RESOLUTION NO. 73 -1972
A RESOLUTION ORDERING IMPROVEMENT, APPROVAL OF PLANS AND ADVERTISING FOR
BIDS: STREET IMPROVEMENT PROJECT ST. 1972 -10 (SEAL COATING)
WHEREAS, the City Council of the City of Fridley has established a
policy of Seal Coating the City streets on a regular basis,
WHEREAS, the City Engineer has submitted a plan showing the streets
in need of Seal Coating, marked as Exhibit "A ",
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fridley, Anoka County, Minnesota, as follows:
1. That the streets marked black on the attached map be seal coated,
and the work involved in said Improvement shall hereafter be
designated as:
STREET IMPROVEMENT PROJECT ST. 1972 -10
2. The plans and specifications prepared by the City Engineer for such
improvement and each of them, pursuant to the Council action here-
tofore, a copy of which plans and specifications are hereto attached
and made a part hereof, are hereby approved and shall be filed with
the City Clerk.
3. The work to be performed under STREET IMPROVEMENT PROJECT ST. 1972 -10
shall be performed under one contract.
The City Manager shall accordingly prepare and cause to be inserted in the
official newspaper advertisements for bids upon the making such improvements
under such approved plans and specifications. The advertisement shall be
published for two (2) weeks (at least 10 days), and shall specify the work
to be done and will state that bids will be opened at 11:30 a.m. on Monday,
July 10, 1972 in the Council Chambers of the City Hall, and that no bids
will be considered unless sealed and filed with the City Clerk, and accompanied
by a cash deposit, bid bond, or certified check payable to the City for five
per cent (5%) of the amount of such bid. That the advertisement for bids
for STREET IMPROVEMENT PROJECT ST. 1972 -10 shall be substantially in form
as that noted in Exhibit 4B" attached hereto for reference and made a part
hereof.

DAY OF JUNE, 1972.

Gentlemen:
The undersigned declares he has fully examined the plans and
specifications and all the contract documents on file in the offices
of the City Manager and City Engineer, all of which are fully understood
and hereby agreed to, and has inspected in detail the site of the
proposed work, and has familiarized himself with all local conditions
affecting the work and contract and the detailed requirements of
construction and waives all right to plead misunderstanding of any item
in relation to this project, Street Improvement Project No. ST. 1972 -10.
BID:
The undersigned agrees, that if this proposal is accepted, he is
to furnish and provide all necessary labor, materials, machinery, tools,
apparatus and all other means of construction and performing the work,
and to complete in strict accordance with the above mentioned plans and
specifications and contract documents, the seal coating of streets, all
as set forth in said plans and specifications and contract documents
for Street Improvement Project No. ST. 1972 -10, involving the following

The undersigned agrees that, if the City decides to diminish
or extend the work, or otherwise alter it by extras or deductions,
including the elimination of any one or more of the items, by an
amount not to exceed twenty -five per cent (25 %) of the Lump Sum
Bid Price, he will perform the work as altered, increased or de-
creased subject to unit bid prices as bid.
The undersigned agrees to enter into contract in form hereto
attached and to furnish a corporate surety bond as required by the
specifications, both within ten (10) days from 'his receipt of the
Notice of Award from the City, should this proposal be accepted. The
day after postmark date shall constitute the day of receipt of
notice. In the event of the failure of the undersigned to enter
into such a contract within said ten (10) days, then the amount
of bid security attached hereto is to be forfeited as agreed liquid-
ated damages to the City of Fridley.
