NOTICE OF HEARING ON IMPROVEMENTS
STREET IMPROVEMENT PROJECT 5T. 1980-1, ADDENDUM #2
WHEREAS, the City Council of the City of Fridley, Anoka County, Minnesota,
has deemed it expedient to receive evidence pertaining to the improvements
hereinafter described.
NOW, THEREfORE, NOTICE IS HEREBY GIVEN THAT on the 9th day of June, 1980 at
7:30 o'clock P.M. the City Council will meet at the City Hall in said City,
and will at said time and place hear all parties interested in said
improvements in whole or in part.
The general nature of the improvements is the construction (on the lands and
streets noted below) of the following improvements, to-wit:
CONSTRUCTION ITEM
Street improvements, including grading, stabilized base, hot-mix bituminous
mat, concrete curb and gutter, storm sewer system, water and sanitary sewer
services and other facilities located as follows:
Hillcrest Avenue
41st Avenue N. E.
81st Avenue
California Street
Hickory Drive to 410 Feet'North
Main Street to California Street
University Avenue to Main Street
41st Avenue N. E. to One Block South
ESTIMATED COST --- �162,000
THAT THE AREA PROPOSED TO BE ASSESSED FOR SAID IMPROVEMENTS IS AS FOLLOWS:
All of the land a6utting upon said streets named above and all lands
within, adjacent and abutting thereto.
All of said land to be assessed proportionately according to the benefits
received by such improvement.
That should the Council proceed with said improvements they will consider
each improvement separate, except as hereafter otherwise provided by the
Council all under the following authority, ta-wit: Minnesota Statutes 1961,
Chapter 429 and laws amendatory thereof, and in conformity with the City
Charter.

The Burlington Northern is the owner of property
fronting cn streets proposed to be improved in
connection with Street Improvement Project St. 1880-1,
Addendum #2.
The Burlington Northern hereby protests the improvement
o£ those streets - heing 41st Ave., N. E, and
California Street - as we feel those improvements
would in no way benefit the property of the Burlington
Northern.

AN ORDINANCE UNDER SECTION 12.07 OF THE CITY CHARTER TO
VACATE STREETS AND ALLEYS AND TO AMEND APPENDIX C Of THE
CITY CODE
The Council of the City of fridley do ordain as follows:
SECTION 1. For the vacation of a drainage and utility easement described as
follows:
The South 160 feet of that part of a 10 foot drainage and uti1ity
easement 10 feet on either side of the common lot line of Lots 5
and 12, Block 2, Paco Industrial Park.
Ail lying in the South Half of Section ll, T-30, R-24 City of
Fridley, County of Anoka, Minnesota.
Be and is hereby vacated.
SECTION 2. The said vacation has been made in conformance with Minnesota
Statutes and pursuant to Section 12.07 of the City Charter and
Appendix C of the City Code shall be so amended.

RESOLUTION ORDERING IMPROVEMENT AND FTNAL PLANS AND SPECIFI-
CATIONS AND ESTIMATES OF COSTS THEREOF: STREET IMPROVEMENT
PROJECT ST. 1980-1, ADDENDUM #2
WHEREAS, Resolution No. 50 - 1980 adopted on the 19th day of May 1980 by the
City Council, set the date for hearing on the proposed impravements, as
specifically noted in the Notice of Hearing attached thereto for reference as
Exhibit "A", and
WHEREAS, all of the property owners whose property is liable to be assessed
with the making of these improvements (as noted in said Notice) were given
ten (10) days notice by mail and published notice of the Council Hearing
through two (2) weekly publications of the required notice, and the hearing
was held and the property owners heard thereon at the hearing as noted in the
said notice.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley, Anoka
Lounty, Minnesota as follows:
1: That the following improvements proposed by Council Resolution No. 49 -
1980 are hereby ordered to be effected and completed as soon as

AGREEMENT BETWEEN MUNICIPALITY APID
COUNTY FOR FEDERAL-AID HIGHWAY IMPROVEMENT
TtiIS AGREFMENT made by the City of FXidley , Minnesota,
hereinafter called the "Municipality" wiCh the County of �O� �
hereinafter, called the "County", WITNESSETH:
WHEREAS, the United States. Government, through the Federal Highway
Administration of the U. S. Department of Transportation does apportion Fed-
eral funds for the construction, reconstruction and improvement of highway
projecte on approved systems of public roads, and,
WHEREAS, said approved syatems within the limits of a Municipality
are naw oz may�be eligible for the participation of theae Federal funds in
their improvement or construction, and
WfiEREAS, the Federal Highway,Administration as a condition to the
use of Federal funda on approved Federal-1,id projects requires the agreement
o£ the Municipality to control road signa, traffic control devicea, ad�er-
tising signs, miecellaneous installations, speed and parking.
NOW, THEREFORE, THE Municipa'lity in consideration of the expendi-
ture and use of Federal funds for the construction, reconstruction or'im-
grovement of any Federal-Aid Street or Eiighway within the limite of the
Muaicipality agrees with the County ss follaws:
(1) No aigne, traffic control devices or other protective de-
vices atiall be erected on any Federal-Aid project within the Municipality
limita except as shall conform with the current Manual on Uniform Traffic
Control Devices for Streets and Highways of the State of Minnesota.
(2) All right-of-way within the limita of the Municipality on
any Federal-Aid project shall be held and maintained inviolate as a public

vice devicea or other private installations other than utilities of puhlic
interest, and no slgna, other than traffic oontrol or protective devices
shall be pexmitted within the right-of-way limita of the projecta. The
Municipality will with respect to such items aa ara within its juriediction
which may be or cause an obstruction or interfere with the free flow of
traffic or which may be or cause a hazard to traffic ar which may vitiate
.the uaefulnesa of the ptoject shall remove or cause Yemoval of the eame at
the request of either the County or the Federal Highway Administrator.
(3) The apeed limits on any Federal-Aid project shall be not
leas than 30 miles er hour.
(4) The Muaicipality shall by ordinance and continued enforce-
ment prohibit all types of parking eucept patallel paxking on any project
financed in whole or in part with Federal funds. The City agrees that
the State may enforce the provision by an action for specific.per£ormance,
mandamus, or other appropriate remedy and by withholding any funds due
the Municipality in possession of the State. •
