RESOLUTION NO. 79 -1979
A RESOLUTION RECEIVING THE PRELIMINARY REPORT AND AUTHORIZATION EXECUTION
OF AGREEMENT TO WAIVE A PUBLIC HEARING ON THE MATTER OF THE CONSTRUCTION
OF CERTAIN IMPROVEMENTS: STREET IMPROVEMENT PROJECT ST. 1979 -1 ADDENDUM #1.
WHEREAS, the construction of certain improvements is deemed to be
in the interest of the City of Fridley and the property owners affected
thereby.
BE IT RESOLVED, by the City Council of the City of Fridley, as follows:
1. That the preliminary report submitted by the City Engineer is hereby
received and accepted.
2. That the City Clerk shall act to ascertian the name and address of the
owner of each parcel of land directly affected or within the area of
lands as may be proposed to be assessed for said improvements, and
calculate estimates of assessments as may be proposed relative thereto
against each of said lands.
3. That the area proposed to be assessed for said improvements and each
of them as noted in said agreement are all the lands and areas as
noted in said agreement. All of the same to be assessed proportionately
according to the benefits received.
4. That the estimates of assessments of the Clerk shall be available for
inspection to the owner of any parcel of land as may be affected thereby.
5. That all property owners whose property is liable to be assessed with the
making of the improvements have signed an agreement requesting the improve-
ments and constitute 1005% of the property owners who will benefit from the
improverent and do waive the right to a public hearing which is allowed
under the normal procedures set forth in Minnesota Statutes Chapter 429.
