RES 1978-35 - 000069035'7 RESOLUTION NO. 35 -1978 A RESOLUTION ORDERING IMPROVEMENT, APPROVAL OF PLANS AND ORDERING ADVERTISEMENT FOR BIDS: STORM SEWER IMPROVEMENT PROJECT #,125 WHEREAS, Resolution #41 -1973 set the date for hearing on the improvements, as specifically noted in the Notice of Hearing attached thereto for reference as Exhibit "A "; and WHEREAS, all property owners whose property is liable to be assessed with the making or the improvements (as noted in said notice) were given ten (10) days notice by mail and published notice of the Council hearing through two (2) weekly publications of the required notice, and the hearing was held and the property owners heard thereon at the hearing, as noted in said notice; and WHEREAS, Resolution #72 -1973 adopted by the City Council of the City of Fridley ordered this improvement. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley, Anoka County, Minnesota as follows: 1. That the following improvement proposed by Council Resolution #41 -1973 are hereby ordered to be effected and completed as soon as reasonably possible, to -wit: Storm Sewer Outfall To serve the area bounded by Matterhorn Drive on the West; Interstate 694 on the South; Gardena Avenue on the North; and the City of Fridley Municipal boundaries on the East. That the work involved in said improvements as listed above shall hereafter be designated as: STORM SEWER IMRPOVEMENT PROJECT #125 ' 2. That the construction of the storm sewer outfall shall be installed by the City of New Brighton through a joint powers agreement. The plans and specifications have been prepared by the City of New Brighton pursuant to the Council Resolutions heretofore adopted, in cooperation with the City Engineer of the City of Fridley, which plans and specifications are hereto attached and made a part hereof are hereby approved and shall be filed with the City Clerk. 3. The work to be performed under STORM SEWER IMPROVEMENT PROJECT NO. 125 shall be performed underone or more contracts as may be deemed advisable upon receipt of bids. The City of New Brighton in cooperation with the City of Fridley, City Engineer, shall accordingly prepare and cause to be inserted in the official newspaper advertisement for bids upon the making of such improvements under such approved plans and specifications. The advertisement shall be published for three (3) weeks (at least 21 days), and shall specify the work to be done and will state that bids willbe opened and considered at 11:00 a.m., on the 5th day of May, 1978, in the Council Chambers of the New Brighton City Hall, and that no bids will be considered unless sealed and filed with the City Engineer, and accompanied by a cash deposit, bid bond, or certified check payable to the City for five percent (5%) of the amount of such bid.
