RES 1973-59 - 0000810097 RESOLUTION NO. 59 -1973 A RESOLUTION IN OPPOSITION TO THE PASSAGE OF HOUSE FILE 1389 ' RELATING TO ELECTIONS, ESTABLISHING A UNIFORM ELECTION DAY, RE- QUIRING THE SEPAR4TE ELECTION OF ALL OFFICERS, LIMITING SPECIAL ELECTIONS. AMENDING MINNESOTA STATUTES, 1971, SECTIONS 123.32, SUBDIVISIONS, 1, 4, AND 23, SECTION 205.09, SUBDIVISION 1, SECTION 205.18 SUBDIVISION 1, AND SECTION 205.20 REPEALING MINNESOTA STATUTES 1971, SECTION 205.07, SUBDIVISION 1, SECTION 205.09, SUBDIVISION 2, SECTION 205.18, SUBDIVISION 2, AND SECTION 205.19. WHEREAS, the Fridley City Council has received and carefully considered House File 1389 relating to elections, and WHEREAS, House File 1389 would establish the first Tuesday after the first Monday in November of even number of years as a uniform election day for all municipalities, school district, towns and public bodies with elected officials. NSELL WHEREAS, House File number 1389 would supersede any Charter or Law to the contrary, and WHEREAS, House File number 1389 would therefore, officially destroy the iniative and referendum provisions in all home rule charter pro - vided by municipalities, and WHEREAS, House File 1389 would provide that special elections to 1 fill an office or decide to the District Court by any question would be held only upon petition a 5% of the eligible voters and if the Court decides an emergency exists, and WHEREAS, House File 1389 would disrupt the existing terms of office of the present elected officials in the City of Fridley as provided by the City's Charter. NOW, THEREFORE, BE IT RESOLVED, BY THE COUNC #I, of the City of Fridley that the Council strongly urges the General Legislation and Veterans Affairs Committee to deny adoption of House File 1389 relating to elections.
