08/21/1972 - 00017171�� THE MINOTES OF THE REGULAR COUNCIL MEETING OF AUGUST 21, 1972 The Regular Council Meeting of the Fridley City Council was convened at 7 38 PM, August 21, 1972. PLEDGE OF ALL�GIANCE Mayor Liebl led the Council and the audience in saying the Pledge of Allegiance to the Flag. INVOCATION Councilman Mrttelstadt offered the Invocation. ROLL CALL MEMBERS PRESENT: Liebl, Utter, Mittelstadt and Breider MEMBERS ABSENT: None ADOPTION OF AGENDA Mayor Liebl said that under the second item on the Agenda, the adoption of the assessment roll for 1972 service connections, that Auditor's Subdivision #89, Part of Lot 1, Parcel 300 in the amount of $3,804.80 is to be deducted making the total for the assessment roll $20,289.31. MOTION by Councilman Mrttelstadt to adopt the Agenda as amended. Seconded by Councilman Breider. Upon a wice vote, al1 ayes, Mayor Liebl declared the motion carried unanimously. VISITORS. Mrs. Earl Ke11ar, 570 57th Avenue N.E. Mrs. Kellar said that about a month ago she had submitted a complaint about a neighbor that was repairing cars and trucks, painting and welding. She wondered what the ordinance was and what protection a citizen had against this type of annoyance. Mayor Liebl told Mrs. Kellar that the Public Safety Director had looked into her complaint, researched the ordinances and written a report. He asked that Mrs. Kellar be given a copy o� the findings in the report. COIQSIDERATION OF APPROVAL OF AGREEMENT WTTH WALL CORPORATION REGARDING RIEDEL PROPERTY DEVELOPMENT. AND CONSIDERATION OP SECOND READING OF OR➢INANCE FOR REZONING BY THE WALL CORPORATION ZOA #72-03 TO REZONE FROM R-1 TO R-3 THE AREA GENERALLY LOCATED ON 5TH STREET TO 7TH STREET FROM MISSISSIPPI STREET TO 63RD AVENUE Tabled August 7, 1972 The City Engineer said that a copy of the proposed agreement has been submitted to the Wall Corporation and the City Manager has been meeting with representatives of the Wall Corporation. He said that legal counsel �or both the owners of the land and the developers were in the audience. � � u REGULAR COUNCIL MEETING OF AUGUST 21, 1972 PAGE 2 � The Council noted that there were a few changes to be made on Page �lE oF the agreement which have already been dlscussed with Mr. Wall. Councilman Mittel- stadt said that the second reading of the ordinance should not be given until after the agreement is signed by both parties. Mr. Douglas Peterson, representing the Riedel estate, said that the Riedels will agree to dismiss the lawsuit against the City contingent upon settling this agreement and passing the ordinance and that the motion for dismissal would not be filed until this matter is closed. The Acting City Attorney said that Mr. Peterson had �ust talked to him in the hall, and he had agreed that Lhe lawsuit could be dropped upon the closing, however on second thought, he felt that it should be conditioned upon the rezoning of the land, rather than the closing. If something should happen, and the proposal fall through, the property would be rezoned� but they could still sue the City. Councilman Breider said that there was a small disagreement in the number of apartments allowed. The Council has specified 105 and Mr. Wall is asking for 108. He asked how much over the allowed density the R-3 area is. The City Engineer said that by approving this agreement, the Council is actually granting a variance both for the R-3 portion and the R-1 district, with a little over 8 units per acre in the R-1 townhouse area. Nr. Wal1 added that the difFerence between the 105 units and 1D8 is very minimal as far as ground coverage is concerned, and the main consideration should be the parking, but in this case, there is more than ample parking. Councilman MitLelstadt asked what is the area � of the apartment units. Mr. Wa11 said that he did not have the exact figures with him, but he would estimate the efficiencies would be about 500 square feet, the one bedroom about 700 square feet and the two bedroom about 900 - 1000 square feet. The City Attorney reported that after some calculating, 107 is the number of units that would be allowed under the ordinance for R-3 zoning, so Mr. Wall's request for 108 is only one over the allowable number. MOTION by Councilman Breider to authorize the Mayor and City Manager signing the agreement, after the following changes are made In Section 4. Townhouses, Item "A" should be °Individually sell all townhouses." deleting °and have them owner occupied." Item "B" should be "Have base selling prices of from $26,000 to $32,000 at 1972 prices ---". This changes $25,000 to $26,000 which was a typographical error. In Section 5. Apartments, Item "�1" should read "--R-3 contain a maximum of 108 apartments. ---" This changes 105 to 108. Seconded by Councilman Utter. MOTION by Councilman Mittelstadt to table this item until later in the Meet?ng tonight to allow time to make the pencilled changes to the original agreement, get the signatures of the Wall Corporation and the Riedel's and bring it back fully signed for the Council to see before consideration of the rezoning ordinance. CONSIDERATION OF REPORT REGARDING DOUGLAS OSIECZANEK, 101 CROWN ROAD, COMPLAINT REGARDING SAND BLOWING FROM MAIN STREET AND SWEEPING OF MAIN STREET: The City Manager reported that Pa�k Construction has been sweeping Main Street a minimum of three times per week, He said as he recalled Mr. Osieczanek also complained about the trucks speeding on Main Street. The Fridley Police ➢epart- ment has written 16 citations to trucks hired by Park Construction Company and the Minnesota Highway Department has issued 33 tickets for overload violations which totalled $2,501 in fines. When Mr. Osieczanek appeared before the Council he also complained about the sand blowzng from Midland Coop and seanted to know when they were going to blacktop as they were supposed to, The property complained of is south of the existing structure and is unpaved, The reason is was left unpaved is because they have been considering expanding and they did not want to put it in only to have to take it back out again. The City Manager said a letter has been written to the Manager of Midland Coop asxing them to keep the area oiled and also to provide screening slats in their existing fence. He said he felt that Midland Coop has been willing to do what they can do to help and added that he thought the trucks �ould be done hauling by the end oP the year. Mayor Liebl said that this problem has been going on for four years. There are homes across Main Street and when the wind blows, the sand accummulates on the window sills to a couple of inches thick He felt the people across the street � � , t i, REGULAR COUNCIL MEETING OF AOGUST 21, 1972 PAGE 6 � had a very valid complaint and that would be most annoying. He had thought that it was stipulated that they were to blacktop that area, and he would like to have them live up to it. The City Eng�neer said �hat they had agreed to blacktop the area north of their building and put in curbing and they have followed their plans. The area to L-he south Mr. Osleczanek talked about was not included in the agreement They have oiled that portion of their 1and, and they have agreed to do so again to eliminate the dust problem. His department has also requested them to provide slats in the screening to give some added protection from the sand. The City Manager added that unless that blacktop was part of the original agreement, the City is in no po- sition to insist that it be put in; only to request. That requesL has been made and the indication is that they are willing to comply, MOTION by Councilman Breider to receive the reports contained in Lhe Council Agenda. Mayor Liebl asked that Mr. Osieczanek be given a copy of the memo from the City Manager dated August 18, 1972 and a copy of the letter written by the Community Development Administrator dated August 18, 1972 to Mr. Red Torrey. CONSIDERATION OF SPECIAL USE PERMIT SP #72-09 BY NAEGELE OUTDOOR ADVERTISING COMPANY FOR A SIDE BY SIDE POSTER LOCATED AT 7940 UNIVERSITY AVENUE N.E. � The City Engineer reported that this sign would be �ust north of 79th Avenue on University Avenue. This was considered by the Planning Commission on Suly 19th - and was approved with many stipulations, which would make it very difficult for them to have the sign put up. They approved a 12'X25' single faced sign and stipulated that if there is construction of an �ndustrial or commercial building within 300 feet, the sign would have to be remo�ed, also when the constructicn of 79th Avenue is begun, the sign would have to be removed six months after the commencement of construction, since 79th Avenue would be an intersection which requires a sign to be 500 feet from the intersect�on 79th Avenue is proposed to be built next year and there is already some building being started in this area. Mayor Liebl read the motion aloud and asked Mr Hokemeir, of Naegele's, if he agreed with them. Mr. Hokemeir said yes, they are awa're of the stipula�ions and feel they can live with them. They know there is a large intersection planned here, but they take chances like this every day In many cases, the development talked of actually does not come about for several years. Mayor Liebl said that as he understood it, Naegele's would pay a fee to the property owner for the use of the property for the sign. Mr. Ray Pfeiffer said yes, the original request was for two signs side by side rather than back to back because of the many trees that would have to come down The Planning Com- mission said that the side by side signs were not possible, so now they would lik� to change their request to a back to back poster sign. � Mayor Lieb1 said that the City of Fridley and Naegele's have signed an agreement for Fridley to use one side of their billboards and Naegele's to use the other side for two different sites and he felt this has been to the mutual satisfaction of both parties, He said that the fee paid by IQaegele's would help the property ��, � REGOLAR COUNCIL MEETING OF AUGUST 21, 1972 PAGE 7 owner pay his taxes. Mr. Hokemeir added that i� it 4tas double faced, it is a double fee to the property owner. The City Engineer wanted to emphasize that 79th Avenue construction should start next spring. Councilman Mittelstadt asked what Naegele's would advertise. Mr. Hokemeir said that their customers would change, and the message would be changed every 30 - 60 days. MOTION by Councilman Breider to concur with the Planning Commission in all their stipulations with the exception that the sign may be double faced rather than single faced. CONSIDERATION OF AGREEMENT WITH SCHOOL DISTRICT #14 FOR EXCHANGE OF LAND AND COMMON OSE OF THE FACILITIES� The City Manager said that this agreement formalizes items that have been in practice for many years, and designates what land belongs to the school and to the City. MOTION by Councilman Breider to approve the agreement found in the Council Agenda on Pages #9 and #9A. Seconded by Councilman Otter. Upon a voice vote, all ayes, Mayor Liebl declared the motion carried unanimously. RESOLUTION #103-1972 - A RESOLUTION REQUESTING THE ANOKA COUNTY BOARD OF COMMISSIO�. FOR AN UNDERPASS ON MISSISSIPPI STREET RAILROA➢ CROSSING IN FRIDLEY• MOlION by Councilman Mittelstadt to adopt Resolution #103-1972. Seconded by Councilman Utter. Upon a voice vote, all ayes, Mayor Lie:hl declared the motion carried unanimously. - A RESOLUTION OPPOSING SENATE FILE 1861 RELATING TO A 40 LL TIME I'IREMEN: The City Manager said that this resolution is relative to an amendment to the Fair Labor Standards Act which would require municipalities which employ full time fire- fighters to pay them time and a half for a11 hours over 40 hours per week. This would be very costly and would break the tradition for firefighters putting in in excess of 40 hours in many places. Those excess hours are put in on duty, but sleeping and not actually working. This amendment would cost the State of Minnesota in excess of $6 million. MOTION by Councilman Mittelstadt to adopt Resolution #104-1972. Seconded by Councilman Otter. Upon a voice vote, a11 ayes, Mayor Liebl declared the motion carried unanimously. RECEIVING THE REPORT REGARDING WALKWAY TO ROBERT LOUIS STEVENSON ELEMENTARY SCHOOL• The City Manager said that the walkway, for the purposes of discussion could be divided into two sections. On the north section the people have been more receptive to the proposal than for the south portion. There have been many discussions with Mr. Bud Davis, but he is not objecting to the sideWalk in principle, they have just been negotiating the price of the easement. On the portion of the walkway between River Edge Way and the school property, there are four possibilities for the location and they are listed in order of preference by the school in the memo ' � Y' J � -6 . REGULAR CDUNCIL MEETING OF AUGUST 21, 1972 PAGE 8 � dated August 18, 1972. The problem with all four possible locations, is that there is one property owner bordering the walkway in each case who is opposed to the construction of the walkway. If the Council wishes to proceed, they should designate the preferred route and authorize the City Attorney to begin condemnation proceedings to acquire the easement ior the south portion of the walkway. Councilman Mittelstadt suggested the south portion be delayed for one year, Perhaps in a years time, the people would change L-heir minds. The City Manager said that the school has said that if the north sidewal]< is put in,they will cease to bus the children from the area. They would come out to East River Road on River Edge Way, then down a direct path to the school Councilman Mittel- stadt said that in that case, perhaps the whole pro�ect should be delayed one year. It was brought out that the school has a policy whereby if a child lives over one mile, or have to cross a ma�or thoroughfarn, they are bused, ln this case those on 63rd are bused and those on River Edge Way walk. The City Engineer said he understood the people received a notice from the school stating the children would not be bused this year. The City Manager said yes, he called the school when he heard about the notices and found that the school thought the City was going tn construct the sidewalk so they sent out the notices. Hr�wev�r, he has been assured that the school will continue busing until the sidewalk is completed. � Members of the audience voiced opposition to putting in the narth secLion without the south section because that would mean putting an additional 100 or so children out onto East River Road that are now bused. The audience asked where the four alternate routes were for the south sidewalk and the City Engineer showed them on the screen, and said that the City would favor #2 (between 132 and 136 River Edge Way) because the houses are the farthest apart and there are garages on each side. Mrs. K. Anderson, 132 River Edge Way said that with eith�r }{1 or �2, they would have the walkway beside them, on one side or the other. Mayor Liebl said that with A1 Rose Addition being developed, there would be more houses and more children. If it is not going in, the school should be notified so they can schedule the busing. MOTION by Councilman Mittelstadt to delay this entire project until June, 1973 and advise the school of this action, and request that the busing continue this fall. Seconded by Councilman Breider for discussion Councilman Sreider said that he would concur only because as he looks at this plan he is concerned that the children on 63rd would go down to East River Road rather than plow through the snow, simply because it is easier. Mrs. Harvey, 108 River Edge Way, asked iz there was any way to provide some more protection to the children that must walk on East River Road, such as a fence? Mayor Liebl said no, it is difficult to maintain Last River Road the way it is. It is maintained by Anoka County and there is no room for a sidewalk or a fence. � Mr Slater, 128 River Edge Way, said that in Lhe negotiations for the land, it seemed that a figure of $350 was offered, but if some oP the people wanted fencing, that amount was deducted. The City Manager said there was an independent fee appraiser hired and that it was felt that this way everyone could get a completely y L; REGULAR COUNCIL MEETING OF �TUGUST 21, 1972 PAGE 9 unbiased opinion. Any figures quoted could not be considered as firm and � final offers. Anyone wishing to see the appraisal is welcome to come in and look at it. The City Manager continued that it seemed to be more a matter of opposition to the sidewalk rather than a disagreement over the amount of the compensation. Mayor Liebl asked if it was not customary to have two appraisals. The Acting City Attorney said yes in a condemnation there are two. In matters such as these, sometimes the City hires one and the property owners another. In this case an independent fee appraiser was hired that had no interest in either side of the matter. Mayor Liebl said that this all comes down to spending so much money to possibly save the life of one child, and he for one, felt that it must be done. He said it was his duty and obligation to do what he felt was right even though it may step on someones' toes a little. He said he was very grateful to those people on the north section of the sidewalk that were willing to give the right of way needed to the City of Fridley. This is not something that would be assessed, but which every tax payer in the City would pay for. If a child gets killed walking on East River Road it will be a direct Council responsibility. He asked how much it would cost to put in both the north and south sections, not counting any condemnation. The City Enginear said that $4,000 was budgetted, this does not count acquisition costs, but covers construction and some fencing. Mayor Liebl asked if the construction of the sidewalk cost $8,000, would that be a waste of money? The Crty Engineer said that was a Council decision. During the first discussions when a roadway was proposed, the people did not want that, but wanted a walkway,.now they don't want a walkway either. In discussions with ' the School Board the Council has repeatedly approved this proposal and there have been some commitments to the school, and he felt Fridley owed the school some sort of an answer. During the hearings many people were in favor of the walk- way. Councilman Mittelstadt called for the question on the motion on the floor. THE VOTE UPON THE MOTION, being a roll call vote, Utter, Mittelstadt and Breider voting aye, Liebl voting nay, Mayor Liebl declared the motion carried. ORDINANCE #519 TO REZONE FROM FROM MISSISSIP: - AN ORDINANCE FOR REZONING BY THE WALL CORPORATION ZOA #72-03 I TO 63RD A I:�NI The Acting City Attorney reported that the original agreement has been changed as stated earlier in the meeting, the Wall Corporation and the Riedels have signed it, and it is ready to come back before the Council, therefore, he said he recommended adopting the Ordinance for rezoning on second reading. His only other suggestion is that the document be typed again later so that it wi11 appear as a neat legal document rather than a rough scratch copy. MOTION by Councilman Mittelstadt to remove this item from the table. Seconded by Councilman Breider. Upon a voice vote,all ayes, Mayor Liebl declared the motion carried unanimously.
