AN ORDItJAP�CE TO AMEND CHAPTER 302 OF THE FRIDLEY CITY CODE, ANIMAL CONTROL THE CITY COUNCIL OF THE CITY OF FRIDLEY DOES ORDAIN AS FOLLOWS: 302.01 DEFINITIONS The following definitions shall apply in the interpretation and application of this Chapter and the following words and terms, whereever they occur in this Chapter are defined as follows: (Ref. 462) • 7. A pet shop is any person, partnership or corporation engaged in the business of breeding, buying, selling or boarding animals of any species. 2. A veterinary hospital is any establishement maintained and operated by a licensed veterinarian for the diagnosis and treatment of diseases and injuries of animals. 3. Animals are any living creatures, domestic or wild. 4. An animal shelter is any premises designated by the City Counsil for the purpose of impounding and caring for animals held under au.thority of this ordinance. Such facility may be City owned or sh�lter service contracted. 5. Officer is any person designated by tfie City Council or emplayed as a law enforcement officer. 6. An animal Control Officer is a person, firm or corporati�n designated as animal contr•ol officer (ACO) whose duty sha71 be t� �eriodically patrol all sectionsof the City for th� purpose of ���icking up stray animals and to ����� ��������� ���X����� ���� �� ������ ��� ��X�� ������� �� ��� �� ����� ������ ��� ¢���� enforce all sections of t��e Animai Con±rol Ordinance throuqh the issuance of ordinance violatien citations; to p�ck �� and dispose of dead animals and to investigate all cases of animal bites reported to him/her and to ensure that all such dogs or anima]s are impounded in a secure place of confinement where the dogs cannot contact other animals or humans and are kept under observation as provided for by law or regulation. 7. An ������ W����� Animal Control Officer is any officer designated by the City Council, as a law enforcement officer; animal control �fficer or firm and any individual, contracted through the animal control officer or an individual, partnership, company or corporation directly appointed by the City Manager to perform animal contro] and animal census duties. The Animal Control Officer will be sworn to discharqe the duties of the Animal Control Officer before issuinq citations. 8. A dog is any animal of the canine species. 9. A cat is any animal of the feline species. 10. The keeping of three of more dogs or three or more cats on the same premises shall constitute a��� kennel. 11. A permit is the authority to keep a dog or other animal of the canine species within the City of Fridley. � ORDINANCE N0. Page 2 12. The dog or cat commits damage to the person or property of anyone other than the owner, or creates a nuisance upon the property of one other than the owner, except in the defense of the owner, his family or his property. 3. A female dog or cat in heat off the premises of the owner, unless confined in the process of being transported to or from the premises of the owner: While on the premises a female dog or cat in heat is not kept in a building or secure enclosure where said female dog or cat cannot be in contact with other male animals of its kind, except for planned breeding. 4. The owner does not assume the obligation and responsitility required of the City Code or does not prevent such dog or cat from committing any act which constitutes a nuisance as defined herein. 5. The owner or custodian keeps a dog or cat who �yS�y6� ��'¢,i��$ Y���,i;�¢,� barks, howls cries or yelps so as tn �iy� �xT��i$ ;�Yf� �YSi�►�� �� ¢�f�$� unnecessarlly �5����,� disturb��S�� or annoy��S¢� �� ��Y`��Yf� any person or erp sons residing in the vicinity thereof; or frequent school grounds or public beaches. The owner allows the dog or cat to chase vehicles or interfere with walking of pedestrians, the driving of automobiles, bicycles, motor- cycles, motorbikes, or snowmobiles on public streets, alleys, grounds or highways. 7. The awner allows a dog or cat to molest ar�annoy any person if such person is not on the property of the owner or custodian. 8. Every unregistered dog and every dog that runs at large or causes disturbance or noise in violation of the provisions of this ordinance is hereby declared a nuisance. 9. A person abandons any dog, cat within the bounds of the City of Fridley. 10. Owner or custodian fails to have dog or cat vaccinated against rabies at least once every two (2) years, or dog's vaccination has not been within the past two years. 302.041 REGISTRATION [This copy formerly under 302.045] A permit and animal tag shall be required for a dog to be maintained within the City of Fridley or other animal of canine species. [The following copy formerly under 302.061] No person sha17 own, keep or harbor any dog over the age of six months, within the City of Fridley unless a permit therefor has been secured. Permit certificates shall be issued by the City Clerk. It shall be the duty of each person owning, keeping, or harboring a dog to pay the permit fee established to the City Clerk on or before the first day of the permit year, or upon establishing residence in the City to forthwith-pay such permit fee. The Clerk may cause a notice of the necessity of paying such permit registration fee to be printed in the official newspaper in January of each year. Issue of new permits for the license year shall commence �������� X May 1 of each year. A compulsory system of permit and registration is established whereby the City will issue City owner permits and license tags to owners of dogs over six months of age upon proof of rabies vaccination within the preceeding year. Permits and tags must be applied for and obtained and tags affixed on dogs or other canines requiring tags , before they attain the age of six months. REGISTRATION ORDINANCE N0. Page 4 [The following copy has been in 302.041] The applieant for permit must sign and agree that he is prepared to comply with regulations established by the Gity Council. Upon -- payment of the permit tag fee the Clerk shall execute a receipt in duplicate, the original of which shall be delivered to the person who pays the fee and the dupTicate retained in the City records. The receipt shall describe the dog or animal as to breed, age, color, ow�er and address a minimum. 302.042 In addition to the permit, suitable animal tags, the shape or color of which shall be different for each registration year, shall be issued by the clerk and he shall issue one appropriate tag to the owner when the fee is paid. The owner shall cause said tag to be affixed by a permanent metal fastener to the collar or harness of the animal so registered, in such a manner so that the tag may be seen. The owner shall see to it that the tag is constantly worn by the animal. In case any tag is lost, a duplicate showing the payment of registration fee for the current year. A charge as provided in Chapter 11 of this Code sha11 be made for each such duplicate tag. If at time of initial registration a dog is due to be vaccinated within the next six months period, then a new vaccination shall be required before permit is issued. 302�. 043 It shall be unlawful to counterfeit or attempt to counterfeit the animal tag or take from any dog a tag legally placed upon it by its owner with the intent to place it upon another animal, or to place such tag upon another animal. 302.044 Rnimal tags shall not be transferable and no refunds shall be made on animal permit fee because of leaving the City or death of the animal before the expiration of the registration period. 302.4�5 [Copy formerly under 302.046, with copy from 302.045 now listed under 302.041] No permit shall be required of any humane society, veterinary hospital ar laboratory. ��z«�� [Numbering not needed, copy now under 302.045] 302.05 REVOCATION A permit, if not revoked, shall be valid during the license year. A new permit shall be obtained each license year by every owner and a new fee paid REVOCATION ORDINANCE N0. Page 5 302.051 The Council may revoke any permit if the person holding this permit refuses to or fails to comply with this Chapter, the regulations promulgated by the Council, or any state of local law governing cruelty to animals or the keeping of animals. 302.052 An animal permit and tag may be revoked if an owner fails to provide animals with sufficient good and wholesome food and water, proper . shelter and protection from the weather, veterinary care when needed to prevent suffering, and with humane care and treatment. Also, if an owner shall beat cruelly, ill treat, torment, overload, overwork, or otherwise abuse any animal, or cause or permit any dog fight, cock fight, bull fight or other combat between animals or between animals and humans. In addition such owner shall be liable to court action under this Code, State Statutes and local laws for any of the actions cited above. 302.053 If any person violating the terms of this ordinance 3 times in one permit year, his permit to own, keep, harbor or have custody of animal(s� for which the offense was cited shall be deemed automatically revoked and no new permit may be issued for a period of one year from date permit is revoked. 302.054 [Number added, but text of copy from 302.051] Any person whose permit is revoked shall, within 15 days thereafter remove such animal(s) permanently from the City of Fridley or humanely dispose of animal(s) cited in the violation being owned, kept or harbored by such person and no part of the permit fee shall be refunded. ,�pz,l��X [Text of copy now under 302.041] 302.062 LIVESTOCK See Ghapter 301 of this Code. 302.063 WILD ANIMALS AND BIRDS See Chapter 303 of this Code. 302.064 EXEMPTIONS The section of this Chapter requiring a permit shall not apply to non-residents of the City who are keeping only domestic pets, provided that animals of such owners shall be kept in the City longer than 30 days and that the animals are kept under restraint. The provisions of this Chapter shal] apply insafar as requirements for rabies vaccinations is concerned. LIVESTOCK WILD ANIMALS AND BIRDS EXEMPTIONS� ORD I �dANCE NO . Page 6 302.Q65 FEES The annual permit fee and expiration date shall be as provided in Chapter ll of this Code. 302.07 IMPOUNDING The Animal Control Officer, �(�i�i�x yJ�����f,� Law,En�orcement Officer or Hunane Society Shall take up and impound any dogs or animals requiring permits or tags found in the City wi:thout the tags; or any dogs or animals which are in violation of any of the other provisions of this ordinance. Animals shall be impounded in an animal shelter and confined in a humane manner. Impounded �¢�� animals shall be kept for not less than five days, �f�� including Sundays and Holidays, unless reclaimed by their owners. If by a permit tag or other means, the owner can be identified, the Animal Control Officer shall immediately upon impoundment notify the owner by telephone or mail of the impoundment of the animal. Not withstanding the provisions of this ordinance, if an animal is .found at large, and the owner or custodian can be identified, the Animal Control Officer, 6S�i,i��X w�t��¢�,� or Law Enforcement Officer may proceed against the owner for violation of the ordinance. The Animal Control Offi cer,� �{�f,i�i�,T �A����Vf and Law Enforcement Officers may enter ����i ��i,� ���i���� premises by warrant or as otherwise provided b� law where he has reasonable cause to believe there is being kept a dog or other canine species or cat or other feline specie which has hi�ten a human being,! or in pursuit of his/her duties as an Animal Control Officer enforcing all of the Animal Control Ordinance. 302.08 NOTICE OF IMPOUNDMENT Upon taking and impounding any dog or animal as provided in this ordinance, the Animal Contral Officer or Poundkeeper shall immediately notify the owner, if known, and the City Police Department. The Animal Control Officer, Poundkeeper,'and Police Department shall maintain a record of dogs and animals so impounded. 302.091 REDEMPTION OF IMPOUNDED ANIMALS In the instance of dogs or animals for which the owner does not have a required permit or tag, the Animal Control Officer or Poundkeeper shall not return such animal to the owner uritil a permit and tag, if applicable, have been purchased from the City Clerk's office or from the Animal Control Officer or Poundkeeper. The Animal Control Offider or Poundkeeper shal] remit to the City the sum paid to him for the permit or tag and if owner has not proof of rabies vaccinations, the cost of FEES IMPOUNDING NOTICE OF IMPOUNDMENT REDEMPTION IMPOUNDED ANIMALS ORDINANCE N0. Page 8 Whenever any doq or animal has bitten any person the owner or custodian of such doq or anima1, having been so notified by the Animal Control Officer or the Police Uepartment, shall irrmediately cause said doq or animal to be quarantined at the Cit.y of Fridley Contract Kennel Facility or at a licensed veterinary hospital or kennel for a period of 14 days after such person has been b�tten by said doq or animal. During the quarantine period, said doq or animal shall be kept under observatiQn to determine its condition and if it is found to be sick or diseased, the operator of the quarantine facility 'shall immediately report in writing to the Police Department and the Fridley Animal Control Officer, the condition of the animal. The Animal Control Officer shall then take necessary steps to determine if the dog or animal is suffering rrom rabbies. During the quarantine period, the doq or animal shall not be removed from the designated quarantine facilit� except by special written permission from the Minnesota Livestock Sanitary Board and the Fridley Animal Control Officer. The owner of such do� or animal shall be responsible for the cost of such quarantine. The quarantine required by this section shall not be necessary and the requirements shall be waived if custodian of such dog or anima7, immediately upon receipt o� the notice referred to above, resents to the Animal Control fficer or Police Departr�ent, the certificate of an authorized veterinarian that the doq or animal was vaccinated for rabies on a date less then two years prior to the date of such notice. Such animal so exempt shall be quarantined on the premises of the owner under strict control for a period of 14 days for the purpose of observation for symptoms of disease. The Animal Control Officer is authorized to conduct a mid-term and terminal examination of the animal. No Police Officer or other person shall kill, or cause to be killed any animal suspected of being rabid, except after the animal has been placed in quarantine and the diagnosis of rabies made. It shall be unlawful for any person other than an Animal Control Offi cer, ��i,ipi�X ►��y�A�yf or Ci ty Law Enforcment Offi cer to ki 11 or destroy any dog or animal of the dog kind found running at large in the City. Violations of the above shall be considered a misdemeanor. 302.12 VICIOUS ANIMAL [Section Added] No person shall keep or allow to be kept anyplace in the City any am ma o a erocious or v�cious c arac er, a i or aisposition or any am mal w�ld by nature, any do or animal s a e eemed to be vicious u on the occurrence of t4vo 2) �tes w�thin 365 calendar days except those occurring in defense of ihe owner or his ro erty. U on conviction or the violation of this section,the court may in addition to �mposition of sentence, direct the Animal Control Officer to VICIOUS ANIMALS� ORQINANCE N0. Page 7 immunication, and furnishing the City Clerk all necessary information pertaining to said purchase including a copy of any permit certificate issued in connection therewith. In addition the Animal Control Officer or Poundkeeper shall be paid by the dog or animal owner the impounding fee plus feeding and care for each day the dog or animal is confined in the pound. All monies received by the Animal Control Officer or Poundkeeper shall be turned over to the City Clerk, and shall be placed in the general fund of the City. 302.092 Any dog or animal for which the owner has a current permit tag may be redeemed from the pound by the owner after impounding by payment of impounding fee plus feeding and care for each day the dog is confined in the pound. Fees paid shall be in accardance with those established by the City Council. All monies received by the Animal Control Officer or Poundkeeper shall be turned over to the City Clerk and shal} be pTaced in the General Fund of the City. 302.10 UNCLAIMED IMPOUNDED ANIMALS Any�dog or animal which is not claimed within five days after impounding, ��� including Sundays or Holidays, may be sold for not less than the amount of the total charges accrued against the animal in accordance with this ordinance and Council resolution, to anyone desiring to purchase the dog, if not requested by a licensed educational or scientific institution under Minnesota Statues Section 35.71. All sums received by the Animal Control Officer or Poundkeeper shail be turned over to the City Clerk, and shall be placed in the general fund of the City. Any dog or animal which is not claimed by the owner, or by a licensed educational or scientific ins�itution, or sold, shall be painlessly put to death and the body properly disposed of by the Poundkeeper. The time of sale or other dispostion of the dog or animal shall be at least 120 hours after notice has been given to the animal owner by the Animal Control Officer or Poundkeeper. Page 9 take the animal in uestion into custod and forthwith dis ose of t P same as may be directed by the City of Fridley. 302.13 COMPLAINTS [Number change from 302.12] Any person complaining to the Police Department that a dog or other animal is allegedly running at large or otherwise constituting a danger or nuisance shall identify himself upon request and shall make every reasonable attempt to assist the authorities in identifying the dog and its owner or custodian. 302.14 MI;ZZtING [Number change from 302.13] COMPLAINTS MUZZL I P�G Whenever the prevalence of hydrophobia renders such action necessary ta protect the public health and safety, the Mayor shall issue a proclamation ordering every person owning or keeping a dog to confine it securely on his premises unless it is muzzled so that it cannot bite.• No person shall vic�late such proclamation, and any unmuzzled dog running at large during the time fixed in the proclamation shall be killed by the Po1i�e, the Animal Control Officer without notice t� the owner. 3U2.15 KENNELS [Number change from 302.14] Because the keepinq of three or more doqs or three or m�re cats on the same premises is subiect to qreat abuse, causing_ discomfort to persons in the area, by waY of smell, noise, hazard and �eneral aesthetic depreciation, the keepin� of three or more dogs and cats or any combination thereof on one premises �s hereby declared a nuisance. The keeping o_f three or more doqs or three or more cats on the same premises, whether owned by the same person or not and for whatever purpose, kept, shall constitute a Rennel; except that a fresh litter of pups/kittens mav be kept for a period of three months before such keeping sha11 be_deemed to be a kennel. No persan sha1T keep or riaintain a kennel in the City of Fridley except upon obtaining a kennel license consistent with the zoning requirements of this Code. Application for kennel license shall be made on forms provided the City. Such application shall show the following: 1. Location of the premises of the kennel. 2 Location of atl structure for the housinq of the dogs and/or cats If said dogs andior cats are to be kept �rimarily w�thin the home or buildinq of residence ot the applicant or of any other person the application shall so stat_e. Any dog runs and housing for do�s shall be a minimum distance of 200 feet from an_y buildinq siructures suitable for human habitation, public place where foad is boucLht, stored or eaten. 5. The premises for the keepinq of dogs shall be fenced and a simple plat showincZthe locatio� of fencinq shall be furnished. The fencing must be of such quality as to contain the dogs and/or cats. 6. Method to be used in keeping the premises in a sanitary condition. 7. Metho� ta be used in keepin�the dogs and/or cats quite. 8. The application shall contain an a�reement by the applicant that the premises may be inspected by the City ai all reasonable times. The City Council shall have discretion whether to issue such license or not. In makinq such determination, the Council shall take into consideration the adequacy of housin�q the runs for the doqs and/or cats, the method used for sanitation and to maintain quite, facilities for containinq the do s and/or cats, and with particularity any violations durinq the previous license period. If a license is c�ranted and the applicant thereafter fails to comply with the statements made in the app1ication or an.y oiher reasonable conditions imposed, or violates anv other provisions of this ord�nance, the licensee shall be notified by mail and �iven ten days to remedy an� defects or defaults. If such conditions be not remedied in said ten da� hearinq shall be held after at ieast ten days mailed notice to the licensee, and the licensee and all other in�erested parties shall be heard. If it shall appear that sai� kennel is not beinq properly maintained, the Council may revoke the kennel �icense and the keeping of three or more doqs, ar cats, or any combination thereof, immediately sha11 be discontinued. It shall be unlawful for any licensee te do or permit any of the following: 1. AllowincLany of the doQS to run at larqe on any street or pub1ic property or any private property not owned by the ]icensee or under his contr�l. 2, Allowinq the premises to be kept in an unsanitary or unhealthful condition. 3. Burning of offal waste. 4. Allowing the docZs or cats to bite or scratch anyone properly on or off the premises. a r - ORDINANCE N0. Page 11 5. Maintaining any dogs noise, odor or otherwise. lp or fight so as to disturb or cats so as to create a nuisance by way of 302.151 KENNEL LICENSE FFE The annual license fee and expiration date shall be as provided in Chapter 11 of this Code. • 302.16 APPOINTMENT OF OFFICER [Number change from 302.15] The Council may appoint such person, persons, or firm as the Council may deem necessary and advisable as Animal Control,Officer ��� ������ w�����. Such appointees sha11 work under the direct Supervision of the Fridley Police Department and shall be responsible for the enforcement of this ordinance. 302.17 ENFORCMENT BY OFFICER [Section Added] Animal Control Officers and Law Enforcement Officers shall hav� police powers in the enfcrcment of this ordinance. It sha11 be unlav�ful for any unauthorized�erson �o break open t_he pound, or attempt to do so, or to take or set free any animal taken � such ofr"icer in the compliance with this ordinance, or in any wa interfere with, hinder, or molest such officer �n the discharge of his dutv under this ordinance. 302.18 GUARD DOGS,-WARNING [Number Change from 302.161] Businesses located within the City and maintaining a guard dog for security purposes shall post notice at the entrance to the premises warning of the presence of said dog. 3Q2.181 GUARD DOGS,-AUTHORIZATION [Number change from 302.1G2] Businesses mainta nin� a guard dog shall file with the City a release authorizing the police or fire departments to shoot said dog in an emergency situation if necessary in order to.allow the police or fire fighters to gain admittance to the premises in the performance of their duties. 302.19 PENALTIES [Number change from 302.17] Any violation of this chapter is a misdemeanor and is subject to all penalties provided for such violation under the provisions of Chapter 901 of this Code. 302.20 SEEING EYE DOGS PERMITTED IN PUBLIC PLACES fSection Added� Whenever any blind person accompanied by a'seeinq eye' or guide doq presents himself/herself for accommodation or service on any KENNEL LICEN` FEE APPOINTMENT OF OFFICER ENFORCEMENT BY O�FICER 0 GUAP.D DOGS WARNING GUARD D�GS AUTHORIZATION PENALTIES SEEINu EYE DOGS ;� � C ORDIi�ANCE N0. = Page 12 public conveyance vehicle or to anv cafe, restaurant, store, or other �lace of business open to the public, it shall be unlawful for the proprietor, manaqer or operator of such vehicle or place of business to refuse admission to the doq or service to the blind person. 302.21 CRUELTY TO ANIMALS [Section Added] CRUEL7Y TO ANIMALS Minnesota Statutes 346.20 throuqh 346.34 are hereby adopted b� reference and shall be in full force and effect in the City of Fridley as if set out here in full. Luce EMS Project Coordinator On May 14, 1975, your assistant, Mr. Colbert, affirmed by the attached letter the Council's action of May 5 attested to in the enclosed agreement our use of the "City's i.5 million qallon reser- vair site, as shown on 'Exhibit A'." . The second paragraph of the agreement indicates that we were ex- tended,"certain antennae similar and adjacent ta the Anoka County Communications Center antennae." k�e are now ready to execute the agreement and begin construc- tion at that site, and find two conditions have changed since the May 5th action by the Council. This le�ter requests clarification because of these two changes, which are: 1. The Federal Communications Cor.mission will no longer allow the small lattice antenna (a picture of which I've attached - the artwork in the picture is shown in black, but the antenna and tower are actually white), but instead requires a full, round, open grid antenna 4 feet in diameter, on a11 new systems. 2. Because of change #1 above, the mechanical configurations of mounting from the center of the tank is not sufficient. t�le are requesting as we have proposed (please see the enclosed modified photograph) a mechanical mounting exclusive of the tank, but im- mediately adjacent to it on the top of a communications tower which would not exceed the height of the tank. The tower is identical to that on the roof of your Gity Hall build- ing and would be supported by attachment to the edge of the tank; the new 4 foot antenna would attach directly to the tower at an elevation that would not stick up above the tank, on the south side. Anoka, Champlin, Brooklyn Center, Brooklyn Park and'other contiguous areas. , Ta background you briefly about our program: aboui one-year ago Hennepin County became a grantee of the Robert Wood Johnson Foundation after national competition in which 44 awards were made from 252 applicants for funding of up to $400,000 to design and develop EMS systems. At the time of aur original application and up to the present time, we have included the areas served in Anoka County by Mer�y and Unity Hospitals and the associated ambulance service in our planning. The residents of your community will be served directly on a daily basis by the implementation of our program through the cooperation of all public safety services and all local governmenta] officials. The use of the ground reservior tank as a radio site is essential to our comr►unications network development. This site will have receiving and re-trans- mitting equipment located there which will relay voice signals from the para- medical (EP1T) personnel and heart rhythm signals from the patient to either Mercy or Unity hospitals or other area health care facilities where the medical situatian will be revie�ved and instructions given in response. Hennepin County will maintain a 24-hour radio watch to assist personnel performing in your community also. Mercy and Unity Nospitals presently receive an average of 24,400 emergency ambulance runs per year from the Mercy/Unity Ambulance service. This radio system will directly support those f�ospital and ambuiance services now enjoyed by your taxpayers - at�no additional cost to them. i ,,.. . � . `, Page 2 . Hennep.in County EMS Project The City of Fridley May 5, 1975 r . Comnunications engineering studies have shown that your ground reservior tank will provide for optimum radio signal utilization. There are no other sites that can serve this communications network in ihe South end of Anoka County as well. On several occasions Hennepin County EMS staff planners have met with Mr.. Richard Sobiech, City Engineer and Mr. Harry Hilagas of the Anoka Cen�ral Communications Center to determine all of the technical details concerning the mounting of an identical antenna network as the present one, to the top of the tank. Mr. Sobiech has said that a drawing by his department would be submitted showing the mounting configuration that he would approve. Meetings have also � been held with Mr. Terry Steeden of the North Area Repeater, Association, a group of amateur radio operators sharing the site.�Determinations have been made thai na harmful interference would result by the addition of the EMS radio equipment.
