THE MINUTES OF THE SPECIAL MEETIWG OF THE FRIDLEY CITY COUNCIL OF APRIL 22, 1974
The Special Meeting of the Fridley C�ty Council was called to order at 5:30 P. M.,
April 22, 1974 by Mayor Liebl.

RECEIVIIVG REPORT ON MEETING WITH CABLE TELEVISION LICENSE BUREAU OF THE FEDERAL
COMMUNICA7IONS COMMISSION IN WASHING70N, D.C.:
Councilman Breider reported that they met �n the office of the Cable Television
License Bureau of the Federal Communications Commission in Washington, D. C. at
9-00 A.M., on Aprll 18, 1974. Those present representing the City of Fridley
were Counc�lman Nee and Councilman Breider; Mr. �ean Caldwell represented the
Fridley CATV Commission; Mr. Robert H�nkley represented General Television,
Inc.; and Mr. Robert McDonnel represented the Minnesota Cable Commission
Those present representing the Federal Communicattons Commission were Acting
Chief David Kinley, Mr. Stephen Effros and Mr. Gary Nansen, Attorney.
Mrs. Kinley had to leave the meeting at 9:30 A.M for some other appointment
and tne discussion cont�nued with Mr. Hansen and Mr. Effros. The C�ty
presented the material for ,7ustification of the $25,000 franchise fee and
5% of gross subscriber revenues to cover the City's costs. Mr. Nee said the
background data and material prepared by the City for present�ng its case was
qu�te well documented and the indications they got from the FCC were that there
will be no problem getting the 5% fee approved by them.

Mr Breider said that Mr. Hansen brought out four sections of the City's cable �
televis�on ordinance which they felt were inconsistent with the present rules
of the FCC, and they suggested the City write some kind of letter indicating
they would not enforce these rules until FCC rules were changed in the future to
permit such enforcement. A general discuss�on followed, and there was a concensus
that at the present time these sections of the ordinance would have very little
effect. Following are the feelings of the FCC on these four sect�ons of the ordinance:

The FCC said that production costs, cablecasting rates and signal send�ng rates,
should not be sub,7ect to the City's approval, but all subscriber fees could be
sub,7ect to the�r approval
405.251 Additian�] Services.
The FCC said this is under the �urisdiction of the FCC, and the City should
not �mpose approval requirements, but the City can have th�s information from the
company ,7ust for informational purposes.
405.253 Services to 6e Provided by the Company:
405 253(1) The FCC sa�d that companies w�ll have a difftculty filling the
channels furnished to public functions, so we should not have any problem in not
enforc�ng this, especially in the im tial stages.
405.253(3) The FCC said the City cannot impose such restrictions as the
channels have to be leased on a f�rst come, first served basis.
Mr. Nee indicated that �f we can submit a letter to that effect, the indication
was g�ven that the cert�ficat�on should be forthcoming in the next two to three
weeks, which certarnly would be a very fast action seetng the t�impo of the opera-
tion in Washington.

MOTION by Councilman Starwalt, seconded by Counc�lman Utter, to authorize the
Mayor to send a letter that the City will not enforce the above listed sect�ons
of the CATV ordinance until the Federal Communications Commission rules are changed
in ihe future to allow such enforcement Upon a voice vote, all voting aye, Mayor
Liebl declared the mot�on carried unanimously.
The meet�ng was ad�ourned by Mayor Liebl at 6:00 P.M.
