RES 1979-87 - 00006785152 0 RESOLUTION NO. 87 -1979 A RESOLUTION VACATING A TEMPORARY CONSTRUCTION EASEMENT FOR STORM SEWER AND UTILITY PURPOSES REGARDING PROJECT SS -12, CONDEMNATION NO. 26120. WHEREAS, the construction of certain improvements were deemed to be in the interest of the City of Fridley and the property owners affected thereby; and WHEREAS, pursuant to a Petition filed by the City of Fridley with , the Clerk of District Court of Anoka County of January 25, 1966, an Order was made, by the District Court of Anoka County on April 20, 1966; filed April 25, 1966 with the Clerk of District Court and filed with the Register of Deeds on April 26, 1977 in Book 714, Pages 406 through 421 as part of Condemnation No. 26120, Project SS -12, declaring the necessity of acquiring easements in and on certain described lands for storm sewer and utility purposes, and declaring that such proceedings were completed under M.S.A. 117.20 and the City of Fridley then became the owner of said easements on the said lands as shown; and WHEREAS, Project SS -12, Condemnation No. 26120 is completed and the temporary construction easements acquired as part of such project are no longer needed by the City of Fridley. BE IT RESOLVED, by the City of Fridley, as follows: 1. That the temporary construction easements acquired by the City of Fridley to complete Project SS -12, Condemnation 26120, herein referred to be vacated. 2. That the City Clerk shall execute to all such affected property owners upon request a Quit Claim Deed on behalf of the City of Fridley indicating that any temporary construction easement interest the City may have has been vacated.
