DISCUSSIOI3 QN ALTERI'ATiVE METHODS FOR PROCSSING VARIANCE APPLICATIONS Chairman Drigans informed the Board that it has been suggested by various.people that any rvicess by which the City could sped up certain variance applications would enhance the building season in Fridley. He said specifically the area tha the Board should concern themselves with is the residential structures that .are currently existing where they propose an addition of living ar.ea or a garage addition. He said the process now, with the reorganization of the Commissions, requires that all requests from the Appeals Board funnel through the Planning Commission and then to the.Council. tie said it does delay the approval proces:; considerably and that may not 2ae a11 bad but in residential areas maybe ths Commission should look at alternatives and make a r_ecommendation to the Council. iie said there was a time when the Board had final approval on variances and to make the petitioners wait 3 ox 4 weeks for final action is putting the City in a bad ].ight for a 6 inch variance. He said people don't appreciai:e that. Chairman Drigans said his recommendation is to allow thisCommission to grant variances, on residential property, thai: had the unanimous approval of the Commission and no aUjections from anybody, public or the administraion or the Conunission, and that if ihere were stipulations attaclied ta the appxoval that everybody agreed to them. He said where those variances were granted, the people ' . I ` The Minutes of the.A eals Commission lSeetin of Se tember 16, 1975 Paqe 10 ` iould be al].owed to build and to get Council approval' after the fact. He said ,variances that had objections to them by anybody, would not be automatic, but would have to go t'tirough the Planning Commission withfinal action by the Council. Chairman Urigans added that the public hearing would be held and the adjoin9.ng propertX owners noified, and it could be stated on the public hearing notice tha xf the proposal was discussed and approved, tha this was the final action. Mrs. Wahlberg said there is a difference between new and existing resiciential structures and those other than residential. 5he asked Chairman Dxigans if she was correct in saying that the Board woul.d like to make the recommendation that the requests for variances to only existing residential structures would receive final approval if the Board so decided. Chairman Drigans said he thought the Board should not concern tkemselves with the industr.ial so much but worry more about the residential because that is where the real hardship is, where the homeowner knows nothing about the paperwork and tme involved a.n processing the applications. He said people sometime do no even know that they need a building permit and some want to get it done in the building season opposed to a contractor in the business who knows the Code and whose business ii is to know the Pror.adure to go through. Mrs. Gabel asked if the Board could safely say R-]. anly, that would include new and existing. She said if that would be the case now, the two requests tonight on the foundations, could have gone ahead. • ' Mr..Kemper stated the residential. variances only have small. areas that they afect whereasindustrial variances affect the cahole City. He added that the Council in mast cases, has gone along with the Board's opinion< He said if there would be any objection from the public, administrati.on or th.e Roard, then it would have to go through the Planning Commission and the Councit. Chairman Drigans asked what the administration's feeling was on this. Mr. Mattson , said the administration came up with thre possible speed up processes. He said ' #1 wauld be to change the order around, between the Planning Commission and the AppeaZs Commission so that while the public hearing notices are being sent out. to the adjoining property owners for the public hearing before the Appeals Commission, the request is going before the Planning Commission far consideration. He said #2 would be to give the Board final say on variances under specific instances< He said #3 would be to give the staff power to apprave variances in certain circumstances if they could get a letter of no objection signed by all the affected neiqhbors. Chairman Drigans asked the Board members xf they would feel any undue pressure if they knew that ii they objected to a variance, that it wou].d delay the petitioner 'by 3 or 4 weeks. He said nnw it zeally doesn't delay the applicant if a member votes nay, but if the new procedure was accepted, it would make a difference. Tdrs. Gabel said she would not feel threatened because usually as a whole, the Board agrees on the final action, rirs. Wahlberg said that it would be one sure way of having another Commission review the request if you felt you have any questions that. need to be J.00ked into further. Mr. Kemper said he wou].d agree with that procedure. Mrs. Wahlberq questioned the #1 procedure on when the apklications were su}amitted. application was submitted a day after the for saving time, because it would dePend She said ii: would no save ti.me if the Planning Commission meeting. f Chairman Drigans questioned the #3 pracedure as he said it would be vezy hard for '' tlte admiiiistration to say no to peol whothe come in contact with dai2y, such ; as conraci:ors and he felt it wul.cl be easier for the Board to act on the requests. , . . J The Minutes of tne A eals Commission Meetin of Se tember 16, 1975 Pa e 11 , . . • Mrs. i•TahZberg said this would put more pressure on the petitioner also, as he would have to go around getting the signatures, and this could take more time if the adjoining property owners lived out of town. Chairman Drigans said he felt the clean way to handle the applications for 'residential areas is for the Appeals Commission to grant the variances if there are no objections from anyone. Chairman Drigans statd that in any case, the City Code should be changed ta show that the adjoining property owners should be notified 10 days ahead o the meeting. Mrs. •ahlberg asked if the proper procedure would be to make a recommendation to the City Council to change the procedure anc to change :he,wordinq of the Code or would this also have to go to the Planning Commission. Chairman Drigans fe.t it should go to the Planning Commission and then to the Council. Mrs. Wahlberg said the administration may not concur with the Appeals Commission`s recommendation, as they may want to have the final say in some instances. Chaizman Drigans stated the Boar.d should list i-.e items they are concerned v:ith for xesidentiaT areas as opposed to commercial and industr5.a1. The Board agreed that their recommendation would be; ' To recommend,to the Planning Commission ancl the Council that the Appeals Commission be granted the power to grant variances in residential (R-1 Zoning) areas under the following conditions; 1. BILL}30FRDS Chairman Drigans informed tlie Board that during the last two meeL-ings, tie Planning Commission has been reviewizg billboards, and for the most part, the recommendations have been to grant the special use pexmits for continuance of the billboards with the stipulation that the time li.mit.caincides with the expiration of t}ie lease. Ne said that i:hey•were asking that Ordinance No. 584 be amended to include this recommendation and also to include something- that had just been policy before. 7his was the notification of all adjacent property owners tithin 200 feet of the variance location. Mr. Driganssaid the problem was the amoun of time it takes to process a variance (about six weeks) and this was aparticular hardship in a residential area. • The Appeals Commission felt this was a particular problem for people who did not know the procedure to follotv when they •anted to build a garage or an addition to their home. These people are usually not in the construction trade, aid i:hey rant to modify their residence in some vay, and are usually going to do the job themselves. They draw up their 1ans, have the financing, and then come in for a building permit. .Then they find out ihey need a variance 4rhic:h has to be approvea before th bui1ding permit can be issued. When they find out they vi11 have to wait a minumum of sixvreeks .o get variance approval it creates a lot of animasity. Residents relt they were being harassed by the administrative staff. These rrould be on residential property (R-i Zoning only}. All other zo;ing districts wouid go throughthe normal procedure. In order for'the Appeals Comm7ssion to give final approval four things would be necessary. 1. They have so many project committees going that this stipulation __ only allowed the Commissioner to give "tokenism" to the pro3ect camm7ttee. Lots 1,2, and 3, Block 15, Fridley Park Addition are located in neighborhood #9 (defined by barriers which include Mississippi Street, East River Road, and Burlington Northern Railxoad). The 1970 population for the area was approximately 232 total persons which included 13% between the ages of 0 to S and 26% between the ages of 5 to 15. This area has not been subject to population changes or moves which would be necessary to maintain a young population. Therefore, it can be anticipated that the population between the ages of 0 to 5 has decreased considerably and the 5 to 15 age group has remained fairly constant but will reduce ' in numbers over the next 5 years. This will mean an overall matur- ing of the neighborhood with a total reduction of the number of persons taking place. In Iooking at the recent housing statistics we can anticipate a fluctuation in the ovexall character of the neighboxhood over the next 10 to 15 years. There are a total of 60 units in the neighborhood of which approximately 56.8% are between 20 to 30 years old, 10% of the units are in need of major repair. 83.3% of the units are still owner occupied, however, this is somewhat below the City average. It is anticipated that the neighborhood will ehange primarily to a renter occupied neighborhood and will follow the comprehensive plan Page 2 . Neighborhood #7, directly West of Neighborhood #9 has a total of 21.8 acres of recreation areas,' park and school property, to satisfy a population which would only require 5.4 acres for any anticipated future population. These facilities could be easily used for the needs of Neighborhood #9 with the provision for safe access across East River Road. This access is anticipated with the provision of phase•3 of the bikeway systems plan. At present time there are signals provided at 61st and Mississippi Street along East River Road. Because of this data, the sizes of the lots in question and the administration of total 1ot size facilities I would recommend that these lots not be utilized for park facilities and efforts shDUld be transferred to providing safer access to available facilities.
