Mr. tiarris asked Mr. 6oardman if the City was going to need any of tht easement on Lots 6 and 7 when the easement for Lat 8 was jogged over. Mr. Kok said he had . no objection to part o ihe easement being retaind if they needed it to join up ith the new Pasement for Lot 8, but he would want to determine that his•garage wasn't on any part of he easement hey wanted to reain. He said the garage was 12 feet , back fro his house. ' ' .' ' Mr. 6oardman said the City would probably retain that part of the South 6 foot easement that lies 85:31 feet from his West property line, so that's the figure that Mr. Kok should us in measuring his property. MOTION b Drigans, seconded by Langenfeld, that the Planning Commission continue the consideration of a vacation request, SAV #75-05, b Rclard Kok, to reduce the drainage and utlity easement from 6 fcet to 0 feet on the South side of Lot 6, B1ock 1, Clark's Addition, the same being 6517 McKinley Street N.E., until August 6, .197, ta a11ow tzme fcr the Engineering L'epartment and the petitioner to agree onhow much af the South 6 fet easement the Citu may want to retain in the Southeast corner of Lot 6, and tiork out a new easement ayreement or Lot 8, B1ock 3, Moore Lake Park 2st.Addition. VERLYN VANDER LUGT: To vacate f property described as ihe to allow the construction Mr. Verlyn Vander Lugt was present. Mr. Qoardman said this was an old street easement. The only ,ray the Ciiy could use this easemni would be far access to tfe park property but the c7rade on this easement would not lend itself to such access, so this ttias street right of ay the City would never need. He said this righ of way continues from Siterts Lane all the way through the property purchaseu by Mr. VandPr Lugt. Mr. Drigans asked if this was a bulclable lot and if a home could be built on it without variances. Mr. Boardman said it was a bidable 1ot and he didn't think. any variances would be needed. Mr. Va.nder Lugt said that if the street right o way wasn't on Mr. Sivert's property, he had, in his purchase agreement? permissior from Mr. Sivert for a 33 ft. easernent to his praperty. . • tfr. Flarris said tlat if this easement was necessary, he should have a legal document drativn u by an attorney, and fi1 this along with his ded at the County. ke said the City shouldhave a copy of it also, in case an eme^gency vehicle would evEr have to get to his proerty. Mr. Bpardman said the Fngineering files wete lockec up so he was unable to get a copy of Registered Land Survey #3. lie said that if'this stree right of way was on Mr. Vander Lugt's property, he felt that it went at the way through on Tract C. Mr. Vander Lugt said he was certain that the 66 fooi: easement went through Mr. irert's property, because after the last Councii meetinq he had stated that he thought he would ask for a partial yacation of this right of way because his water supply ws on this easement. '• . Plannin Commission Meeting - July 23, 1975 ' Paqe 6 1 B Mr. Drigans asked if there wre any other easements on this property other than 1 , the street right of way? Fle asked how services were provided? Mr. 6oardman said the street right of way could be used for utility easements if services ever became avail- able in this area. ' , . Mr. Harris asked how sewer and water were handled in this area. Mr. Boardman said that sever and water were not availabie i`or this area, and they were a71 on- iand systens. Mr. Harris said he didn't think that the Metropolitan Waste Control Agency would allow that type of system any more. Mr. Boardnan said that all the property in this area had on-land systems. He said the lot size of Mr. Vander Lugt's property was suffiicient to qualify for this type of system. MOTION by Scott that the Planninq Commission recommend to Council approval of the vacation request, 5AV #75-07, by Ver.Zyn Vander Lugt to vacate the street easement . occpying tlie Easterl 66 feet of property described as the South part of Tract C, Registered Land Survey No. 3. ' 1 (ir. !{arris said there should probably be a stipulation on an easement hing granted on the othr portion of Lot C, if this was not street right o way. Mr. . Boardman said that if there vas street right of way on h1r. Vander Lugi's property, he was sure the right of way was on all ofi Tract C. Mr. Harris said this could be ' i roned out be-Fore thi s vaenf; to Counci 1. , ' ' ' ' , ' •. , ' Mr. Drigans said he thought they were rnoving too fast; on this recuest. h1r. Bardnan sai d that tfie fact hat there Gvas .going to be an on-1 and system on this propert;y was nothing that should concern the Planning Commission on the vacation request, because ihis met the Sta.te requirements and had alread,y been discussed by t;he C;ty Concil. He sid the street riyht of way that iii°. Vander Lugt wanted to vacate was street right ofway that -rhe City woulr.i never need, and if there was not street right of way on ;he balar7ce of Tract C, it was in the purchase agreement hat access wo«lc# bp rn;ed, ad this cauld be worked out legally if it was necessary. TiiE MOTION DIED FOR LICI OF A S`ECOND Mr. Scctt said there vre7Te na util7ties goifg to'this property. The City has agreed in principle to provide serice to the uimproved porion of tle road going into tiis property, that was plowing this road in the winter time, even if it was not improved. He said the oly thing :he Plaraniri Commission ras doing by no1; granting tfis vacation reques was denying t,e person to build a iouse. He has met every ather criteria in the work, that ar7y other breaucratic organization coud confrort him with, and he has overco,e i:hem all. The only thing that was stoppiig hi °om buildii7g h:s house was te fac that h couldn't build it on an easement. He said he tiiought they were placing an inordinate burden on the purchaser of this proerty and that Mr. Sivert had cooperated, the neighbors had cooperated and the p etiticner had been to several Council meetings to iron out a11 tha small problems on this property. The only thing thai: was keeping him frani building a home and iiving in FridIey was the fact that we ,rant to keep an easenent that will never be used, by staff's testimony. . Ir. Bercman asked if there were any other peaple present who had an interest in L`Il'ia reques. There as no response. Mr. Scott asked Mr. Qoardman -if he was correct in his assumtiorl? ` '. . Planning Commission Meetinq - July 23, 1975 • page 7 1 ., C Mr. Qoardman answered that he couldn't see any problem with vacating the street easement. There was absalutly no tie un that property. We cannot use that street easement because the grades are ioo steep i:o use it for access o the park property. It was actual]y a street easement that had no purpose. Mr. Qergman asked if it vras a normal practice to have easements retained for utilities on property. Mr. Qoardman said it was, but on these properties, utilities were provided by the property owner. He said that in this area, Tract A was park property. Tract C, D and E already have homes buil on them. Tract E could be served from Central Avenue, if utilities were available. Tract C and D could be served from Siverts Lane. Mr. Qoardman'said that if utilities ever didgo into this area, the easenent on Mr. Sivert's property could serve Mr. Vander Lugt's property. ' Mr. Drigans to1c1 Mr. Boardman that this particular parcel of land had been under discussion some time in the past`year, but he didr't recal1 the circumstances. Mr. Qoardman said it was discussed in the Park and Recrea±ion Comprehensive Pln. ' , LJ ' Mr. Driyans asked wliat the original purpose Nras for this street r.ight of way? Mr. .Boardman said it was there in case this area was 'ever platted. Mr. Drigans said that ifthis area was platted, then how would vre get access? Mr. Boardman said through the develoed portion of Siverts Lane. He explained that Parcel 500 was tax exempt proprty, which was being heid by the County for the County. Parcel 900 was in trust with the State of P1innesata, 4vhich was also beng held for purk property. • Nr. Sott said that even i' this was developed into a grandiose park they still couldn't use tiis easernent for a raad because of the steep grades. ' Nfr. Drigans asked holv the City got ccess to Parcel 620. Mr. Boardman said that at the present time they had access fromald Ceni:ral. He said this access was rather 17mited because ihis was such a v,ild area. ' Mr. Boardman said th only pr;vately ov,med property in tnis area was Parcel 1300 ;hich was owned by i=loyd Foslien, so there were other access pints available. Mr. Varder Lugt said that neither 'che realor oi~ himseif were aware af this ' easement on he property when he purchased it. Tiat`s why he was sosur that thas 66 foot easement was on all of Tract C. . ' J Mr. Drigans asked what would hapen i an ordinance was passed where everyone had to hoak up to City sewer and water? r. Boardman said that this wouldn`t affect this properLy unless th City put :n scrvices fo;^ his area. The people in this area couldn`t comply with such an ordinance Iecause there were no services avaiiable. Nlr. Drigans said that h fet this was part oF the problem. If we can't tell ' people in this area when services would be available n future planning for the City, this should be resolved.. ' ' Mr. Qergman said he though tie Plannirg Commission had discussed several poinis that were pertiren.t to this vacation, and h also thoaghi they had discussed a lot of points that were not necessarilygermane on this particular piece of land. He said tht the robems with Tract C were relatively immaterial to this particular request. ' • ' ' e ' ' ' , , Planning Commissio Mneting - Julv 23, 1975 Nage __ - 1D ,MOTION by Bergman, seconded b Scott, tha the Planning Commission recommend to Council approval of vacation reques, 5AV I175-07, by Vr1yn Vander Lugt, to vacate the street easement occupying the Eastcr.iy 66 fet of property described as the South part of Tract C, Registcred Lan Svrve No. 3, with the stipultion that the petitioner and the City Adm.inistration clarify thc street dedication South of 69th Avenue N.E. before this goes to the Council'. Mr. Drigans asked what he meant "'in princile'.'? Mr. Scott said it was City policy not to maintain anything but an improved road. CONTIfUED: VACATIO REQUEST, SAV #75-05, QY RICNARD KOK: Vacate the 6 foot drainage and utility easement on ;he South side of Lot 6, Block 1, Clark's Addition, the same being 6517 McKinley Street N.E. Mr. Richard Kok vaas present. Mr. Clark said this item had been continaed a couple of times, once because the petitioner was not present and another time to alloti the Engineering staff to determine the utility pat:erns in this particular block. He said there was a memo and a map in the agenda explaining the part of t'is easernent that had to be retained. Plr. Clark continued that the Engineering Deparf:ent had no objection to 85.31 of ihis easement being vacated on Lot 6, Blocic l, lark's Addition, but they N;ould need ;he balanc of this easement to line up 4ith an easment i;hey would need to fol lo the fot'til-SOUlII boundaries of Lot 7, alock 1, Clark's Addition, and Lot 8, alock 3, Poore Lake Parl: lst Addilion. He said the mapshoti,ed that the-existing gaage did encroach into the 6 foot easment. Gy retaining part of this easement, a very small portion of the garaqe ras still in the easement, but the recommendation was to allor this very small pori.ion to encroach into the easement. 1 Chairman Harris asi:ed if th Encineering staff was recommending that the 6 foot easement on he (orch bounda.,y of Lot 7 be vaca:ed also. ir. Clark said there vasn't any recommerdation, just that if it as vac.ated, to be sure the same part of this easement as retained as on the South side ofi Lot 6. Mr. C1ar{c said there -rere no uti 1 i ti es i n thi s easement, i:hey aanted to rei.ai n, but i 1' they have 1 ooked at the area, they would be aare tiat there vas a loti' spol: North of Lot 8, and EasL of Lot 6, and it mtst Lrap water. If the people in the area should ever petition the Ci;y to drain that low area, we would huve to have an easement to get a storm sewer back into this area, and feel that the logical alignment vould be betveen Lots 7 and 8. L f_J Mr. Drirans said he could see no purpose ta ;eep the 6 foot easement on the North side of Lot 7, if the easement was vacated on Lot 6,,except for the part needed fr a potential storm seer easement. A half of an easement wasn't good or anything. Pir. David Harris said he agreed witf 1r. Drigans. . Nir. Kol: asl:ed i f thi s smal l amount of hi s garage that woul d be al l owed to encroach ir► this easement would cause him problerns if he vrarted to sell i:his property. He thought he shoul d get some;hi ng i n tiri ti ng that ihe Ci ty voul d al low tii s encoachment. Mr. David f,arris said whaL P1r.
