RESOLUTION NO. 3o_1977
A RESOLUTION AUTHORIZING ACQUISITION OF ADDITIONAL EASEMENTS
AND RIGHT OF WAYS FOR WATER, SANITARY SEWER, STORM SEWER, AND
STREET IMPROVEMENT PROJECTS
WHEREAS, it is necessary to acquire easements and right of ways for
the construction of Water, Sanitary Sewer, Storm Sewer, and Street
Improvement Projects as listed below:
1. Water, Sanitary Sewer and Storm Sewer: Project #106
a) A street and utility easement described as part of Lot 3,
Auditor's Subdivision No. 92, to provide additional right
of way from 61st Avenue between McKinley and Benjamin Streets.
b) A street and utility easement being part of Lot 9; Auditor's
Subdivision No. 22, to provide the West Half of the right of
way for Benjamin Street betwen 61st Avenue and Rice Creek Road.
C) A utility easement being part of Lots 4 and /or 5, Auditor's
Subdivision No. 22.
2. Street Improvement Project St. 1972 -1 and 1972 -2:
a) A street and utility easement being parts of Lots 18, 19, and
20, Auditor's Subdivision No. 92, to provide additional right
of way for Oakwood Manor North of Gardena Avenue.
b) A street and utility easement being part of Lot 49, Auditor's
Subdivision No. 92, to provide right of way for Arthur Street
South of Gardena.
c) A sidewalk easement being. part of Lot 1, Block 6, Rice Creek
Terrace Plat 6.
WHEREAS, the City Council previously determined that the Projects were
feasible and necessary and has ordered in the improvement,
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley
that:
The City Administration, assisted by the City Attorney
is authorized to acquire the said right of ways for
the purposes of the improvements of public utilites
and streets.
BE IT FURTHER RESOLVED, that if the Administration is not able to
acquire said right of ways upon terms agreeable to the City Council, that
the City Attorney is hereby authorized to commence condemnation action in
the Anoka District Court for the above described right of, ways,
