RESOLUTION NO. 154 -1973
A RESOLUTION ADVOCATING THAT FIRE FIGHTERS BE EXCLUDED FROM THE OVERTIME
PROVISIONS OF TEE PROPOSED AMENDMENTS BEING DEVELOPED TO THE FAIR LABOR
STANDARDS ACT
WHEREAS, changes 4ertain provisions of the Fair Labor Standards Act
are at this time beirp considered by Congress; and
WHEREAS, certain of these proposed changes relating to overtime would
work a hardship on cities and villages throughout the state; and
WHEREAS, those proposed changes relating to overtime would work a special
hardship on the cities and villages in the case of fire fighters because of
their unique situation and working conditions; and
WHEREAS, it is advantageous to both the fire fighters and the municipalities
to not alter this section of the Fair Labor Standards Act; and
WHEREAS, proposed changes would have a direct financial impact on the
cities and villages in the State of Minnesota by more than $6 million dollars
per year; and
WHEREAS, the work week of fire fighters is not directly comparable to those
of other municipal employees, as a typical work week for fite fighters might run
forty -eight hours on duty and twenty -four hours off; and
WHEREAS, fire fighters spend a relatively small percentage of their duty
hours responding to fire calls, and a far greater percentage of their time on
standby activities such as eating, sleeping, and recreation; and
WHEREAS, a forty -hour workweek has not been advanced in our labor negot-
iations with the fire fighters;
NOW, HEREBY, BE IT RESOLVED that the City Council of the City of Fridley
hereby goes on record as being opposed to inclusion of fire fighters in any
changes in the overtime provisions of the Fair Labor Standards Act; and
BE IT FURTHER RESOLVED that the City Council urges our representatives in
Congress to take note of the problems which would arise if fire fighters were
included in the proposed changes in the overtime provision of the Fair Labor
Standards Act, and the City Council further urges our congressional delegates
to oppose these provisions being included in any changes to the Fair Labor
Standards Act; and
IT IS FURTHER RESOLVED that the City Manager is hereby directed to forward
a copy of this resolution to Senator Humphrey, Sanator Mondale, Congressman
Fraser, and to the Chairman of the Senate Committee on Labor and Public Welfare.
