One of the proposals consists of the construction of a bypass storm sewer to handle the pealc flow during spring melt and heavy rains. It would be designed to maintain as natural a flow as possible in the existing creek bed. In conjunctian with this proposal, our survey crew has marked with yellow ribbon those trees that would have to be removed to construct this proposal. It is my opinion that said memo is as apPlicable now as it was nine months ago. If installed, the only realistic quarantee that can be made for an aeration system is that the fish-habitable porL-ion of Moore Lake will be extended to its et�tir� depth. In addition, if the aeraLors are operated through the winter, tr�e chance of fiski winter kill will be minimized. Wi U1 the winter }:ill threat remcved, the Minncsota Department of Natural Resources would be receptive to manaqing the fish popuZation through stoc};ing and other techniques. However ii� mus� be stated that aeration in itself does nat deal with the overall problems of 2�toore Lake. Urban development has resulted in the accelerated eutrophicai:ion of Moore Lake through the influx of nutrients and other pollutants from storm water runoff. To deal scientif icaZly and realistically wit.h any problern, attempts must be made to; 1. Defi.ne the problem. 2. Define the desired objectives and eventual use of the east side of Moore Lake. 3. Collect physical, hyclrol.oqical and bio3.ogical data. 4. Develope a plan for corrective action. Incorporated in this plan may belake restoration techniques currently being used by other qoveriimental agencies. Examples are: c�redging; la3,e bottom consolidation, sedimentation �onding, periodic street swecping of residential Z�eighborlioods, di_lution and f.lushing by adding fresh water, storm sewer diversion, first flush di.version, education of area resideni�s, etc. 5. Finance through local, st�ate, or federal monies for the plan for corrcctive action. To my knowledge there is no State assistance available. A federal program that has aut.liorized the issuaJice of $].5,000,000 in assistance is ciarrent].y receiving ap}�lications �or this money, Uut a].1 applications must have technical data substintiating any proposals. On November 10, 1975, the City Cou�;cil held a public hearing on the matter of adopting an ordinance authorizing On-Sale Wine Licenses. The Council had before them at that time a proposed ordinance relating to the issuance of a Wine License. This ordinance w as not adopted. The ordinance is being b rought before you at this time because of Bob Schroer's inqui ry. Pe rhaps the Coun ci 1 coul d adopt the ordi n an ce even though the re may be no immediate need. The proposed license fee for the tdine License was $2,000 per year, plus an additional $100 per year for Sunday sales of wine. I am attaching the material listed below relaiing to ihe above. Wine licenses, authorized by Laws i975, C.hapter 345, Section 4, which bccame effective August 1, may be issued witf�out numerica) iimit in addition to conventionai licenses. They may also b� issued in a city having a municipal liquor dispensary. . Only a restaurant inay be granted a wine license. Except as to seating capacity, the same qualifications apply as for on-sale liquor licenses; the restaurant must be "an establishment, under the �ontra! of a singfe proprietor or mana�er, having appropriate facilities for serving meals, and where, in consideration of payment therefor, meals are regularly served at tables to the general public, and whicii employs an adequate staff to provide the usual and suitable service to its guests.". IC must have facilities for seating at least 25 �uests at one time. The liquor control director is infernreting this lan��,age as not permittino the issuance of ►vine ticenses to clubs holding special club licenses. Anotherdifference is that a wine license permits only the on-sa(e of wine not exceeding, 14 per cent alcohol by volume in conjunction vvith the sale of food. Stron�er I Sc��temk�er 1975 ��� wine and other intoxicatin�; liquors still may be sold for consumption on the premises only under an on- sale fiquor license. The fee also is different in the two cases. A wine license may not be more than half the on-sale liquor license fee vr $2,000, �vhichever is lower. Thus, in a municipal liquor store city having no private license,, only the 52,U00 maximum app(ies to �vine license fees. � Unlike o►rsale licenses (except in a few special law situations), wine licenses must be approved by the state (iquor control director. As in the case of ot�er liquor licens�s, the application form is prescribed by the liquor control director thoiigl� the council may require additiona! information. Another difference concerns Sunday sales. Sunaay sales of aII k�nds of intoxicatino (iquor are p�rmitted only after a popular vote authorizing such sales an� then only by hotels, restaurants, or ciubs holdin� on-safe licenses. /� �vine license authorizes the sale af �vine on all days of the �veek "unless the issuing author�ty restricts the Iicense's authorization to the sal� of wine on all days other than Sunday." Nothing is said about a prior vote and the legislative in�ention evidently 4vas to leave to the council, the issuin� au:hority in the case of cities, sole discretion with re�ard to Sunday wine sales. Tt�e state liquor control director is so interpreting the law. � Since wine is included in the definition of intoxic�ting liquor in the state liq�.�or control act, restrictions in tt�at act on sale and consumption apply to rvine sales by �vine licensees. Restriction on hours apply to week-clay sales. Presumably Sunday sales are limited to the I�ours behveen 12 noon and miclni�;ht; at any rate, the council will tx� within the law if it limits sales to those hours. '�� Rest�ictions on sates to minors and to intoxicateci persons apply. So does the statutory procedure for suspension and revocation of (iquor (icensees. 7here is no express requirement for a bond in the ease of wine licensees. On-sale licensees must furnish a band of �3,000 to �5,000, the amaunt to be determined by the council, which may provide for liability insurance instead. This . provisior�� may not apply to wine licensees, but under the council's � authority to impose stricter segulalior�s, the council may make similar provision for a bond by ordinance.
