RES 1974-96 - 00007936C y� .- 1�7- RESOLUTION NO. 96 -1974 A RESOLUTION CONFIRMING ASSESSMENT FOR 1974 WATER AND SEWER MAINS, LATERALS AND SERVICE CONNECTIONS BE IT RESOLVED by the City Council of the City of Fridley, Minnesota, as follows: 1: The City Clerk has with the assistance of the engineers heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the 1974 WATER AND SEWER MAINS, LATERALS, AND SERVICE CONNECTIONS in said City against every assessable lot, piece, or parcel of land in accordance with the provisions of law, and has prepared and filed with the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece, or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet in regular session at this time and place to pass on the proposed assessment. 3. Said proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any to such proposed assessment, or to any item thereof, and no objections have been filed; except: Howard Crabtree, 7100 Riverview Terrace -- Questioned credit available Akbar Sajady, 6747 East River Road -- Questioned credit available 8081 Broad Avenue, L. 21 -24, Blk. J. Riverview Heights Addition, omitted. I 4. The amounts specified in the proposed assessment are changed and altered as follows: Lot 3 & 4, Block 1, Marion Terrace Addition -- Assessment of $1,782.48 deleted from this roll as owner has not yet done work. Assessment will be placed on subsequent roll; S. 5' of Lot 5 and Lot 6, Block 1, Scherer Addition -- Credit of $516.04 applied against assessment of $516.04, leaving -0- Balance; Lot 21 -24, Block J. Riverview Heights Addition, omitted assessment of $1,414.69, added to roll. 5. This Council finds that each of the lots, pieces or parcels of land enum- erated in said proposed assessment as altered and modified was and is specially benefited by the 1974 WATER AND SEWER MAINS, LATERALS, AND SERVICE CONNECTIONS in the amount in said proposed assessment as altered and modified by the corrective roll in the amount set opposite the description of each such lot, piece, or parcel of land, and that said amount so set out is hereby levied against each of the respective lots, pieces, or parcels of land therein described. 6. Such proposed assessment as altered, modified, and corrected is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment as altered, modified, and corrected, with the changes and alterations herein above made, are affirmed, adopted and confirmed as the proper special assessments for each of said lots, pieces, or parcels of land respectively. 7. Said assessment so affirmed, adopted, and confirmed shall be certified to said City Clerk and filed in his office and shall thereupon be and con - stitute the special assessment for 1974 WATER AND SEWER MAINS, LATERALS, AND SERVICE CONNECTIONS. RESOLUTION NO. 96 -1974 Page 2 8. The amounts assessed against each lot, piece, or parcel of land shall bear interest from the date hereto until the same have been paid at the rate of seven and one - half (72) per cent per annum. 9. Such assessment shall be payable in fifteen (15) annual installments payable on the 1st day of January in each year, beginning in the year 1975 and continuing until all of said installments shall have been pail, each installment to be collected with the taxes collectible during said year by the County Auditor. 10. The City Clerk is hereby directed to make up and file in the office of the County Auditor of Anoka County a certified statement of the amount of all such unpaid assessments and the amount which will be due thereon on the lst day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Starwalt, and upon a vote being taken, the following voted in favor thereof: All and the following voted against the same: None PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 16TH DAY OF SEPTEMBER, 1974.
