legali[y of commiting fwnds under a penalty retrospective p1an, causes us � to recommend the acceptance of the bid of P. M. Endsley, the Slidin Scale Dlvidend Plan in Fireman's Fund with a maximum three year premium of 584, 49. �- Accepting a three year plan will permit the immc�diate institutio.^. of a ' workable safety plan and we would recommend thaf the insurance be purchased on the proviso that Fizeman's Fund will guarantee a minimum of four safety meetings annually and the institution of a safety program for the benefit of the City of Fzidley. lA i : Mx. Part of the charge wi11 novr be based on a "SAC" or connection charge. In order to t�ll tiahat af�°ect the "SAC" charoe would have on the City of Fridley, I have orepared material sno�vinct what the charges to the City of Fridley t-�ould have been if the "SAC° charge had been in effect during 1971 anci 1972, I have also made a projection for the year 1973. If the "SAC" charge had been in effect during the year 1971, a total of $338,918.00 would have been charged to tl�e City of fridley. Under the previous method or" billirg a total of 5307,E�}6,00 o-ras charged io the City. This is a difference of y�81,072.00. The previous method of billing included an item called "Deferred Cnarges" in the ariount of $39,202.00. This charge was in the form of an advance to otfier comr;aniiies ir the area. Theoretically this money 4•io�ald have been returned to the City of Fridley at some future date. Tnis has the affect of further ircrzasing the difference between the taao rnethods of billing. For the year 1972, the City was bi]led $364,007.00 under the previous billing policy. This is equivalent of 2,700 one family housing starts, or an equivalent am�unt of co�:,n:��rcial and industrial construction. 6ased or an average "S(�r_° charc�e of 5358.00, this would cost fridley $966,600.00 over the �'ifteen year period or an average of $6�r,440.00 per year. For the thi- y year perio�, the increased flow is expected to be the equivalent of 5,6sU one family housing starts. Using an average connection charge of 5375.00, this would cost the City $2,101,250.00, or an average of $70,375.00 per year. One word of caution, for the "SAC" charge to be reduced to an average of �64,440.00 �er y2ar would mean that construction activity for the fifteen year period would be approximately one-third of what it has been for the past few years. The items that change on the sewer bill with the new method of billing are the reserve capacity �harges and tl�e current deferred charges. All other parts of the bill would remain the same. Substituted for the reserve capacity charges and current year deferred charges would be the "SAC" charges. The City should keep in mind that regardless of which method of billing the Metropolitan Sewer Board uses, the City has the option of collecting the money in any manner it chooses. That is, it could cplleCt ail the money from current u5ers, or put part of the cost on a connection charge basis and part on a user basis. As an examole, Coon Rapids has been collecting $150.00 per connection for several year5� and uses the money collected to help pay their operatinq costs. BRUNSELL, ASSISTANT CITY MANAGER/FINANCE DIRECTOR LAW SUIT ON SAC CHARGES NOVEMBER 17, 1972 The following communities are row part of the law suit on SAC charges: Brooklyn Center, Columbia Heights, Edina, Golden Valley, Plymouth, Robbinsdale, White Bear Lake, Hopkins, Maplewood, Forest Lake, Burnsville and St. Anthony. The following communities are still considering.the matter of whether they want to be part of the law suit: North St. Paul, South St. Paul and Fridlev. One of the contentions of the group which has filed the law suit is that the new formula penalizes the developing communities or inner ring suburbs. Among the reasons advanced for this is as follows: The SAC charges or reserve capacity charges, which the SAC charges replaced, are primarily for the retire- ment of bonds. The portion of the bond payments that is to be picked up by SAC charges is determined by the ratio of unused capacity of the lines to design capacity. As an example, if $10,000,000.00 in debt service were required for the current year, and current flow occupied sever�ty percent of the capacity of the facility, seventy percent of the charge would be put on current users and thirty percent on SAC charges. Developing communities in paying the SAC charges are paying the bulk of the cost of new construction. This also has the effect of reducing the reserve capacity charges, or reducing the percentage of reserve ca�acity and of increasing the percentage for current use. The developing community is adding each year to its current use even though it is paying the bulk of the large connection charges. Eventually the community will have paid a substantia7 amount in connection charges and also will pay for a percentage of the bonus forever until they are retired under the current use category. As new 6onds are sold, the split is made on the same ratio, tha*_ is, the ratio between current use and unused capacity so that the people who paid the connection charges nf $275.00 wilt also help to pay a large percentaye of new bonas sold for construction. 5 J NEWS RELEASE MUNICIPALTTIES FILE LAW SUIT AGAINST THE METROPOLITAN COUNCIL AND SEWER BOARD IN NATTER OF RESERVB SEWER CAPACITY CHARGES Plymouth Mayor Al Hilde and Brooklyn Center Mayor Phil Cohen, spokesmen for those municipalities opposed to the new SAC sewer charge formula adopted by the N4etropolitan Council, announced filing of a law suit in Hennepin County District Court challenging the Metropolitan Council's authority and decision. In proceeding with the court test the mayors pointed out that the author of the Metropolitan Sewer Bi11, State Senator Robert O. Ashbach, appeared with them before the Metropolitan Council's Referral Committee to testify that the proposed alteration to the �ewer charge formula was inconsistent with the intent oi ttie law and that such change could only be accomplished by the legislature. In addition to the communities named as plaintiffs in the law suit, it is expected that other communities aggrieved by the Metropolitan Council action will enter the suit as interveners. The mayors emphasized that the legal action is the last possible recourse at this point of time, having exhausted administrative appeals which were rejected by a majority vote of the Metropolitan Council. The rejections followed offers from municipal officials to work with the Metropolitan Council and Sewer Board in developing a more equitable formula for presentation to anci adoption by the State Legislature. Such pleas also were summarily reJec'ted by a majority of the Metropolitan Council members and Sewer Board. 5 K Mayors Hilde and Cohen stressed the irony of having to seek legal recourse to require appointive structures such as the Metropolitan Council and the highly insulated Metropolitan Sewer Board to conform to the provisions spelled out by the State Legislature.
