RES 1977-61 - 0000713692 R I I� it I, RESOLUTION NO. 61 -1977 A RESOLUTION AUTHORIZING TRANSFER OF ROADWAY RIGHTS, PERTAINING TO NORTH INNSBRUCK DRIVE EXTENSION INTO NEW BRIGHTON, TO THE CITY OF NEW BRIGHTON RESOLUTION OF THE CITY OF FRIDLEY PERTAINING TO THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: Commencing at the Southeast corner of the South Half of the North Half of the Northeast Quarter of the Southwest Quarter of said Section 19; thence North along the East line of the Southwest Quarter of said Section 19 on an assumed bearing of N 00 18' 04" E for a distance of 33 feet to the actual point of beginning of the centerline to be described; thence N 890 59' 33" W parallel with the South line of said North Half of the Southwest Quarter for a distance of 1369.17 feet; thence on a tangential curve to the left with a radius of 3311.58 feet for a distance of 399.51 feet; thence S. 830 05' 43" W, tangent to the last described curve, for a distance of 470.91 feet more or less to a point on the West line of the Southwest Quarter of said Section 19, said point being 705 feet South, as measured along said West line, from the Northwest corner of the Southwest Quarter of said Section 19 and there terminating. WHEREAS, the City of New Brighton wishes to construct Palmer Drive over a portion of the above described easement in accordance with its normal policies of installing sewer, water, underground utilities and then a nine inch crushed rock surface throughout one winter and paving it and putting in curbs and gutter the following year; and, WHEREAS, the terms of the Agreement dated the 14th day of November, 1970, between Rojolo, a limited partenership, Acres, Inc., a Minnesota corporation, Rodney Billman, Inc., a Minnesota corporation, and the City of Fridley, provides that a party of the first part as owner of the property consents to the conveyance or dedication by parties of the second part of said easement to the City of New Brighton for road purposes; and also consents to the use of said easement for road purposes by the City of Fridley. Be it hereby resolved that upon completion of construction, the City of Fridley does hereby consent to convey any and all of its interest in said road ease- ment for the purpose of constructing and maintaining a road on all or part of the above described property to the City of New Brighton, formerly known as the Village of New Brighton; and WHEREAS, the City of New Brighton agrees to maintain ingress and egress while construction is underway and perpetually thereafter FURTHER RESOLVES that the appropriate city officials are hereby authorized and directed to execute and deliver any and all documents to accomplish the aforesaid end.
