RES 1972-133 - 00008543266 RESOLUTION NO. 133 -1972 A RESOLUTION REGARDING BUILDING REQUIREMENTS FOR PHYSICALLY HANDICAPPED WHEREAS, the Minnesota Legislature in the 1971 session adopted Chapter 471 entitled UNIFORM MUNICIPAL CONTRACTING LAW; and WHEREAS, under the provisions of this law, the state has adopted rules and regulations relating to public buildings providing accessibility and usability features for physically handicapped; and WHEREAS, pursuant to said chapter, said rules are to apply to all buildings except single family and two family dwellings; and WHEREAS, said chapter provides that in case of practicable difficulty, unnecessary hardship, or extreme differences, the local authorities may grant exceptions from the literal requirements of this chapter; and WHEREAS, the council understands that the state authorities are considering adopting rules and regulations and /or requesting the legislature to amend said chapter to liberalize the requirements as they apply to multiple structures containing a limited number of units; and WHEREAS, the council finds that it is a practicable difficulty and an unnecessary hardship to apply said requirements to small multiple family buildings; NOW, THEREFORE, be it resolved that the City of Fridley shall waive such requirements for all multiple family structures containing eight or fewer units; said waiver to remain in effect until changed by the council.
